Thank you for your note below. To answer your questions:
1. Yes, the variance application link below is what should be used.
2. Regarding the mailer list, I have already generated the owners and residents at the locations noted on the attached exhibit which
represents the required 300’ radius. (As you can see, water is not included in the calculation.) I have already directed staff to create
mailing labels and attach to envelopes in anticipation of your variance request and/or appeal. I will generate the letters as well, and
mail.
a. This is how I normally do these public notices for the Harbor Commission, and, in my opinion, is part of the prescribed fees.

A couple quick questions on the variance, please. Your April 21st email, below, provides a link to the Community
Development Planning Permit Application (for variance). It sounds like this is the proper application, which Community
Development will likely forward to Public Works for consideration. We plan to complete these Community Development
application materials for the variance, unless you direct us otherwise.
In addition, your email states that you will “”handle” the radius map materials for both applications. Sherman asked me to
let you know that we’d handle getting the “notice list” for the variance. If you have any questions about this, please let us
know.

Sherman,
I am in receipt of your emails today concerning the 320 and 322 Buena Vista pier transfers, and your preliminary questions co ncerning the
appeal and variance processes. I will attempt to address each process below.
Appeal Staff’s Decision to Harbor Commission
1. Earlier this week, I provided you a draft response letter to the pier permit transfer application. You indicated you had suggested
comments. Upon our mutual agreement, I will sign and transmit that letter to you.
2. If desired, you may appeal that decision. Appeal forms are located via the City Clerk’s office here:

i. Note that the form must be physically submitted to the City Clerk’s Office. Please also note the required fee. ($1,250 –
PWB018)
ii. (The $2,130 fee you previously mentioned is for construction plan check appeals.)
iii. I will handle the mailers and radius map.
3. Appeals to the Harbor Commission are public hearings. Public notice via newspaper, on-site posting, and letters to residents are
required.
a. The next available date for a HC public hearing is June 8 at 5:00 p.m.
Request for Variance
1. A variance may be requested via the Community Development Department who would likely forward to Public Works for consideration.
2. Variance application is located here: https://newportbeachca.gov/government/departments/community-development/planning-
division/applications-forms-and-fees#Variance (Planning Permit Application)
a. The variance application fee is here: https://newportbeachca.gov/home/showpublisheddocument/131/637731673541200000
b. Note the fee is $5,380 + $508 for public noticing.
c. I will handle the mailers and radius map.
3. The same schedule noted above also applies.
Please also note that upon submitting the above forms and fees, I will review and determine the timing for both actions as they relate to the
Harbor Commission. Further thought is required as to whether one request precedes the other, or whether both are heard at the same meeting.
I will be out of the office tomorrow, but available next week to discuss as needed.
