Hi Sherman,
Per our conversation, attached is our DRAFT Special Conditions for the pier permit transfer applications for the piers at 320 and 322 Buena
Vista. Please review and feel free to provide comments/edits as redlines.
A couple things to note:
1. The last condition addresses the alternative approach of retaining the current pier abutting the former 322 Buena Vista address.
2. Once we agree on the language of these special conditions, I will give this to Lisa who will proceed with the transfer via her usual
process. I believe she has already completed her field verification, so the rest should go quickly.
3. For reference, attached are the original applications.
4. For clarity, the address at 322 Buena Vista no longer officially exists. The address for the combined properties is now 320 Buena Vista.

Residential Pier Permit Transfers
320 and 322 Buena Vista Boulevard
On March 9, 2022, two pier permit transfer applications were submitted to the City. Because of
the unusual circumstances concerning this property and the associated piers, approval of the pier
transfers is based upon and subject to these special conditions.
1. The current lot with the street address of 320 Buena Vista is the result of a merger in 2017
of two separate lots: 320 Buena Vista and 322 Buena Vista.
2. The property at 320 Buena Vista shared a pier with 316 and 318 Buena Vista, and that
pier was located within the prolongation of the property lines of 316 and 318 Buena Vista.
In 1988, the City Council approved a pier reconstruction project which would position a
new pier adjacent to 316 and 318 Buena Vista. However, because of the unusual
curvature of the land along this section of Buena Vista, and because the original pier had
been positioned within the prolongation of the property lines at 320 Buena Vista, the City
Council allowed the newly reconfigured pier to be shared equally between 316, 318 and
320 Buena Vista.
3. The property at 322 Buena Vista had a permit for the abutting pier.
4. Subsequent to the lot merger in 2017, no application had been made for transfer of either
of the two pier permits. However, the owner of the newly-merged lot continued to use both
piers.
5. Newport Beach Municipal Code Section 17.35.020(A)(7) states in pertinent part: “In single-
unit and two-unit residential districts, only a single pier and slip shall be permitted bayward
of each parcel or lot.” Accordingly, the merged property at 322 Buena Vista may not have
more than one pier.

6. The applicant desires to retain use of the shared pier with 316 and 318 Buena Vista and
intends to demolish the pier abutting his property at 320 Buena Vista.
7. Therefore, the City approves transfer of the shared pier permit associated with 316, 318
and 320 Buena Vista to the applicant.
8. The City approves transfer of the pier permit for the pier abutting 322 Buena Vista on a
limited basis to allow the applicant time to obtain the necessary permits and approvals
from the City and regulatory agencies for demolition and removal of the pier. The pier
permit shall expire and be invalid after six (6) months. The City may grant an extension of
the permit upon a showing that the applicant has been diligently working to demolish and
remove the pier.
9. Alternatively, and within the six (6) month period, if the applicant proposes retain the pier
abutting the former 322 Buena Vista address and relinquish his joint permittee status with
the pier abutting 316 and 318 Buena Vista, the pier transfer may proceed under those
circumstances.
