(GLA) conducted a Phase I Archaeological Resources Assessment (Phase I) study (study) for the Surf Farm Project (Project) in Newport Beach, Orange County, California. The study consisted of background research and a field survey and was completed per the requirements of the California Environmental Quality Act of 1970 (CEQA). This study was prepared to: 1) identify archaeological resources that may meet the CEQA definition of a historical resource (California Public Resources Code [PRC] Section 21084.1) or a unique archaeological resource (PRC Section 21083.2) and that may be impacted by the proposed Project; (2) assess the potential for human remains; and (3) recommend best practices and procedures that may be utilized with respect to archaeological resources, if warranted. This report was prepared by GLA’s Director of Cultural Resources, Kerrie Collison, M.A., Registered Professional Archaeologist (RPA) 28731436. PROJECT LOCATION AND DESCRIPTION The 15.44-acre Project site is generally located in western Orange County, California within Newport Beach [Attachment A, Map 1]. It is depicted on the United States Geological Survey (USGS) Newport Beach, California 7.5-minute topographic quadrangle map in Section 12 of Township 6 South, Range 10 West, San Bernardino Baseline and Meridian (USGS 1981) [Attachment A, Map 2]. The Project site, which is part of the Newport Beach Golf Course, is in the east corner of the intersection of Irvine Avenue and Mesa Drive and has an address of 3100 Irvine Avenue [Attachment A, Map 3]. The Project site is currently developed with an existing 38-bay partially covered driving range, a putting green, three holes of the golf course (holes 1, 2, and 9), a pro shop, a restaurant with a full bar, and a large surface parking lot. Outdoor areas around the lagoon will be developed to provide seating and lounging areas, wave viewing platforms for spectators, private cabanas with bathrooms and showers, and three warming pools. Two new buildings are proposed. The main building will be three stories tall over a subterranean basement with a maximum height of 50 feet above grade. It will house ancillary uses such as: health and fitness facilities, a surf-related retail store, locker rooms, storage lockers, and food service. A second, smaller, building providing 20 overnight athlete accommodations will be two stories tall and 40-feet above grade. Square footage of new buildings totals approximately 79,534. The site will be served by two surface parking lots that will provide 351 spaces along with a designated drop-off and valet area. The site will be accessed from Irvine Avenue in the general location of the existing driveway, which will provide left/right access into the site, and right-turn only access out of the site. A secondary driveway is proposed along Mesa Drive. The facility will employ approximately 50 full-time and part-time employees. It is estimated that the average total personnel number on site will be approximately 35 at any given time of day or week. The proposed hours of operation for the surf lagoon are 6:00 a.m. to 11:00 p.m., 7 days a week with ancillary amenity hours varying based on demand. The surf lagoon, restaurant, bar, and retail store will be open to the public during most normal business hours; however, the lagoon will be closed for members-only usage during certain hours of the day to accommodate member peak demand. The facility is anticipated to host approximately 12 events per year. Construction of the Project is anticipated to take 18 months to complete. During project construction, parking and warm-up hitting bays will remain available for golf course use, as well as continued golf on properties to the north of Irvine Avenue and south of Mesa Drive. BACKGROUND RESEARCH South Central Coastal Information Center GLA archaeologist Kerrie Collison conducted a records search at the South Central Coastal Information Center (SCCIC) of the California Historical Resources Information System located at California State University, Fullerton, on September 9, 2024. The SCCIC, an affiliate of the California Office of Historic Preservation (OHP), is the official repository of cultural resources records and reports for Orange County. The records search included a review of all recorded historic-period and precontact cultural resources within a 0.5-mile radius of the Project site, as well as a review of known cultural resources surveys, excavation reports, and other documentation. The SCCIC records search results are included in Attachment B. Adam Cleary Back Bay Barrels, LLC March 3, 2025 Page 3 The results of the records search indicate that 38 previous cultural resources studies have included a portion of the records search area and three of the studies have included the Project site. However, the three studies that have included the Project site consist of a missing report, a literature search, and an annual report, none of which have fieldwork results documented. Approximately half of the records