Highway, on the northwesterly corner of Newport Boulevard and

Applications
If approved, the applications under consideration will allow the construction
of a 50,000 sq.ft. cancer center facility with a related covered walkway by
Hoag Memorial Hospital. A use permit is required in order to allow construc-
tion in the Unclassified District, and to allow construction of a 35 foot
building within the 26/35 Foot Height Limitation District. Also requested is
the provision of off-street parking based on a demonstrated formula and the
approval of a modification so as to allow a portion of the required parking to
be compact spaces. Acceptance of a Traffic Study and an Environmental Document
are also requested. Use Permit procedures are contained in Chapter 20.80; Mod-
ification procedures are in Chapter 20.81; and Traffic Study procedures are in
Chapter 15.40 of the Newport Beach Municipal Code.

If desired, sustain, modify or overrule the decision of the Planning Commis-
sion.
Planning Commission Action
The Planning Commission reviewed the proposed project on September 4, 1986, and
voted (All Ayes) to approve the Traffic Study and Use Permit No. 1421(Amended),
and to accept the Environmental Document. The Findings and Conditions of
Approval are listed below:
A. ENVIRONMENTAL DOCUMENT
Findings:
1. That an Initial Study and Negative Declaration have been prepared in
compliance with the California Environmental Quality Act, the State CEQA
Guidelines, and City policy, and that their contents have been considered
in the decisions on this project.
2. That based on the information contained in the Initial Study, the project
incorporates sufficient mitigation measures to reduce potentially signifi-
cant environmental effects, and that the project will not result in signi-
ficant environmental impacts.
B. TRAFFIC STUDY
Findings:
1. That a Traffic Study has been prepared which analyzes the impact of the
proposed project on the peak hour traffic and circulation system in
accordance with Chapter 15.40 of the Newport Beach Municipal Code and City
Policy S-1.
2. That the Traffic Study indicates that the project -generated traffic will
neither cause nor make worse an unsatisfactory level of traffic on any
'major', 'primary -modified', or 'primary' street, so long as the committed
improvement at Newport Boulevard and Hospital Road/Westminster Avenue is
constructed.
Condition:
1. That prior to the occupancy of the proposed project, the applicant shall
contribute a proportional share as determined by the City, to the
Circulation System Improvements for the intersection of Newport Boulevard
and Hospital Road/Westminster Avenue.

C. USE PERMIT NO. 1421 (AMENDED)
Findings:
1. That the proposed development is consistent with the General Plan and the
adopted Local Coastal Program, Land Use Plan, and is compatible with
surrounding land uses.
2. The project will comply with all applicable City and State Building Codes
and Zoning requirements for new building applicable to the district in
which the proposed project is located, except those items requested in
conjunction with the proposed modifications.
3. The increased building height will result in more public visual open space
and views than is required by the basic height limit, in that the proposed
building is a maximum of 6 feet higher than the existing upper level
elevation.
4. The increased building height will result in a more desirable architec-
tural treatment of the building and a stronger and more appealing visual
character of the area than is required by the basic height limit.
5. The increased building height will not result in undesirable or abrupt
scale relationships being created between the structure and existing
developments or public spaces, in that the proposed structure is similar
in height to the adjacent Villa Balboa development.
6. The structure will have no more floor area than could have been achieved
without the use permit for the building height.
7. Adequate off-street parking and related vehicular circulation are being
provided in conjunction with the proposed development.
8. The proposed number of compact car spaces constitutes 25 percent of the
parking requirements which is within limits generally accepted by the
Planning Commission relative to previous similar applications.
9. The proposed Use Permit No. 1421 (Amended) and modification for compact
parking will not, under the circumstances of this particular case, be
detrimental to the health, safety, peace, comfort, and general welfare of
persons residing or working in the neighborhood of such proposed use or be
detrimental or injurious to property and improvements in the neighborhood
or the general welfare of the City and further that the proposed modi-
fication is consistent with the legislative intent of Title 20 of this
Code.
Conditions:
1. That development shall be in substantial conformance with the approved
plot plan, floor plan, and elevations, as modified by the preferred design
alternative one, except as noted below.
2. Development of site shall be subject to a grading permit to be approved by
the Building and Planning Departments.

3. That a grading plan shall include a complete plan for temporary and perm-
anent drainage facilities, to minimize any potential impacts from silt,
debris, and other water pollutants.
4. The grading permit shall include a description of haul routes, access
points to the site, watering, and sweeping program designed to minimize
impact of haul operations.
5. An erosion, siltation and dust control plan shall be submitted and be
subject to the approval of the Building Department and a copy shall be
forwarded to the California Regional Water Quality Control Board, Santa
Ana Region.
6. The velocity of concentrated runoff from the project shall be evaluated
and erosive velocities controlled as part of the project design.
7. That grading shall be conducted in accordance with plans prepared by a
Civil Engineer and based on recommendations of a soil engineer and an
engineering geologist subsequent to the completion of a comprehensive soil
and geologic investigation of the site. Permanent reproducible copies of
the "Approved as Built" grading plans on standard size sheets shall be
furnished to the Building Department.
8. Prior to the issuance of the grading permit, the design engineer shall
review and state that the discharge of surface runoff from the project
will be performed in a manner to assure that increased peak flows from the
project will not increase erosion immediately downstream of the system.
This report shall be reviewed and approved by the Planning and Building
Department.
9. That erosion control measures shall be done on any exposed slopes within
thirty days after grading or as approved by the Grading Engineer. Any cut
material stockpiled on the site shall be placed in such a location and
manner as to prevent transport of silt or soil off site.
10. Existing on -site drainage facilities shall be improved or updated to the
satisfaction of the City of Newport Beach.
11. Any exposed slopes shall be planted as soon as possible to reduce erosion
potential. No slope established on the site shall exceed 2:1.
12. The grading plan shall include a complete plan for temporary and permanent
drainage facilities to minimize any potential impacts from silt, debris
and other water pollutants. The existing 42-inch storm drain shall be
extended if necessary.
13. If groundwater seepage is found to occur on the project site, the plan
design should not block the seepage. Blockage could include higher water
pressures which might influence slope stability.
14. A paleontological monitor shall be retained by the landowner and/or
developer to attend pre -grade meetings and perform inspections during
development. The paleontologist shall be allowed to divert, direct, or
halt grading in a specific area to allow for salvage of exposed fossil
materials.
TO:

15. Archaeological, paleontological, and historical resources within the
coastal zone shall be investigated in accordance with acceptable
scientific procedures and appropriate mitigation measures (including
testing, salvage or presentation) shall be adopted on a case -by -case basis
in accordance with regular City policy.
16. Should fossils be recovered, a paleontological report shall be prepared
for the project to satisfy the City of Newport Beach K-5 and K-6
requirements.
17. If resources are recovered, they shall be donated to an appropriate
natural history museum or foundation, such as the Orange County Natural
History Foundation or the Los Angeles County Museum of Natural History.
18. A landscape and irrigation plan for the project shall be prepared by a
licensed landscape architect. The landscape plan shall integrate and
phase the installation of landscaping with the proposed construction
schedule. (Prior to the occupancy of any structure, the licensed land-
scape architect shall certify to the Planning Department that the land-
scaping has been installed in accordance with the prepared plan.)
19. The landscape plan shall be subject to the review of the Parks, Beaches
and Recreation Department and approval of the Planning and Public Works
Department.
20. The landscape plan shall include a maintenance program which controls the
use of fertilizers and pesticides.
21. The landscape plan shall place heavy emphasis on the use of drought -
resistant native vegetation and be irrigated with a system designed to
avoid surface runoff and over -watering.
22. Landscaping shall be regularly maintained free of weeds and debris. All
vegetation shall be regularly trimmed and kept in a healthy condition.
23. Prior to issuance of building or grading permits, the geometrics and
adequacy of the on -site access road for emergency vehicles shall be
evaluated and approved by the Public Works Department.
24. Emergency access from Newport Boulevard or Pacific Coast Highway shall be
provided in a manner acceptable to the Public Works and Fire Departments.
25. That prior to the issuance of building permits, the Fire Department shall
review the proposed plans and may require automatic fire sprinkler
protection.
26. The Fire Department access shall be approved by the Fire Department.
27. That all buildings on the project site shall be equipped with fire
suppression systems approved by the Fire Department.
28. That all access to the buildings be approved by the Fire Department.
TO: City Council - 6.
29. That all on -site fire protection (hydrants and Fire Department connec-
tions) shall be approved by the Fire and Public Works Departments.
30. The project applicant will coordinate with the City of Newport Beach fire
department in relocating the fire main.
31. Parking areas shall be paved early during construction activities.
32. Handicap and compact parking spaces shall be designated by a method
approved by the City Traffic Engineer.
33. The layout of the surface parking, including compact parking, shall be
subject to further review and approval by the City traffic engineer.
34. All proposed development shall provide for vacuum sweeping of parking
areas.
35. That all improvements be constructed as required by Ordinance and the
Public Works Department.
36. That the intersection of the private streets and drives be designed to
provide sight distance for a speed of 25 miles per hour. Slopes,
landscaping, walls and other obstruction shall be considered in the sight
distance requirements. Landscaping within the sight distance requirement
may be approximately modified at non -critical locations, subject to
approval of the Traffic Engineer.
37. That drainage and utility improvements be shown on standard improvement
plans prepared by a licensed civil engineer.
38. That a hydrology and hydraulic study be prepared by the applicant and
approved by the Public Works Department, along with a master plan of
water, sewer and storm drain facilities for the on -site improvements prior
to issuance of any grading permits. Any modifications or extensions to
the existing storm drain, water and sewer systems shown to be required by
the study shall be the responsibility of the developer.
39. County Sanitation District Fees be paid prior to issuance of any Building
Permits.
40. Prior to issuance of -building or grading permits, a bicycle trail study
shall be conducted in a manner acceptable to the City Public Works Depart-
ment. The study will evaluate the possibility of a bicycle trail connec-
tion from the Villa Balboa blufftop trail to Pacific Coast Highway.
41. That a minimum 10-foot wide bike trail be constructed to connect the Coast
Highway bike trail at Newport Boulevard with the Villa Balboa bike trail/
emergency access road.
42. That all proposed signs shall be in conformance with the provision of
Chapter 20.06 of the Newport Beach Municipal Code and shall be approved by
the City Traffic Engineer if located adjacent to the vehicular ingress and
egress.

