Each of us is a 1/3 owner of the pier which has served 316, 318, and 320 Buena Vista under an agreement recorded in 1988. We know that 320 and 322 Buena Vista (Lot 161) were merged and that Stephen Rogers built a new home on the merged property before he died. The home is now owned by Ed and Uz Shea. We understand that the City Department of Public Works has determined that It will not issue a pier permit to the Sheas for both the 1/3 interest in the shared pier and in the separate pier which extends in front of Lot 161, and that the Sheas have appealed that decision to the Harbor Commission. We have no objection to the Sheas enjoying both the 1/3 Interest in the pier which Is shared with us, as well as enjoying the pier in front of Lot 161. We ask the Harbor Commissioners to support the Sheas appeal of the decision from the Department of Public Works. ht'^4 DocuSlgned by: G. We have new neighbors, Ed & Liz Shea, who purchased 320 Buena Vista after Stephen Rogers passed away. When Rogers built his new home, Rogers enjoyed shared use of 1/3 of the pier and float associated with 320 Buena Vista and a separate pier and float from 322 Buena Vista. We have been informed that the City has been unwilling to transfer the pier permits for both piers to the Sheas and that the Sheas have appealed this decision to the Newport Beach Harbor Commission. We support the Sheas appeal and ask that the Harbor Commission allow the transfer of the pier permit for the former 322 Buena Vista as well as the pier permit for the shared 1/3 dock associated with 320 Buena Vista. The Sheas are not asking for any change, only to receive the rights which Rogers possessed and which the Sheas should receive when purchasing the property. Thank you.