search area has been previously studied for cultural resources. A summary of all previous cultural resources studies identified during the records search is presented in Table 1. Table 1. The resources mainly consist of lithic scatters and habitation debris; however, resource P-30-000174 (which is less than 0.25-mile northwest of the Project site) also contained human remains. According to the site record for P-30-000174 (Smith 1966), bones were excavated from the site in 1950 and given to Bowers Museum. Aerial Photographs and Maps Historic topographic maps (USGS n.d.) and aerial photographs (NETR n.d.) were examined to provide historical information about the Project site and to contribute to an assessment of the Project site and vicinity. The results of the examination are presented in Table 2. Table 2. In summary, the map and aerial photograph review indicates that the Project site was initially disturbed by mechanical disking as early as 1938 and that the drainage ditch on adjacent property was constructed prior to 1938. The currently extant golf course and driving range, along with associated structures, were constructed between 1974 and 1980. Additional Background Research Soil surveys (USDA n.d.) indicate that three types of near surficial natural sediments exist within the Project Site: Myford sandy loam 2 to 9 percent slopes deposits, Myford sandy loam 9 to 15 percent slopes, and Thapto-Histic Fluvaquents deposits. Both Myford sandy loam 2 to 9 percent slopes deposits and Myford sandy loam 9 to 15 percent slopes deposits typically consist of sandy loam to 12 inches deep, sandy clay from 12 to 18 inches deep, and sandy clay loam to 71 inches deep. The Thapto-Histic Fluvaquents deposits typically consist of mucky clay to 9 inches deep, Adam Cleary Back Bay Barrels, LLC March 3, 2025 Page 6 mucky silty clay from 9 to 21 inches deep, highly decomposed plant material from 21 to 56 inches deep, and silty clay loam from 56 to 68 inches deep. Geologic deposits exist under surficial sediments of the Project site, specifically older alluvium, lake, playa, and terrace deposits that date to the Pleistocene (2.6 million to 11,700 years ago) (CGS 2015). ARCHAEOLOGICAL FIELD SURVEY GLA archaeologist Kerrie Collison conducted an intensive pedestrian survey of the Project site on September 10, 2024. The survey was conducted using opportunistic transects based on exposed sediment and considering safety during active golfing. The Project site is gently sloped and contoured. Where present, rodent burrowing holes and rodent dirt aprons were examined for evidence of near-surface archaeological deposits (such as artifacts or midden deposits) and/or human remains. At the time of the pedestrian survey, ground visibility of sediments in the Project site was approximately 25 percent due to manicured landscaping and concrete [Attachment C, Photograph 1]. A portion of the Project site was not surveyed (the active golf driving range) because it contains no natural sediment and is covered with artificial turf [Attachment C, Photograph 2]. The paved portion of the parking lot was also not surveyed [Attachment C, Photograph 3], but planters were checked for archaeological items. It was noted that the northwestern portion of the Project site has a lower elevation than the surrounding roads [Attachment C, Photograph 4 and Photograph 5]. No midden deposits, shells, debitage, or temporally diagnostic artifacts (precontact or historic-period) were observed. SUMMARY AND RECOMMENDATIONS This study consisted of background research and a field survey. The SCCIC records search results indicate that nine cultural resources have been recorded within 0.5 mile of the Project site. The Project site is less than 0.5 mile from Upper Newport Bay and within 0.25 mile of buried human remains (which were excavated in 1950). Disturbance to the Project site occurred by mechanical disking as early as 1938 and by construction of the drainage ditch on adjacent property prior to 1938. The field survey did not identify midden deposits, shells, debitage, or temporally diagnostic artifacts (precontact or historic period). It cannot be definitively stated whether pre-1938 activities or construction of the extant golf facilities in the Project site impacted cultural resources. However, the presence of nine precontact cultural resources within 0.5 mile of the Project site (one of which contained human remains) as well as the location of the Project site near Upper Newport Bay (which would have Adam Cleary Back Bay Barrels, LLC March 3, 2025 Page 7 served as a commonly and heavily used food source for precontact populations in the area) indicates an elevated sensitivity for subsurface cultural resources within the Project site. Cultural deposits within the Project site may be disturbed and no longer in their original depositional location due to development of the site, which would mean that deposits may not provide useful scientific data in terms of relative dating, but there is potential for