43. All mechanical equipment and trash areas shall be screened from public
streets, alleys and adjoining properties.
44. Mechanical equipment shall not be located on the roof of the structure.
45. That any mechanical equipment shall be sound attenuated in such a manner
as to achieve a maximum sound level of 55 Dba at the property line.
46. That any mechanical equipment and emergency power generators shall be
screened from view and noise associated with said installations shall be
sound attenuated to acceptable levels in receptor areas. The latter shall
be based upon the recommendations of a qualified acoustical engineer, and
be approved by the Planning Department.
47. Final design of the project shall provide for the incorporation of water -
saving devices for project lavatories and other water -using facilities.
48. That the lighting system shall be designed and maintained in such a manner
as to conceal the light source and to minimize light spillage and glare to
the adjacent residential uses. The plans shall be prepared and signed by
a Licensed Electrical Engineer; with a letter from the engineer stating
that, in his opinion, this requirement has been met.
49. The structure shall be designed to protect the building from gas accumu-
lation and seepage, based on the recommendations of a geotechnical
engineer.
50. That the Planning Commission may add or modify conditions of approval to
this use permit, or recommend to the City Council the revocation of this
use permit, upon a determination that the operation which is the subject
of this use permit, causes injury, or is detrimental to the health,
safety, peace, morals, comfort, or general welfare of the community.
51. This use permit shall expire unless exercised within 24 months from the
date of approval as specified in Section 20.80.090;A of the Newport Beach
Municipal Code.
Background
On September 26, 1986, the City Clerk received an appeal of the Planning Com-
mission decision to approve a Traffic Study and amended Use Permit for the Hoag
Memorial Hospital Cancer Center from the Villa Balboa Community Association.
Analysis
The applicant, Hoag Memorial Hospital Presbyterian, is requesting these
approvals in order to construct a three-story, 45,000 sq.ft. cancer center with
a related 5,000 sq.ft. covered walkway system and open parking areas on the
site commonly known as CalTrans East near the existing Hoag Hospital parking
structure. Attached for the information of the City Council is an excerpt of
the Planning Commission minutes of September 4, 1986, and a copy of the
Planning Commission staff report which describes the applicant's request.

In making its appeal to the City Council, the Villa Balboa Community Associa-
tion made a number of statements regarding availability of information, a
judgment and agreement for a bicycle trail and the consistency of a conceptual
land use plan for the entire CalTrans East site with the Newport Beach General
Plan. These issues are addressed in this staff report. Additionally, staff
has become aware of an error made in the original staff report in regards to
the existing land use designation of the subject property in the Land Use
Element of the General Plan. The General Plan designation is discussed and
clarified.
Villa Balboa Community Association Comments
The Homeowners Association alleges in its letter of appeal that copies of the
Negative Declaration were not available when requested by the Association.
This statement is false. Copies of the Negative Declaration with the support-
ing Initial Study were and are available to persons upon request. Planning
Department records indicate that two copies of the Initial Study were given to
Mr. Kim Lombard, who represented himself to City staff as the chairman of a
committee established by the Villa Balboa Homeowners Association to review the
project. A number of persons came to the Planning Department to review the
file and the development plans. Many of these persons requested copies of the
plans. The Planning Department does not receive project plans for distribution
to members of the general public. These people were referred to the developer
to obtain copies of the plans.
The letter submitted by the Homeowners Association discusses an agreement and
recorded judgment pertaining to the development of Versailles -on -the -Bluff and
Villa Balboa which includes the provisions and agreements for the bicycle trail
and access easement which exist on the southerly edge of Villa Balboa adjacent
to the subject property. The Planning Commission, in making the decision on
the approval of the Use Permit, considered the public access easement and
bicycle trail. Specific Conditions of Approval were attached to the approval
of the project which require the applicant to conduct a bicycle trail study to
evaluate the possibility of a connection from the Villa Balboa trail to Coast
Highway. The construction of the bicycle trail connection is required to be
constructed by the applicant. In applying this Condition of Approval, the
Planning Commission is connecting the bicycle trail easement on Villa Balboa to
Coast Highway. This is considered a benefit to the community at large in the
City of Newport Beach.
Discussion is included in regards to a Conceptual Land Use Plan provided by
Hoag Hospital in the submittal package to the City. This plan was provided at
the request of staff in order that overall site circulation could be assessed
in order to assure that the approval of the cancer center project would not
limit future on -site circulation. The conceptual land use plan was approved by
the Planning Commission. The possible future project is not under considera-
tion at this time, and its conformance with the City's General Plan and Local
Coastal Program is not at question in this application.
Conformance of the Project with the Newport Beach General Plan and the Local
Coastal Program, Land Use Plan
The staff report prepared for the Planning Commission indicates that the prop-
erty in question is designated for "Recreational and Environmental Open Space"

in the Newport Beach General Plan and the Local Coastal Program, Land Use Plan,
with the provision in the LCP that the site can be used for the expansion of
Hoag Hospital facilities on site. The staff report was in error.
On February 11, 1985, the City Council adopted Resolution No. 85-7, approving
amendments to the Recreation and Open Space Element of the Newport Beach
General Plan. Concurrent with this action, the City Council approved a series
of General Plan Land Use Element and Local Coastal Program, Land Use Plan,
amendments to assure internal consistency of the General Plan and LCP elements.
As part of this action, the land use designation of the CalTrans East parcel
was amended from the "Recreational and Environmental Open Space" category to
"Governmental, Educational and Institutional Facilities." The project in
question is consistent with this designation.

The public hear ing wa s opened in connection with this
item, and Mr. Michael Stephens , President of Hoag
Me morial Hospital Presbyterian, appeared before the
Planning Commission . Mr. Stephens explained that the
cancer program is one of the most active and vital
p rograms at the hospital, and the space allocated to
the cancer center has not been increased since 1974 .
He said that statistics indicate that the activity has
grown to the point that the need has exceeded the
capacity.

Mr. Stephens stated that every effort has been made to
accommodate the expan3ion of the program; however,
there is not enough space to provide patient treatment
wi thin the hospital. He further stated that the 23
acr e Cal Trans parcel on West Coast Highway is the
proposed site of the cancer center , and was purchased
by the hospital three years ago. Mr . Stephens
comme nted that the land was purchased with the idea
that it would provide the hospital with the flexibility
and space that they do not have at the current
location. He explained that if the hospital had to
e xpand at the current location that a structure seven
or eight stories would be necessary for economic
reasons .
In re sponse to concerns previously submitted by
adjacent neighbors, Mr. Stephens replied that the
parcel is the only adjacent site the hospital has, that
the plan will have to service the area for the duration
of t he hospital's existence, and that the development
will have to be on a planned basis over a considerable
period of time. Mr. Stephens stated that the master
plan has not been completed. He said that the hospital
has been considerate of the adjacent neighbo rhood, and
the impact that the proposed development would have on
the neighbors.
Robert Shapiro, M. D., Acting Director of Radiation
Therapy , appeared before the Planning Commission. Dr.
Shapiro explained how important the cancer center will
be t o the treatment of cancer, the need to centralize
the cancer care center on behalf of the cancer patient;
and the importance and the mechanics of current
radiation equ i p ment .
Mr. Phillip R. Schwartze, Vice President, Phillips
Brandt Reddick, Planning Consul tan ts, appeared before
the Plann ing Commission and presented a slide
presentation of the proposed project. Mr. Schwartz
de sc ribed the view analysis and the view impact that
the proposed project would have on the surrounding
neighborhood . He explained how the proposed project
wo uld be built into the bluff area to protect views;
the pedestrian link between the current hospital
structure to the proposed project; the service area
from the exi sting parking structure; the utilization of
the three floors of the proposed structure; the grading
and slope area of the proposed structur8; relocation of
the elevator tower and elevation; and the landscaping.
Mr. Schwartze also referred to the scale model that was
on display.

