HomeMy WebLinkAbout2025-65 - Creating the Newport Beach Police Headquarters Assessment CommitteeRESOLUTION NO. 2025-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CREATING THE NEWPORT BEACH POLICE HEADQUARTERS ASSESSMENT COMMITTEE WHEREAS, Section 200 of the City Charter, of the City of Newport Beach ("City"), vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the City Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges or procedures granted or prescribed by any law of the State of California; WHEREAS, at its meeting on September 23, 2025, the City Council voted to consider the formation of an ad hoc committee to evaluate potential sites and assess the feasibility, cost, and design of constructing a new Newport Beach Police Department ("NBPD") headquarters; WHEREAS, the current NBPD headquarters, located at 870 Santa Barbara Drive, was constructed in 1973 and no longer adequately meets the operational needs of the NBPD; WHEREAS, the City's Public Works Department completed a use survey of the existing NBPD headquarters, along with a comprehensive needs assessment, to evaluate current space utilization and future requirements; WHEREAS, the use survey determined that the existing facility comprises 49,284 gross square feet, while the needs assessment concluded that a new headquarters should be a minimum of 73,000 square feet to adequately accommodate the Patrol Division and include a properly designed firearms training and shooting range; and WHEREAS, the City Council desires to create the Newport Beach Police Headquarters Assessment Committee to evaluate potential sites and assess the feasibility, cost and design options for a new NBPD headquarters. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Resolution No. 2025-65 Page 2 of 3 Section 1: The City Council hereby creates the Newport Beach Police Headquarters Assessment Committee ("Committee"), the purpose of which shall be to evaluate potential sites and assess the feasibility, cost and design of constructing a new Newport Beach Police Department headquarters. Section 2: The Committee shall be an ad hoc advisory committee. The term, appointment process, membership, responsibilities, and expiration shall be done in conformance with this resolution and Attachment 1, which is incorporated herein by this reference. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative portion of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Resolution No. 2025-65 Page 3 of 3 Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution. Harp City Attorney Attachment 1: Description of the Newport Beach Police Headquarters Assessment Committee ATTACHMENT 1 NEWPORT BEACH POLICE HEADQUARTERS ASSESSMENT COMMITTEE AUTHORIZATION: Established by Resolution No. 2025-65 adopted on October 14, 2025. MEMBERSHIP: Three (3) Councilmembers appointed by the Mayor and confirmed by the entire City Council. MEMBERSHIP TERM: Membership shall be indefinite, pending expiration or termination of the Committee. Committee members shall serve at the pleasure of the City Council. MEETINGS: Committee meetings will be held as necessary or convenient for the Committee. PURPOSE & A. Evaluate potential sites for a new Newport Beach RESPONSIBILITIES: Police Department station headquarters and provide recommendations to the City Council; B. Assess the feasibility, cost and design of developing a new Newport Beach Police Department station headquarters and provide recommendations to the City Council; and C. Such other related matters as directed by the City Council. EXPIRATION: The Committee shall expire upon making its recommendations to the entire City Council at a noticed public meeting of the City Council, or December 31, 2028, whichever is earlier.