identification of artifact types that could be subject to other methods of dating (such as obsidian) as well as the identification of human remains. Such artifact types or human remains could be considered historical resources or unique archaeological resources per CEQA. Historical resources are defined in PRC 21084.1 as resources listed in, or determined eligible for listing in, the California Register of Historical Resources (California Register). State CEQA Guidelines Section 15064.5(a) defines a historical resource in PRC 21084.1 and expands the definition to also include a resource included in a local register of historical resources. Historically significant resources are resources that meet listing criteria for the California Register, including the following criteria. A historical resource is one that: A. Is associated with events that have made a significant contribution to the broad patterns of California's history and cultural heritage; B. Is associated with the lives of persons important in our past; C. Embodies the distinctive characteristics of a type, period, region, or method of construction, or represents the work of an important creative individual, or possesses high artistic values; or D. Has yielded, or may be likely to yield, information important in prehistory or history. Ineligibility of a resource for listing in the California Register, non-inclusion of a resource in a local register, and nonidentification of a resource in a historical resources survey does not preclude an agency from determining that the resource is a historical resource. Public agencies must also consider project effects on unique archaeological resources. Per PRC 21083.2(g), an archaeological resource is considered unique if it: • Contains information needed for important scientific research questions and there is a demonstrable public interest in that information; • Has a special or particular quality such as being the oldest of its type or the best available example of its type; or • Is directly associated with a scientifically recognized important or historic event or person. Adam Cleary Back Bay Barrels, LLC March 3, 2025 Page 8 Recommendations While no known historical or archaeological resources exist within the Project site, for previously stated reasons, GLA recommends that an archaeologist monitor construction-related ground disturbance during Project implementation so artifact types that could be subject to dating (such as obsidian), as well as human remains, can be identified if present. Archaeological monitoring should continue until grading and excavation is complete. Upon completion of the monitoring and, if necessary, mitigation, the archaeologist should prepare a draft report to document the methods and results of the investigation(s). The final monitoring report should be submitted to the SCCIC. If archaeological materials are encountered during Project work, the archaeological monitor should examine the area closely and temporarily halt activity in the vicinity of the find. A Secretary of the Interior-qualified archaeologist should determine whether the find qualifies as a historical resource or a unique archaeological resource per CEQA. If the find is not a historical resource or a unique archaeological resource, avoidance of potential impacts to the find is not necessary. If the find is determined a historical resource or a unique archaeological resource, impacts to the resource should be mitigated. Mitigation of impacts may consist of excavating the archaeological deposit in accordance with a data recovery plan, recording the resource, preparing a report of findings, and accessioning recovered archaeological materials at an appropriate curation facility. It is not anticipated that the Project site contains human remains. However, in the event that human remains are encountered at any time during Project work, State Health and Safety Code Section 7050.5 states that no further disturbance shall occur until the Orange County Coroner has made a determination of origin and disposition pursuant to State PRC Section 5097.98. The County Coroner must be notified of the find immediately. If the remains are determined to be Native American, the County Coroner would notify the Native American Heritage Commission (NAHC) within 24 hours, which would determine and notify a Most Likely Descendant (MLD). With the permission of the landowner or his/her authorized representative, the MLD may inspect the site of the discovery. The MLD shall complete the inspection and make recommendations or preferences for treatment within 48 hours of being granted access to the site. The MLD’s recommendations may include scientific removal and nondestructive analysis of human remains and items associated with Native American burials, preservation of Native American human remains and associated items in place, relinquishment of Native American human remains and associated items to the descendants for treatment, or any other culturally appropriate treatment.