Dr. Shapiro reappeared before the Planning Commission
and introduced Mr . Ron Langseth, a former cancer
patient of Dr. Shapiro. Mr. Langseth appeared before
the Planning Commission and he explained the importance
of the proposed cancer center from a patient's point of
view, and he commented that the patient would benefit
if the treatment would be entirely under one roof and
also from convenient parking.
Mrs. Laraine Eggleston appeared before the Planning
Commission on behalf of the Sandpipers, a Community
Support Group for Hoag Cancer Center . Mrs. Eggleston
e xplained the need for the improvement of cancer
treatme nt and she said that the Sandpipers have
committed to raise $500,000.00 within the next three to
fi ve years, wh ich would encourage other support groups
and individuals in the area to provide the needed funds
fo r the completion of the center.
Mr. Michael Stephens reappeared before the Planning
Commission and concluded the presentation by
s ummarizing the aforementioned testimonies. Mr.
Stephens stated that he concurs with the findings and
conditions in Exhibit "A ".
Mrs. Clara Laidlaw, 240 Nice Lane, President of Villa
Balboa Homeowner s Association, appeared before the
Pla nning Commission on behalf of the Homeowners
Association. Mr s . Laidlaw stated that the foremost
c oncern of the homeowners is the view impairment, and
she s aid that further concerns are: if the connector
link could be underground instead of above the ground;
the service road could be lowered; and consideration of
another location for the proposed center. Mrs. Laidlaw
stated that the General Plan adopted by the City
indicated that the 22 acre site would remain as open
space, and t hat the Coastal Commission submitted a
report indicating open space. She asked for a
clarification to the staff report which reads "that
this project is considered consistent with the General
Plan ".
Patricia Temple , Environmental Coordinator, responded
to Mrs. Laidlaw's testimony , and stated that the staff
did not do any specific analysis of the view impacts
related to the service road and parking on the bluff.
She said that staff's concern was the blockage of bay
and ocean views, and not encroachments into the "view
shed ". In reference to the General Plan consistency,

Ms . Templ e stated that the City adopted and the Coastal
Commission certified the Local Coastal Program is
considered to be the City's most current General Plan
within the Coastal zoue. She said that the Land Use
Plan designates the Hoag Hospital site as recreational
and environmental open spac::e but there is a specific
provision with in the designation which allows for the
expansion of Hoag Hospital facilities on the site. Ms.
Temple further stated that staff indicated that the
project wa s consistent with the General Plan, and also
that in the event that Hoag Hospital pursued a master
site deve lopment plan that a General Plan Amendment
will be r equired .
In response to the concern regarding another site
location for the cancer center, Ms. Temple replied that
staff did not do an additional analysis; however, Hoag
Hospital did an analysis and they indicated that it was
nece ssary to have a direct link to the existing campus,
and she e x plained why the cancer center was located
into the slope area so that Villa Balboa units would
not have a v iew obstruction. In response to a question
posed by Chairman Turner , Ms. Temple replied that the
service road and the small amount of parking would be
between the cancer center and Villa Balboa . Discussion
followed between Commissioner Kur lander , Chairman
Turner, and Ms . Temple regarding lowering the access
road.
In respon se to questions posed b y Chairman Turner and
Mr. Hewicker, Mr. Phillip Schwartz e reappeared before
the Planning Commission and he explaine d why the
inte r-link be t ween the cancer center and the hospital
would be convenient for the in-patient and the
ou t-patie nt.
In respon se to a question posed by Commissioner Person
regardi ng the legal responsibility of the Planning
Cornnission granting or denying a discretionary approval
as it relates to the protection of private views, Ms.
Korade replied that the Planning Commission can
consider private views under certain circumstances, and
that in the standard use permit the private views can
be considered b ut are not a controlling factor in

Homeowners Association. Mr. Lombard requested that the
application be continued so that the Villa Balboa
Homeowners Association may evaluate what impact the
cancer center will have to the surrounding
neighborhood. He said that representatives of Hoag
Hospital have met with the homeowners, that the
repre sentatives were interested in their opinions and
that changes were made to the original design. Mr.
Lombard commented that 700 questionnaires have been
mailed to Villa Balboa homeowners, Versaille homeowners
and tenants, and that there has not been enough time to
receive all of the replies. He said that 45 responses
have indicated concerns regarding the environmental
imp act ; opposition to the cancer center as it is
currently planned; decrease in property values; and
they request for legal counsel regarding the affect the
development would have to their property. Mr. Lombard
stated that his concern is what affect Hoag Ho s pital's
proposed General Plan will have on the surrounding
community.
In respon se to questions posed by Chairman Turner, Mr.
Lombard replied that there has not been enough time to
make recommendations for change, and that the entire 22
acre p arcel should be studied instead of the subject
project site .
Chairman Turner commented that previous testimony has
stated that no long range projections have been made by
the applicants. He further stated that 550,000 square
feet wou ld be roughly twice the size that Hoag Hospital
currently is which would be a tremendous amount of
growth , and that Hoag Hospital probably is not ready to
build out at this time. Mr. Lombard rebutted that the
applicants have prepared a design, ann that the public
should be given information and additional time. In
response to a question posed by Chairman Turner, Mr.
Lomb ard replied that the Villa Balboa Homeowners
Association is requesting a continuation of thirty
days.
Mr. Paul Butler, 280 Cagney Lane, No. 110, appeared
before the Planning Commission in opposition to the
app licat ion on the subject site. Mr. Butler's
pre sentation was regarding a newspaper article
regarding the Newport -Inglewood Earthquake fault and
the impact that an earthquake would have on the subject
bluff site; City of Newport Beach Resolution No. 84-49

Coastal Commission identifying environmental sensitive
areas including the coastal bluffs; that the subject

that the Coastal Commission has requested no change in
land use; a nd that gas seepage and pressure is
increasing in the subject area.
In response to a question posed by Commissioner
Winburn, Mr. Butler replied that his wife has owned the
Villa Balboa residence since the development was
completed, and that the proposed project will block
their v iew of the turning basin; however, their concern
is that the building could slide down the hill if there
would be a large earthquake.
In response to Mr. Butler's concerns, Ms. Temple
replied that the subject site by definition is not a
bluff, but that the site is an engineered cut slope and
that the Coastal Commission recognizes the site as a
slope. Ms. Temple stated that the State of California
has conducted studies regarding the West Newport area
and that there was a determination that the faults in
the West Newport area have not experienced any
earthquake movement for the past 10,000 years. In
reference to the Public Safety Element, Ms. Temple
stated that the slope is greater than 25 percent and is
not considered a hazardous area.
Chairman Turner stated that the State of California
proces ses hospital Building Permits, and that the
subject appl ication would probably also be processed by
the State .
Ms. Lynn Smith , 950 Cagney Lane, appeared before the
Planning Commission. Ms. Smith stated her concern that
the Homeowners Association has not been given adequate
time to analyze the proposed project; that Hoag
Hospital has been allowed to "bootstrap" the General
Plan by starting with the cancer center; why was Hoag
Hosp i tal permitted to develop on a site prior to owning
the property ; that the west side of Superior Avenue is
considered a natural bluff, and recreational and open
space area; the legal interpretation of bluff; that the
projec t is not consistent with the General Plan; and
why the Coastal Commission does not require a General
Plan Amendm ent for the cancer center. Ms. Smith
emphasized the concern that she has regarding the bluff
site.

Ms. Temple responded that the Local Coastal Program
designation shows that the Cal Trans West site,
westerly of Superior Avenue, as recreational and open
space; h owever , that designation has been amended to
multi-family residential.
Mr. Jerry Scarboro, 280 Cagney Lane, Building No. 5,
appeared before the Planning Commission, and he
recommended that the Planning Commission look at the
entire 22 acre facility. Mr. Scarboro's presentation
stated his concerns and he requested additional studies
regarding the service road; the traffic; noise;
transportation implications of the total development;
and the safety concerns of the service road.
Mr . Wayne Lamb, 280 Cagney Lane, appeared before the
Planning Commission. Mr. Lamb stated his concern that
the Villa Balboa Homeowners Association has not had
adequate time to study the proposed project; that the
homeowners were of the opinion that the proposed site
would remain as an open space area; and suggested that
the applicants and homeowners come to a compromise
regarding lighting, heights, and subterranean parking.
Mr . Phillip Schwartze reappeared before the Planning
Commission in response to previous testimony. He
replied that no Master Plan for Hoag Hospital exists,
that the mod e l plan was prepared when the cancer center
was conceived , and that the model was designed as a
worse case situation for traffic circulation; that
the subject site was determined because the link would
minimize the distance between the existing hospital
campus and the proposed cancer center; and he explained
the results of the geo-technical studies.
In response to questions posed by Chairman Turner, Mr.
Schwartze responded that the applicants have attempted
to acquaint the homeowners with the proposed project,
and that he did not know what could be accomplished if
the application would be continued. Chairman Turner
explained that the homeowners may not be as
knowledgeable of architectural design, and he commended
the applicants regarding the usage of sticks outlining
the proposed project on the subject site.
Mr. Dan McGregor, 106 Cagney Lane, appeared before the
Planning Commission, and commented-that his view would
be eliminated completely by the proposed project. His
concerns are regarding the lowering of the passenger
link to the cancer center; that Villa Balboa homeowners

will experience depreciation in their property values;
what affect an earthquake would have to Villa Balboa
because the slope wquld be cut into; that the
homeowners should be aware of Hoag Hospital's future
development; and that he was requesting a continuation

