tion for the subject improvements.
The Public Works Department will supply the Committee
with any additional information which may be required to make
findings and recommendations in this matter.

ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION
A preliminary environmental review of the project for the
loth Street at Bay Avenue Street Replacement has been performed.
The review was conducted in accordance with the requirements of the
California Environmental Quality Act of 1970, the State "Guide-
lines for Implementation of the California Environmental Quality
Act of 1970," and the City's "Policies and Procedures for Imple-
menting the California Environmental. Quality Act."
The environmental statement has been reviewed and was ap-
proved by the City's Environmental Affairs Committee.
As a result of the preliminary review, it has been determined
that:
1. The project is approved.
2. The project will not have a significant effect on
the environment.
3. An environmental impact report has not been prepared.
A Negative Declaration has been prepared and is
attached hereto.

NEGATIVE DECLARATION
BY
CITY OF NEWPORT BEACH
PUBLIC WORKS DEPARTMENT
1. PROJECT LOCATION: The project is located in loth Street from the Newport Bay
street end to the first alley south of Bay Avenue and in Bay Avenue from 10th
Street to 360 feet east of 10th Street.
2. PROJECT DESCRIPTION: Existing portland cement concrete pavement curb and gutter
in loth Street is to be removed and replaced. New pavement is to be 3 inches
asphaltic concrete over 4 inches crushed aggregate base. Portions of existing
18-inch corrugated metal pipe storm drain at the 10th Street end are to be re-
moved for construction of a.6-foot-long catch basin at the street end. The basin
will be fitted with an 18-inch diameter tide gate.
Existing portland cement concrete sidewalk, curb and gutter along the north side
of Bay Avenue is to be removed and replaced. New sidewalk is to be 5 feet wide,,.
in lieu of the existing 2 feet, with an 18-inch high tide surge wall "built along
the back of the walk. The surge wall will extend around loth Street end except,
for 15-foot beach access opening parallel to -loth Street.
3. PROJECT GOALS: The project will provide (1) relief from high tide flooding of
Bay Avenue and immediate area, (2) control over ocean water backflow flooding
through existing storm drain, (3) construction of adequate gutters and catch
basins to drain away storm water from the immediate area, (4) restoration of a
smooth riding surface alopg_lOth Street, (5) construction of an adequate width
sidewalk along the Bay Avenue beach, and (6) relief from high tide sediment
transport onto City streets in the immediate area.
4. EFFECT ON THE ENVIRONMENT: There will be no significant long-term irrevers-
ible or irretrievable effects on the environment. There will be minimal,
acceptable short-term disturbances of the environment due to construction
activity.
5. BASIS FOR NEGATIVE DECLARATION: This project is consistent with the General
Plan policies of the City of Newport Beach and could not have a significant
effect on the environment.
6. INITIAL STUDY: The City of Newport Beach Public Works Department has pre-
pared this Negative Declaration and its Initial Study in accordance with
Article 7, Chapter 3, Guidelines for Implementation of the California Environ-
mental Quality Act of 1970. Copies of the Initial Study may be obtained from
said department during normal business hours.
