BLOCK 5, EAST NEWPORT; AND IN THE SUBDIVISION OF BLOCK A,
EAST.NEWPORT
Attached for the Committee's review and comment are the
Notice of Determination and the EIR Negative Declaration for the
subject improvements.
The Public Works Department will supply the Committee with
any additional information which may be required to make findings and
recommendations in this matter.
The tentative project schedule calls for construction to
start in November 1976.

ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION
A preliminary environmental review of the proposed project for alley
improvement; in the Balboa Peninsula area of Newport Beach has been performed.
The review was conducted in accordance with the requirements of the California
Environmental Quality Act of 1970, the State "Guidelines for Implementation of
the California Environmental Quality Act of 1970", and the City's "Policies
and Procedures for Implementing the California Environmental Quality Act".
The environmental statement has been reviewed and was approved by the
City's Environmental Affairs Committee.
As a result of the preliminary review, it has been determined that:
1. The project is approved.
2. The project will not have a significant effect,on the environment.
3. An environmental impact report has not been •prepared. A Negative
Declaration has been prepared and is attached hereto.

AND 'IN THE„SUBDIVISION OF BLOCK'A, EAST NEWPORT.•

' I. LOCATION •
These alleys are located on the Balboa Peninsula in the City of Newport Beach.
The alley in Block 530, Lancaster's Addition, is in the City block bounded by
31st Street, 32nd Street, Lafayette Avenue and Villa Way; the alleys in Block 5,
East Newport, are in the City block bounded by 7th Street, 8th Street, Balboa.
Avenue and Bay Avenue; the alleys in the Subdivision of Block A, East Newport,
are in the two City blocks bounded by Lindo Avenue, Edgewater Avenue, Anade
Avenue and Bay Avenue.
II. DESCRIPTION OF THE PROJECT
The proposed project consists of paving eight existing unpaved alleys with
6-inch-thick portland cement concrete. The approximate total length of the
alleys is 1800 feet and the widths are 10 feet and 20 feet.
The project was initiated by a petition from concerned property owners. The'
procedure being used is found in Chapter 27 of the Improvement Act of 1911.
The cost of the project will be borne by the property owners.
III. PURPOSE OF THE PROJECT
The purposes of.the project are to: -

Eliminate dust and mud from the alley.
Provide a smoother driving surface.
Raise the value of adjacent property by improving the appearance of
the alley.
IV. DISCUSSION OF ENVIRONMENTAL IMPACT
A.
Land Resources
Pavement constructed by the project will be built on land already used as
an alley. No additional land will be required.
B. Human Resources
There will be no harmful effects on human resources caused by the project
since the proposed work is within the right-of-way of an existing, unpaved
alley. No relocation of residences will be necessary.
C. Air Resources
This project will not increase or decrease the total volume of vehicle
emissions in this air quality region. Hard surface pavement will reduce
the amount of dust raised by passing vehicles.
Dust control procedures will be used during construction.
D. Floodinn, Erosion, and Siltation
The terrain in the project area is very flat. The streets adjoining these
alleys are paved. The bay front beach forms the fourth side of -Subdivision
of Block A. There is a concrete sidewalk along the bay front adjacent to
the private homes. There will be no change in the possibility of flooding,
erosiop, or siltation of Newport Bay as a result of paving the alley.
E. Groundwater
There are no water aquifers in the area of the project.
F. Noise Level
Construction of the project will not alter the ambient noise levels for the
surrounding area, since no new additional volume of traffic in the alley is
expected.

During construction, noise levels may rise due to necessary construction
operations. Working hours will be limited to create the minimum of dis-
turbance to neighboring residents. The operations will cease upon comple-
tion of the project.
G. Vegetation and Animal Life
There are no known rare or endangered species or habitats of such species

V. BASIS FOR NEGATIVE DECLARATION
The proposed project has been reviewed in conjunction with Sections 15081 and
15082 of Article 7, Chapter 3 (Guidelines for Implementation of the California

Environmental Quality Act of 1970), Title 14, Division 6 of California Adminis-
trative Code. .
Comparison with the criteria set forth in the above sections indicates that the
proposed project will not have a significant environmental impact.