The Planning Commission recessed at 11:35 p.m. and
reconvened at 11:43 p.m.
Mr. Phillip Schwartze reappeared before the Planning
Commission, and in reference to concerns regarding
earthquakes, he explained that professional agencies
that would be involved in the approval of the
geo-technical study before the facility could be
constructed. Mr. Schwartze stated that the applicants
would be happy to work with interested homeowners
during the public hearing process.
Mr. W. W. Horningstar, 240 Nice Lane, appeared before
the Planning Commission and stated his concerns that
when he purchased his property that the subject site
would remain as open space; that the long range General
Plan for Hoag Hospital would consist of approximately
600,000 square feet including 12 buildings; that the
service road would service all of the buildings from
the third floor because it would not be aesthetically
pleasing for the patients; that the impact of the
proposed development should be studied and considered
and what affect the proposed project will have on the
residents of the surrounding residences; he referred to
Finding No. 9 stating "that the use permit will not be
detrimental to the health, safety, peace, comfort, and
general welfare of persons residing or working in the
neighborhood of such proposed use or be detrimental or
injurious to property and improvements in the
neighborhood or the general welfare of the City", and
he rebutted that the project would be injurious to the
welfare, that the project would be detrimental to
property values, traffic and noise; and he commented
that the City required an easement for a bicycle trail
before Villa Balboa was developed.
Mrs. Cordelia Ramsay Butler, 280 Cagney Lane, Building
No. 5, No. 110, appeared before the Planning
Commission, and requested that the cancer center not be
developed on the proposed site because there would be a

property depreciation for many of the residents. In
response to a question posed by Chairman Turner
regarding where the cancer center could be relocated,
Mrs. Butler suggested the hospital's current parking
area, and that the parking could go underground. She
further commented that the third floor service area
will obstruct views.
In response to a question posed by Commissioner Person
regarding the responsibility of the Planning Commission
and the City Council concerning the protection of
private views, Mr. Hewicker replied that the position
of the City has been that when discussing the issues of
view and view preservation, the City is talking about
preservation of public and not the preservation of
private views from private residences. He explained
that the City is talking about preservation of views
from public parks, public walkways, public bicycle
trails , public streets and highways, and public
buildings.
In response to a question posed by Commissioner Winburn
regarding the preservation of view from the bicycle
trail, Mr. Hewicker replied that he is aware that there
would be some view obstruction by the elevator
penthouse, and that the project has taken into
consideration the preservation of views in terms of
bringing the roof up to the maximum.
Mrs. Butler reappeared before the Planning Commission,
and added that there is a concern that hospitals could
be developed in residential neighborhoods. Chairman
Turn er and Commissioner Person explained that the area
i has been zoned for hospital use.
Ms. Korade referred to her previous statement regarding
private views and she explained that the private views
cannot control the grantor denial of the use permit,
that the function of the Planning Commission is not to
protect private views.
Mr . Kim Lombard reappeared before the Planning
Commission, and he referred to the Land Use Plan and
the view shed, and he stated that much could be
accomplished if the homeowners and the applicants could
discuss the proposed project.
Mr. Tom Matthews, 220 Nice Lane, appeared before the
Planning Commission questioning the credibility of Hoag
Hospital and the presentations that the applicants have

given to the homeowners and the Planning Commission.
He said that the hom2owners have had two weeks to
review the proposed project and that he would request
that the application be continued beyond thirty days.
Mr. Matthews was concerned about the loss of property
values and the traffic that would be generated by the
development.
In response to questions posed by Commissioner
Koppelman regarding implementation of General Plan
Amendment, Ms. Temple replied that the proposed plan is
one building, that there is no Master Plan that has
been submitted for review to the City. She said that
the conceptual plan wa s in order for staff to do some
base analysis on on-site circulation and staff would be
allowed to do some base line analysis in terms of
opportunities and constraints on the public view park
that is designated within the recreational and open
space element of the General Plan. Ms. Temple
explained that the Land Use Plan as exhibited, has no
official status, it is only a piece of information upon
which the staff felt the Planning Commission could be
aided in reaching a decision on the cancer center. She
further commented that staff does not know what the
exact square footage is, and in no event would the
approval of this project lead the City into approving
any other amount on the balance of the site.
Ms . Temple stated that staff has requested that the
Planned Community Plan also be submitted simultaneously
so that the actual structural siting can also be
reviewed if any further amendment to the Local Coastal
Program would be considered by the Planning Commission
or City Council.
The public hearing was closed at this time.
Commissioner Person pointed out that the Villa Balboa
residents wi l l have opportunities to attend additional
public hearings. Motion was made to approve Use Permit
No. 1421 (Amended) and Traffic Study subject to the
findings and conditions in Exhibit "A". Commissioner
Person explained that the Planning Commission has never
been involved in the pure protection of private views,
that the subject property is owned by Hoag Hospital,
that the con sideration is a 50,000 square foot
facility, and that the project is worthwhile.

Commissioner Koppelman stated that she would support
the motion because an effort has been made on the part
of the hospital to preserve views, the hospital is an
advantage to the entire community, and that the project
should not be delayed.
Chairman Turner stated that he would support the
motion. He pointed out that the current project is
50,000 square feet, and not the 600,000 square feet
which would have to come before the Planning Commission
and the City Council. Chairman Turner advised the
homeowners that there will be further public hearings
regarding the subject application. He said that the
hospital has tried to be a good neighbor and is a
valuable asset to the community. Chairman Turner
emphasized the necessity of cancer research and
treatment.
Commissioner Eichenhofer stated that there is more at
issue than views, and that she would support the
motion. Commissioner Eichenhofer commented that the
residents are concerned about the hospital's long-range
plans and she encouraged the residents to attend other
public hearings, and she suggested that Hoag Hospital
keep the residents informed of further developments.
Commissioner Merrill stated that Hoag Hospital cannot
pred ict what will be developed in the future because
there are constant changes in the manner that care is
delivered, the requirements of insurance companies,
creating surgical centers, and new technology.
Chairman Turner agreed to Commissioner Merrill's
statement.
Motion v oted on to approve Use Permit No. 1421
(Amended) and Traffic Study subject to the findings and

Findings :
1. That an Initial Study and Negative Declaration
have been prepared in compliance with the
California Environmental Quality Act, the State
CEQA Guidelines, and City policy, and that their
contents have been considered in the decisions on
this project.
2 . That based on the information contained in the
Initial Study, the project incorporates sufficient
mitigation measures to reduce potentially signifi-
cant environmental effects, and that the project
will not result in significant environmental
impacts.
B. TRAFFIC STUDY
Findings:
1 . That a Traffic Study has been prepared which
analyzes the impact of the proposed project on the
peak hour traffic and circulation system in
a ccordance with Chapter 15.40 of the Newport Beach
Municipal Code and City Policy S-1.
2 . That the Traffic Study indicates that the proj-
ect-generated traffic will neither cause nor make
worse an unsatisfactory level of traffic on any
'major ', 'primary-modified', or 'primary' street,
so long as the committed improvement at Newport
Boulevard and Hospital Road/Westminster Avenue is
constructed.
Condition:
1. That prior to the occupancy of the proposed
project , the applicant shall contribute a propor-
tional share as determined by the City, to the
Circulation System Improvements for the inter-
section of Newport Boulevard and Hospital
Road/W estminster Avenue.

Findings :
1. That the proposed development is consistent with
the General Plan and the adopted Local Coastal
Program, Land Use Plan, and is compatible with
surrounding land uses.
2 . The project will comply with all applicable City
and State Building Codes and Zoning requirements
for new building applicable to the district in
which the proposed project is located, except
those items requested in conjunction with the
proposed modifications .
3. The increased building height will result in more
public visual open space and views than is
required by the basic height limit, in that the
proposed building is a maximum of 6 feet higher
than the existing upper level elevation.
4. The increased building height will result in a
more desirable architectural treatment of the
building and a stronger and more appealing visual
character of the area than is required by the
basic height limit.
5. The increased building height will not result in
undesirable or abrupt scale relationships being
created betwe e n the structure and existing devel-
opments or public spaces, in that the proposed
structure is similar in height to the adjacent
Villa Balboa development.
6. The structure will have no more floor area than
could have been achieved without the use permit
for the building height.
7. Adequate off-street parking and related vehicular
circulation are being provided in conjunction with
the proposed development.
8. The proposed number of compact car spaces consti-
tutes 25 percent of the parking requirements which
is within limits generally accepted by the Plan-
ning Commission relative to previous similar
applications.

9. The proposed Use Permit No. 1421 (Amended) and

the circumstances of this particular case, be
detrimental to the health, safety, peace, comfort,
and general welfare of persons residing or working
in the neighborhood of such proposed use or be
detrimental or injurious to property and improve-
ments in the neighborhood or the general welfare
of the City and further that the proposed modi-
fication is consistent with the legislative intent
of Title 20 of this Code.
Conditions:
1. That development shall be in substantial confor-
mance with the approved plot plan, floor plan, and
elev ations, as modified by the preferred design
alternative one, except as noted below.
2. Development of site shall be subject to a grading
permit to be approved by the Building and Planning
Departments.
3. That a grading plan shall include a complete plan
for temporary and permanent drainage facilities,
to minimize any potential impacts from silt,
debris , and other water pollutants.
4 . The grading permit shall include a description of
haul routes, access points to the site, watering,
and sweeping program designed to minimize impact
of haul operations.
5. An erosion, siltation and dust control plan shall
be submitted and be subject to the approval of the
Building Department and a copy shall be forwarded
to the California Regional Water Quality Control
Board, Santa Ana Region.
6. The velocity of concentrated runoff from the
project shall be evaluated and erosive velocities
controlled as part of the project design.
7. That grading shall be conducted in accordance with
plans prepared by a Civil Engineer and based on
recommendations of a soil enginee r and an engi-
neering geologist subsequent to the completion of
a comprehensive soil and geologic investigation of

causes injury, or is detrimental to the health,
safety, peace, morals, comfort, or general welfare
of the community.
51. This use permit shall expire unless exercised
within 24 months from the date of approval as

Chapter 20. 80; Modi fication procedures are in Chapter 20. 81; and
Traffic Study procedure s are in Chapter 15.40 of the Newport Beach
Municipal Code.
Environmental Significance
In accordance with the California Environmental Quality Act (CEQA),
the State CEQA Guidelines and City Council Policy K-3, an Initial
Study has been prepared for the proposed project. Environmental
issues evaluated in the Initial Study are Land Use, Earth Resources,
Air Quality, Hydrology /Water Quality, Biological Resources, Noise,
Transportation/Circulation, Cultural Resources, Visual/Aesthetics,
Public Services and Utilities and other environmental issues. Based
upon the information contained in the Initial Study, it has been
determined that the proposed project, as mitigated, will not create a
significant adverse environmental effect and a Negative Declaration
has been prepared. A copy of the Negative Declaration and Initial
Study are attached to thi s report for the consideration of the Plan-
ning Commission .
Conformance with the General Plan and Local Coastal Program, Land Use
Plan
The Land Use Element of the Newport Beach General Plan designates the
site for "Recreational and Environmental Open Space" to be used for
parking, public recreational and visual-environmental purposes. The
Local Coastal Program, Land Use Plan carries a similar designation for
the site and specifically accommodates the expansion for Hoag Hospital
facilities on the site. The proposed project will use approximately
5% of the site , with the balance remaining undeveloped at this time.
The project is consistent with the General Plan and Local Coastal
Program.
Subject Property and Surrounding Land Use
The site proposed for development is a small portion of the site
commonly known as "CalTrans East." The site is currently vacant with
the exception of a parking lot wh ich is not in use at this time, and a
noxious gas recovery and burn-off facility. To the north of the site
is the Villa Balboa and Versailles-on-the-Bluff condominium projects
and the main campus of Hoag Memorial Hospital. Easterly of the site
is the Coast Highway /Newport Boulevard interchange with commercial
uses in Mariners' Mile beyond. Southerly of the site, across Coast
Highway, are residentia l uses in Balboa Coves. To the west of the
site are vacant portions of the CalTrans East site and, beyond Superi-
or Avenue , the vacant CalTrans West site.

Analysis
As previously indicated , the proposed project would allow construction
of a cancer treatment facility on a small portion of the CalTrans East
site immediately adjacent to the existing Hoag Hospital parking
structure . This particular project has been proposed by the hospital
at this time in order to allow construction to commence this year if
the project is approved. The hospital is currently in the process of
developing a Master Site Development plan for the entire CalTrans East
s ite. A preliminary concept plan for the entire site was requested by
staff for thi s permit in order to allow analysis of opportunities and
constraints relative to on-site circulation. This was done to insure
that the cancer center siting would not unduly restrain general
on-site circulation. A copy of the. Conceptual Site Plan has been
attached to the Plans and Elevations of the project for the informa-
tion of the Planning Commission.
Subsequent to the s ubmittal of the plans and elevations of the Use
Permit , representatives of the hospital held a series of meetings with
homeowners in the Villa Balboa condominium project. As illustrated in
the Initial Study, the project, as submitted, included a covered
walkway and elevator penthouse which blocked views of lower Newport
Bay from ground-floor units in Building 5 of the Villa Balboa project.
In response to concerns e xpressed by residents at these meetings, the
project proponent ha s developed several design alternatives to reduce
the view impacts of the project. In studying the various
alternatives, the applicant has now proposed to revise the original
submittal in such a way as to minimize the need for the walkway and
penthouse encroachment into the view-shed. The revised plans and view
impacts are discussed in detail in later sections of this report.
Statistical Summary. No development standards are provided in the
Unclassified District. This summary describes the project in general,
but does not compare t h e project to zoning standards.

A Traffic Study was performed for the proposed development in confor-
mance with the City's Traffic Phasing Ordinance and City Council
Policy S-1. The proposed project is expected to be completed in 1987.

The first step in evaluating intersections is to conduct a 1% Traffic
Volume Analysis, taking into consideration existing traffic, regional
growth and the traffic of previously committed projects. For any
intersection where, on any approach leg , the project traffic is
estimated to be greater than 1% of the projected morning and afternoon
peak two and one-half hour volume, Intersection Capacity Utilization
(ICU) i s required.
Results of the one percent test i ndicate that the project traffic
e xceeded 1% of projected traff ic on an approach leg of two inter-
sections in the morning a n d two intersections in the afternoon. An
ICU Analysis wa s conducted for each of these intersections, with
Intersection Capacity Utilization ratios as shown in the following

As illustrated , the projected ICU ratios for the two intersections do
not exceed O. 90 in either the morning or afternoon peak hours , and
therefore meet the requirements of the Traffic Phasing Ordinance. It
should be noted, howe ver, that the ICU ratios presented assume com-
pletion of a committed intersection improvement at Newport Boulevard
and Hospital Road which has not y et been constructed. When this
occurs, it is the standard practice of the City to require the inter-
section improvement of all subsequent projects which are dependent on
that improvement to achieve an acceptable level of service. As such,
the "c ommitted" improvement at Newport Boulevard and Hospital Road is
also a condition of this project, and a condition requiring a propor-
tional contribution to this improvement has been included.

Use Permit No. 1421 (Amended)
The property in question is located in the Unclassified District.
Development is permitted in the zoning district which is consistent
with the General Plan subject to the approval of a use permit in each
case. The site is located in the 26/35 Foot Height Limitation Dis-
trict. Therefore, the u se of the site and the proposed height of the
structure necessitate the use permit. In addition, the provision of
parking based upon a demonstrated formula with a portion provided as
compact spaces had also been requested. The various issues associated
with this application are discussed in this section of the report.
Land Use . A Use Permit is required to allow construction of the
proposed project in the Unclassified District. Development is allowed
in this district so long as the development is consistent with the
General Plan. As previously discussed, the project is considered
consistent with the General Plan.
The cancer facility is a three-level structure providing for diagnos-
tic and treatment services for patients. The uses include examination
rooms, treatment rooms , waiting areas, reception areas and office
support, and offices for physicians associated with the facility. The
use proposed is a facility which is ancillary to Hoag Hospital, and
generates a relatively low level of traffic. It can, therefore, be
served by the existing access roads which serve the hospital and does
not require the provision of independent access via West Coast High-
way. It was this desire to limit the need for an additional full
access point on Coast Highway which led the City to support the
concept of the hospital use of the site.
The Recreation and Open Space Element and the Circulation Element
Master Plan of Bikeways provide for a bluff top secondary bike trail
paralleling Coast Highway from Newport Boulevard to Bluff Road (Balboa
Boulevard extended). The trail would have a bridge over Superior
Avenue. The purpose of this trail is to provide a view of the ocean
and bay, and is not considered to be a transportation or commuter link
in the system.
Villa Balboa has provided a joint bike trail/emergency access road
between the Hoag Hospital access road and Superior Avenue. The Master
Plan of Bikeways shows a connection from this bike trail/access road
to Coast Highway in the vicinity of the ramp to Newport Boulevard.
This connection goes through the Hoag site, and when constructed will
need to be coordinated with the grading and improvements for the
cancer center . There appears to be sufficient space to construct the
trail, but to obtain acceptable grades for the trail may require some
side hill cuts and retaining structures. An alignment feasibility
study has been included as a condition of approval if the application
is approved by the Planning Commission. This study will be required
prior to the issuance of building or grading permits so that trail
construction can be included as a part of the cancer center project.
Building Height and Views. During the preliminary staff review of the
project, a great deal of attention was given to the potential effects
the project may have on views from the Villa Balboa bike trail/access
road and from the ocean and bay facing units in Villa Balboa.

Detailed view analysis studies were conducted for the proposed project
and are included in the Initial Study. Additionally, representatives
of Hoag Hospital have held a series of meetings with the residents of
Villa Balboa. As a re s ult of these meetings, additional building
design alternatives were developed in order that the project have a
minimal impact of the public and private views .
The original project included a covered walkway system and elevator
penthouse whi c h were the highest portions of the structure . While the
r oof of the building itself wa s only three to five feet higher than
the elevation of the bike trail easement, the walkway and elevator
penthouse were 17 feet and 14 feet higher, respectively. These
facilities were the only sources of significant view obstructions.
The alte rnate building designs studied are included in the Planning
Commission packet. The various alternatives revolve around ways to
lower the cove r ed walkway one full level, thereby eliminating the need
for any walkway encr oachments above the roof elevation. The elevator
penthouse will now be only three feet higher than the roof elevation.
The hospital ha s , therefore, revised its original proposal to incor-
porated the preferred alternative one into the proposed project to
mitigate these view impacts.
The site is located in the 26/35 Foot Height Limitation District. The
proposed structur e reaches a maximum height of 35 feet , which necessi-
tates the approva l of a use permit. Section 20 .02.040 of the Newport
Beach Municipal Code sets forth specific findings which must be made
in order to approve a use permit to exceed the Basic Height Limit, as
follows:
20 .02.040 PLANNING COMMISSION OR CITY COUNCIL REVIEW .
The Planning Commission or City Council in approving any
Planned Comrnuni ty Di strict , any Specific Area Plan , or in
approving any use permit for structures in excess of the
basic height limit in any zone shall find that each of the
following four p oints have been complied with:
a. The increased building height would result in more
public vi s ual open space and views than is required by
the bas ic height limit in any zone . Particular atten-
tion s hall be given to the location of the structure on
the lot, the percentage of ground cover , and the
treatment of all setback and open areas.
b. The increased building height would result in a more
desirable architectural treatment of the building and a
s tronger and more appealing visual character of the
area that i s r equired by the basic height limit in any
zone .
c. The increased building height would not result in any
undesirable or abrupt scale relationships being created
between the structure and existing developments or
public spaces . Particular attention shall be given to

the total bulk of the structure including both horizon-
tal and vertical dimensions.
d. The structure s hall have no more floor area than could
have been achieved without the use permit. (Ord. 1454
§ 4 (part) , 1972.)
The project involves development of a structure on a very small
portion of a 22 acre undeveloped site. As such, the project is of
very low overall intensity and is within the level of intensity
generally approved by the City. Since approximately 95% of the site
is not proposed for development at this time, considerable public
visual open space will remain. Staff is aware, however, of the Master
Site Development Plan which is forthcoming for the site. Hoag Hospi-
tal has provided a preliminary concept plan for the entire site wh.ich
enables some assessment of the impact the whole project may have on
public open space. Based on the plan, it does not appear that the
approval of this use permit will preclude future opportunities for
public view parks. The building itself will be built into the graded
slope which will minimize the visual bulk of the structure. The three
story structure is of a similar height to the Villa Balboa buildings,
which are also three story structures. It is the opinion of staff
that the criteria to exceed the basic height limit have been met by
the project as revised by the applicant.
Parking. The applicant has proposed to provide parking based upon a
demonstrated formula and to provide a portion of the parking as
compact spaces. A parking demand study was prepared by the consulting
firm of Basmaciyan-Darnell, Inc. This study has been reviewed by the
City Traffic Engineer. It is the opinion of staff that the proposed
number of parking spaces will be adequate for the proposed project.
The City has consistently allowed compact parking spaces in lots of
sufficient size, so long as the total number of compact spaces does
not exceed 25%.
Conclusion and Recommendation
In order to grant any use permit, the Planning Commission must find
that the establishment , maintenance or operation of the use or build-
ing will not, under the circumstances of the particular case, be
detrimental to the health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood or the
general welfare of the City. Additionally, specific findings in
regards to public visual open space and views, architectural treat-
ment, scale relationships and floor area must be made to approve a use
permit to exceed the basic height limit.
The use proposed for the property meets the criteria of the Traffic
Phasing Ordinance. The redesign of the project submitted by the
applicant enhances the compliance of the project with the criteria to
exceed the basic height limit, and the use is consistent with the
General Plan . Staff recommends approval of Use Permit No. 1421
(Amended) and the related Traffic Study. Should the Planning
Commission concur with staff, Findings and Conditions for Approval are

project, the applicant shall contribute a propor-
tional share as determined by the City, to the
Circulation System Improvements for the inter-
section of Newport Boulevard and Hospital
Road/Westminster Avenue.

those items requested in conjunction with the
proposed modifications.

proposed building is a maximum of 6 feet higher
than the existing upper level elevation.
4. The increased building height will result in a
more desirable architectural treatment of the
building and a stronger and more appealing visual

created between the structure and existing devel-
opments or public spaces, in that the proposed
structure is similar in height to the adjacent
Villa Balboa development.

7. Adequate off-street parking and related vehicular
circulation are being provided in conjunction with
the proposed development .
8. The proposed number of compact car spaces consti-
tutes 25 percent of the parking requirements which
is within limits generally accepted by the Plan-
ning Commission relative to previous similar
applications.
9. The proposed Use Permit No. 1421 (Amended) and
modification for compact parking will not, under
the circumstances of this particular case, be
detrimental to the health, safety, peace, comfort,
and general welfare of persons residing or working

in the neighborhood of such proposed use or be
detrimental or injurious to property and improve-
ments in the neighborhood or the general welfare
of the City and further that the proposed modi-
fication is consistent with the legislative intent
of Title 20 of this Code.
Conditions :
1. That development shall be in substantial confor-
mance with the approved plot plan, floor plan, and
elevations , as modified by the preferred design
a lte rnative one , except as noted below .
2. De v elopment of site shall be subject to a grading
permit to be approved by the Building and Planning
Departments.
3 . That a grading plan shall include a complete plan
for temporary and permanent drainage facilities,
to minimize any potential impacts from silt ,
debris, and other water pollutants.
4. The grading permit shall include a description of
haul routes, access points to the site, watering,
and sweeping program designed to minimize impact
of haul operations.
5 . An erosion, siltation and dust control plan shall
be submitted and be subject to the approval of the
Building Department and a copy shall be forwarded
to t h e California Regional Water Quality Control
Board, Santa Ana Region .
6 . The v eloc ity of concentrated runoff from the
pro ject s h all be evaluated and erosive velocities
controlled as part of the project design.
7 . That grading shall be conducted in accordance with
plans prepared by a Civil Engineer and based on
recommendations of a soil engineer and an engi-
ne e ring geologist subsequent to the completion of
a comprehensive soil and geologic investigation of
the site. Permanent reproducible copies of the
"Approved as Built" grading plans on standard size
sheets shall be furnished to the Building Depart-
ment .
8 . Prior to the issuance of the grading permit, the
design engineer shall review and state that the
discharge of surface runoff from the project will
be performed in a manner to assure that increased
peak flows from the project will not increase
erosion immediately downstream of the system.

This report shall be reviewed and approved by the
Planning and Building Department.
9. That erosion control measures shall be done on any
exposed slopes within thirty days after grading or
as approved by the Grading Engineer. Any cut
material stockpiled on the site shall be placed in
such a location and manner as to prevent transport
of silt or soil off-site.
10 . Existing on-site drainage facilities shall

11 . Any exposed slopes shall be planted as soon as
possible to reduce erosion potential. No slope
established on the site shall exceed 2:1.
12. The grading plan shall include a complete plan for
temporary and permanent drainage facilities to
minimize any potential impacts from silt, debris
and other water pollutants. The existing 42-inch
storm drain shall be extended if necessary.
13. If groundwater seepage is found to occur on the
project site, the plan design should not block the
seepage. Blockage could include higher water
pressures which might influence slope stability.
14. A paleontological monitor shall be retained by the
landowner and/or developer to attend pre-grade
meetings and perform inspections during develop-
ment . The paleontologist shall be allowed to
divert , direct, or halt grading in a specific area
to allow for salvage of exposed fossil materials.
15. Arch aeological, paleontological, and historical
resources within the coastal zone shall be inves-
tigated in accordance with acceptable scientific
procedures and appropriate mitigation measures
(including testing, salvage or presentation) shall
be adopted on a case-by-case basis in accordance
with regular City policy.
16 . Should fossils be recovered, a paleontological
r eport shall be prepared for the project to
satisfy the City of Newport Beach K-5 and K-6
r equirements .
17. If resources are recovered, they shall be donated
to an appropriate natural history museum or
foundation, such as the Orange County Natural
History Foundation or the Los Angeles County
Museum of Natural History .

18. A landscape and irrigation plan for the project
shall be prepared by a licensed landscape archi-
tect. The landscape plan shall integrate and
phase the installation of landscaping with the
proposed construction schedule. (Prior to the
occupancy of any structure, the licensed landscape
architect shall certify to the Planning Department
that the landscaping has been installed in accor-
dance with the prepared plan.)
19. The landscape plan shall be subject to the review
of the Parks, Beaches and Recreation Department
and approval of the Planning and Public Works
Department.
20. The landscape plan shall include a maintenance
program which controls the use of fertilizers and
pesticides.
21. The landscape plan shall place heavy emphasis on
the use of drought-resistant native vegetation and
be irrigated with a system designed to avoid
surface runoff and over-watering .
22 . Landscaping shall be regularly maintained free of
weeds and debris. All vegetation shall be regu-
larly trimmed and kept in a healthy condition.
23 . Prior to issuance of building or grading permits,
the geometrics and adequacy of the on-site access
road for emergency vehicles shall be evaluated and
approved by the Public Works Department.
24 . Emergency access from Newport Boulevard or Pacific
Coast Highway shall be provided in a manner
acceptable to the Public Works and Fire Depart-
ments .
2 5. That prior to the issuance of building permits,
the Fire Department shall review the proposed
plans and may require automatic fire sprinkler
protection.
26 . The Fire Department access shall be approved by
the Fire Department.
27 . That all buildings on the project site shall be
equipped with fire suppression systems approved by

permits. Any modifications or extensions to the
e x isting storm drain, water and sewer systems
shown to be required by the study shall be the
responsibility of the developer .
39 . County Sanitation District Fees be paid prior to
issuance of any Building Permits.
4 0 . P rio r to issuance of building or grading permits,
a bicycle trail study shall be conducted in a
manner acceptable to the City Public Works

Department. The study will evaluate the possibil-
ity of a bicycle trail connection from the Villa
Balboa blufftop trail to Pacific Coast Highway.
41. That a minimum 10-foot wide bike trail be con-
structed to connect the Coast Highway bike trail
at Newport Boulevard with the Villa Balboa bike
trail/emergency access road.
42. That all proposed signs shall be in conformance
with the provision of Chapter 20.06 of the Newport
Beach Municipal Code and shall be approved by the
City Traffic Engineer if located adjacent to the
vehicular ingress and egress.
43. All mechanical equipment and trash areas shall be
screened from public streets, alleys and adjoining
properties.
44. Mechanical equipment shall not be located on the
roof of the structure.
45. That any mechanical equipment shall be sound
attenuated in such a manner as to achieve a
maximum sourid level of 55 Dba at the property
line.
46. That any mechanical equipment and emergency power
generators shall be screened from view and noise
associated with said installations shall be sound
attenuated to acceptable levels in receptor areas.
The latter shall be based upon the recommendations
of a qualified acoustical engineer, and be ap-
proved by the Planning Department.
47. Final design of the project shall provide for the
incorporation of water-saving devices for project
lavatories and other water-using facilities.
48. That the lighting system shall be designed and
maintained in such a manner as to conceal the
light source and to minimize light spillage and
glare to the adjacent residential uses. The plans
shall be prepared and signed by a Licensed Elec-
trical Engineer; with a letter from the engineer
stating that, in his opinion, this requirement has
been met.
49. The structure shall be designed to protect the
building from gas accumulation and seepage, based
on the recommendations of a geotechnical engineer.
50. That the Planning Commission may add or modify
conditions of approval to this use perrni t, or

recommend to the City Council the revocation of
this use permit, upon a determination that the
operation which is the subject of this use permit,
causes injury, or is detrimental to the health,
safety, peace, morals, comfort, or general welfare

proposed construction of the Cancer Center by Hoag Hospital,
to be located directly in front of our 280 Villa Balboa
building.
When we purchased our unit at the 280 building, we were
told by the developers that the vacant land directly in front
of us was owned by Cal Trans and would always remain as open
space, e-xcept for a strip along the highway that could be
used for widening the highway. Now it appears that parcel
has been sold to Hoag and will be developed.
We paid, as undoubtedly you did also, an additional
premium for our unit because of the unobstructed bay and
ocean view. (Enclosed original price list showing ocean view
units and prices.)
If Hoag is allowed to proceed with their proposed building
it is certain the value of our unit, and yours, will decrease.
It is extremely important that we all make every effort
to attend the meeting called by Mr. Mike Stevens on August 14
at 7 p.m. at Grace Center, Hoag Hospital, and express our
concerns.

In r esponse to the questions raised about radioactive material
that might be handled in the Cancer Center, I have reviewed the
matter with our Radiology Department.
The radia tion generated in the treatment of patients is much like
that of a standard Xray but with a higher electrical energy force
and a more focused point of destination -the cancerous tumor.
The radiation generated during treatment is kept within the
treatment room with the use of lead-lined walls. When the
equipment is turned off, the radiation stops just as it does with
a standard Xray machine. The radiation is generated by
electricity and therefore there is no radioactive material used
o r generated .
If you have any questions, we will be happy to try and answer
them either before or at the hearings. Please feel free to

As I am sure you know, Hoag Memorial Hospital Presbyterian
is planning to build a new Cancer Center and it is my under-
standing that the project will be reviewed by your Commission

Most Newport Beach residents have probably had a personal
expe rience with cancer--either themselves or someone in their
famil y. In my case, my father died of cancer in 1985. During
the illness which preceded his death, he was treated at Hoag
Hospital and received excellent care.
Today , under less than optimum conditions with respect
to physical plant and equipment, Hoag Hospital is providing
outstanding care to cancer patients from Newport Beach--a city
in which I both live and work and in which I both pay taxes
and provide employment to others. The Cancer Center is very
important to those of us in Newport Beach if Hoag Hospital
is to be able to continue to provide quality care to Newport
Beach residents . I sincerely hope that the Newport Beach Planning
Commission will do whatever it can to facilitate the construction

I urge you to give much thought in deciding this issue; having no
need for it person a lly , I certainly understand how those who do
could use a place where their needs are centrally located. Fairly
recent I h ad need of tests a nd treatments for a different problem
a nd ha v ing to mo v e from pla ce to place in the hospital made it
difficult , especi a lly feeling quite ill and somewhat a little scared.
Some yea rs ago I helped in a small way the furnishing of a new Cancer
Wing in a hospita l in the S a n Gabriel Valley and know firsthand how
much it me a nt to those with this dreaded affliction so I along with
other i n terested residents of Newport Beach await a confirming "YES"
from our Pl a nning Commission to the request.

On September 4, 1986, you will review the proposed Hoag Cancer Center
project. Because I will be out of town on business and unable to attend the
Planning Comm i ssion meeting, I am taking the liberty of writing this letter of
support for the proposed project.
My wife and I have been residents of the City of Newport Beach for 15
years and for the past 10 years we have lived within walking distance of
Hoag Memorial Hospital. In fact, I am alive and well today because of the
radiation therapy I received earlier this year as a cancer patient of Hoag's
Radiation Therapy Department. The medical care I received, professionalism
of the experienced doctors and trained radiation therapists, plus the positive
and tender loving care of the entire staff, unquestionably exceeded my
expectations. That's the positive result from a patients point of view. The
negatives were that unless I came as early as 7:00 A.M., finding a parking
space was difficult and the patient load factor ( in spite of the best efforts of
the staff) required lengthy waiting for treatment. It is obvious that the
current hospital facilities are grossly inadequate to provide space for patient
care and the necessary equipment and treatment rooms to handle the volume
of people requiring comprehensive cancer care.
As a recent patient, I implore you, the Chairman and Members of the
Planning Commission, to vote for approval of this application.

The purpose of this letter is to advise you of my personal
recommendation of the proposed Comprehensive Cancer Center to be
built by Hoag Hospital adjacent to the present hospital site.
I have personally inspected the proposed site and outline
where the building is to be situated. I have also been advised
that Hoag Hospital has tried to minimize the impact on the
adjacent residential area. It appears that the Cancer Center can
be built in a satisfactorily environmental manner.
Hoag currently treats more cancer patients than any other
hospital in Orange county. My own father was treated for cancer
at the hospital in 1972. The exising facilities are inadequate
for present and expected future needs. The new Hoag Compre-
hensive Cancer Center will provide needed additional services,
both to patients and to affected family members.
Personally, I am on the Board of Directors of the 552 Club
of Hoag Memorial Hospital Presbyterian and in charge of the 552
Club Cancer Campaign Committee. As such, I am involved with the
funding of the Cancer Center. As you can understand, the neces-
sary fund raising, approximately $14,000,000, cannot proceed with
any momentum without the City approval process having been com-

The reason I am writin g this letter is to request continuous of
approval of Use Perm it No. 1421 and for additional time to review
the impact o f the entire Hoag Hospital rezoning. I feel that the
homeowners at Villa Balboa have been given inadequate time to
pr epare for your September 4 public hearing.
I cite the following examples:
-Hoag Ho sp ital has spent over 5 months in planning for the
proposed Cancer Center while Villa Balboa has had only a
few weeks t o respond.
-The negative declaration prepared by the City Planning

On Augu s t 14 , 1 98 6 , Hoag Hospital held a meeting to share the
de s i g n con c e pt o f th e proposed Cancer Center Building. This
building i s t o be l ocated directly adjacent to the Villa Balboa
pr ope rty on the fo r mer Caltrans site. The construction of this
cent e r as plann e d may have a serious impact on your current and
future prope r ty va lu e .
On August 20, on beha l f of the Homeowners Association, the Villa
Ba lb oa Community Association Board of Directors established a
c omm it t ee to i nve stiga t e the various environmental, physical and
l ega l impact s of the proposed Hoag Hospital expanion. This
c om mittee will c ir culate a petition against the proposed
de velopent, th e im pai r ment of our views, the potential decline in
prop e rty valu e s an d the potential negative effect on the quality
of living at Villa Balboa and the Versailles.
On Wedne ~d a y, Au g ust 27 and September 3 at 7:00 p.m. the Review
Committ e e will hav e meetings outside in the pool/ common
area behind 950 Ca gn e y Lane . The purpose of these meetings is to
organize a working committee which can make recommendations to
the Villa Balb oa Home Owners Association Board of Directors and
to formulat e a str a t egy for a proposal to the City Planning
Commission .
On Thur s day, Septemb er 4 at 7:00 p.m. the Newport Beach Planning
De partment will hold .a public hearing to assess the Hoag Hospital
appli c ation f o r use of this property. All homeowners are
invited.
Several legitimate concern s h a ve already been voiced to both Hoag
Hospital and the Vill a Ba l boa Board. Among these are the
following:
-Altern a ti ve design and location
-Vi e w Impairment from 280 Cagney Lane
-La c k of lo ng term master plan from Hoag
-Sec ur ity of Vi lla Balboa
-Potenti a l i nc r eased earth quake threat
-Incr eased congestion and traffic
-Legal remedies
We solicit the i nvolvement of ALL homeowners in this vital

perc e nt of the possible construction between Villa Balboa and

This letter is in reference to Hoag Hospital's plan
to build a new Cancer Center.
I am a strong supporter of Hoag Hospital and very
much in favor of building the new Cancer Center.
This facility would serve more than 1,900 patients
who desperately need cancer care . At present, Hoag
Radiation Therapy Department treats 50 patients a day
and is the busiest cancer center in the county.
This new facility, operating as the Hoag Cancer Center,
will house a new radiation therapy department, out-
patient chemotherapy center, counseling center, a store
for special needs of the cancer patient, a pharmacy,
laboratory and offices for the physicians specializing
in the care of cancer patients .
I feel, with the number of people needing this center
and the number of new cancer cases everyday, the Hoag

Hoag Hospital plans to build a new comprehensive cancer center on property
adjacent to the main hospital campus. Hoag has been a long time leader in
cancer care in Orange County. In fact, Hoag admits more cancer patients each
year than any other hospital in the County.
Che of the most canpelling needs for the new cancer center is the size of Haag's
radiation therapy department. Radiation therapy is an essential treatment for
many cancer patients. The present unit was designed to accornnodate 20 patients
per day and now often treats more than 60 patients daily. At this pace the
equiµnent is wearing out. Waiting and treatment areas are crowded. Haag's new
cancer center will double the cqpacity to serve the coomunity's cancer patients.
Another primary reason for construction is to enhance patient convenience. Many
of the services cancer patients regularly require are scattered throughout the
hospital. It is difficult for these patients, who often do not feel well due to
the effects of the cancer or the side effects of the treatment, to find parking
and traverse the hospital corridors. The new cancer center will provide easy
access parking and most of the services the patient will need in one convenient
location.
We need your help. The Hoag Cancer Center project will be reviewed by the City
of Newport Beach Planning Commission on September 4th at 7:00 p.rn. in the City
Council Chambers located at 3300 Newport Boulevard. Your support of this
project in the form of a letter to the Chairman of the Planning Coomission would
be truly appreciated. A fact sheet giving information on the project has been

As concerned citizens, homeowners and residents of Villa Bal-
boa we wish to extend our opposition to the location of the Hoag
Canc e r Cent er. This is much against our wishes for many reasons
which only a few can be voiced here.
SAFETY-The proposed Bldg as planned is requesting the neces
-sity of cutting deeply into "The Bluff", thereby creating a more
unstable condition than alraedy exists and a hazard to our Bldg
which alr~~dy is within proximity of the Newport -Inglewood fault
within this coastal zone. Our place has alr8~y shown some damage
f r om the last two recent earthquakes by two of our doors jamming,
bearing witness to the fact of the unstable ground condition.
HEALTH-For health reasons we will be exposed to smog due to
th e many vehicles and transportation, especially of trucks that
will b e delivering supplies to the rear of their bldg as planned
a n d whi c h is at our doorstep (as the rear of proposed bldg-is just
a few f ee t from our door). We will be breathing in these exhaust
fumes as truck s k ee p running and unloading. What a sight to behold
i n an exc lu s ive n e i g hborh o od! As citizens, we have always consider
-ed New poTt Be a c h a s a well planned community. Also for health rea
-s ons they (Hoag Hosp .) have not filled . enough data or guarantee
that ~here will not be damage from their High Powered Electron ac-
c el e rator that a c celerates electrons at the speed of light within
the reac h of our home . It would appear to be very poor community
planning to allo w this .
NOISE-We as citizens of this community are entitled to a
q uiet , peaceful enviroment , and if this center is erected as alrea
-dy planned on this site we will be exposed to extra traffic at

n i ght and early morning hours causing loss of sleep as well as
lights from cars glaring into our windows etc ...
VIEW-Please refer to the letter of August 6th, 1986 written
by Richard & Carol Panghurn and Mary Petropoulos stating that a
high premium has been paid for our view of the Bay and ocean with
~· the supporting documents to verify such. W~also enclosing some
further data to supplement this.

and open space and to zone it as such, and not issue a permit for
this high rise structure in this exclusive residental neighborhood.

On Septe mber 4 , 1986, you will review the proposed Hoag Cancer Center
project. Because I will be out of town on business and unable to attend the
Planning Commission meeting , I am taking the liberty of writing this letter of
support for the proposed project.
My wife and I have been residents of the City of Newport Beach for 15
years and for the past 10 years we have lived within walking distance of
Hoag Memoria l Hospital. In fact, I am alive and well today because of the
radiation the r apy I received earlier this year as a cancer patient of Hoag's
Radiation Thera p y Department. The medical care I received, professionalism
of the e x perienced doctors and trained radiation thera pists, plus the positive
and tender lo v ing c a re of the entire staff, unquestionably e x ceeded my
e x pectations. That's the positive result from a patients point of view. The
negatives were that unless I came as early as 7 :00 A .M., finding a parking
space was difficult and the patient load factor ( in spite of the best efforts of
the staff) required lengthy waiting for treatment. It is obvious that the
current hospital facilities are grossl y inadequate to provide space for patient
care and the necessary equipment and treatment rooms to handle the volume
o f peopl e requiring c omprehensi v e cancer care .

Attention Homeowners:
On August 14, 1986, Hoag Hospital held a meeting to share the
design concept of the proposed Cancer Center Building. This

building is to be located directly adjacent to the Villa Balboa -~-
property on the former Caltrans site. The construction of this -
center as planned may have a serious impact on your current and
future property value.
On August 20, on behalf of the Homeowners Association, the Villa
Balboa Community Association Board of Directors established a
committee to investigate the various environmental, physical and
legal impacts of the proposed Hoag Hospital expanion. This
committee will circulate a petition against the proposed
developent, the impairment of our views, the potential decline in
property values and the potential negative effect on the quality
of living at Villa Balboa and the Versailles.
On Wedne~day, August 27 and September 3 at 7:00 p.m. the Review
Committee will have meetings outside in the pool/ common
area behind 950 Cagney Lane. The purpose of these meetings is to
organize a working committee which can make recommendations to
the Villa Balboa Home Owners Association Board of Directors and
to formulate a strategy for a proposal to the City Planning
Commission.
On Thursday, September 4 at 7:00 p.m. the Newport Beach Planning
Department will hold a public hearing to assess the Hoag Hospital
application for use of this property. All homeowners are
invited.
Several legitimate concerns have already been voiced to both Hoag
Hospital and the Villa Balboa Board. Among these are the
following:
-Alternative design and location
-View Impairment from 280 Cagney Lane
-Lack of long term master plan from Hoag
-Security of Villa Balboa
-Potential increased earth quake threat
-Increased congestion and traffic
-Legal remedies
We solicit the involvement of ALL homeowners in this vital
matter. The proposed Cancer Center represents less than ten
percent of the possible construction between Villa Balboa and
Pacific Coast Highway over the next several years. Only through
a united effort at City Planning and City Council hearings will
we have a voice in the outcome of this and future projects.

I'd like to introduce myself. I am a homeowner at 280 Cagney
Lane # 105 -one of the Villa Balboa buildings adjacent to Hoag
Hospital. I was recently elected by the Villa Balboa Home Owners
Association (HOA) to chair a committee to review the proposed
Hoag Hospital Cancer Center.
The reason I am writing this letter is to request continuous of
approval of Use Permit No. 1421 and for additional time to review
the impact of the entire Hoag Hospital rezoning. I feel that the
homeowners at Villa Balboa have been given inadequate time to
prepare for your September 4 public hearing.
I cite the following examples:
-Hoag Hospital has spent over 5 months in planning for the
proposed Cancer Center while Villa Balboa has had only a
few weeks to respond.
-The negative declaration prepared by the City Planning
Staff has not been available for public review until this
week.
-The Villa Balboa HOA board of directors met on August 20,
(earliest possible) to set up a committee to review the
Hoag proposal. We need time to organize.
-A high percentage of the homeowners of both Villa Balboa
and the Versailles are absentee -this requires extra
time to be notified.
-A questioner was been mailed to both HOA's on August 28.

Dear Ladies and Gentlemen,
As concerned citizens, homeowners and residents of Villa Bal-
boa we wish to extend our opposition to the location of the Hoag
Cancer Center. This is much against our wishes for many reasons
which only a few can be voiced here.
SAFETY-The proposed Bldg as planned is requesting the neces
-sity of cutting deeply into "The Bluff", thereby creating a more
unstable condition than alraedy exists and a hazard to our Bldg
which alr~~dy is within proximity of the Newport -Inglewood fault
within this coastal zone. Our place has alra~y shown some damage
from the last two recent earthquakes by two of our doors jamming,
bearing witness to the fact of the unstable ground condition.
HEALTH-For health reasons we will be exposed to smog due to
the many vehicles and transportation, especially of trucks that
will be delivering supplies to the rear of their bldg as planned
and which is at our doorstep (as the rear of proposed bldg-is just
a few feet from our door). We will be breathing in these exhaust
fumes as trucks keep running and unloading. What a sight to behold
in an exclusive neighborhood! As citizens, we have always consider
-ed NewpoTt Beach as a well planned community. Also for health rea
-sons they (Hoag Hosp.) have not filled enough data or guarantee
that ~here will not be damage from their High Powered Electron ac-
celerator that accelerates electrons at the speed of light within
the reach of our home. It would appear to be very poor community
planning to allow this.
NOISE-We as citizens of this community are entitled to a
quiet, peaceful enviroment, and if this center is erected as alrea
-dy planned on this site we will be exposed to extra traffic at

night and early morning hours causing loss of sleep as well as
lights from cars glaring into our windows etc ...

I am writing this letter because I am extremely concerned about
the cancer facilities at Hoag Hospital.
I believe that enlarging the facility is of utmost importance not
only to the members of our community, but also to people in
adjacent communities. It would be a tremendous asset to have a
treatment cente r of this kind close to so many of our citizens
who need the help it can provide. I reside at 2706 Bayshore
Drive in Newport Beach and would very much appreciate a positive
vote on your part for this project.
