Negative Declara- tion, and the Environmental Fact Sheet for the subject improvements. CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT BALBOA BOULEVARD MEDIAN MODIFICATIONS FROM 33RD STREET TO 44TH STREET (C-2369) ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION A preliminary environmental review of the project for modifica- tions of the Balboa.Boulevard median from 33rd Street to 44th Street in the City of Newport Beach has been performed. The review was con- ducted in accordance with the requirements of the California Environ- mental Quality Act of 1970, the State'Guidelines for Implementation of the California Environmental Quality Act of 1970," and the City's "Policies and Procedures for Implementing the California Environmental Quality Act." The environmental statement has been reviewed and was approved by the City's Environmental Affairs Committee. As a result of the preliminary review, it has been determined that: 1. The project is approved. 2. The project will not have a significant effect on the environ- ment. 3. An environmental impact report has not been prepared. A negative declaration has been prepared and is attached hereto. Benjamin B. Nolan Public Works Director IM:jd 3/22/83 • BALBOA BOULEVARD MEDIAN MODIFICATIONS FROM 33RD STREET TO 44TH STREET NEGATIVE DECLARATION by CITY OF NEWPORT BEACH, CALIFORNIA PUBLIC WORKS DEPARTMENT 1. PROJECT LOCATION: The project locations include (1) median islands along Balboa Boulevard between 33rd and 44th Streets and (2) West Newport Park, each within the City of Newport Beach and one-half mile proximate. 2. PROJECT DESCRIPTION: Landscaping, including 36.Washingtonia Robusta palm trees of height varying from 3 to 30 feet, will be removed from said median islands and replanted in West Newport Park. :The former palm tree sites will then be paved with asphaltic concrete. 3. PROJECT GOALS: Completion of the project will allow improved sight distances at eleven intersections along Balboa Boulevard, thereby providing for increased personal safety of the beach visitor or City resident. Also, the project will provide much -needed site beautification at West Newport Park one-half mile proximate to Balboa Boulevard. 4. EFFECT ON THE ENVIRONMENT. There will be no significant long-term irrevers- ible or irretrievable effects on the environment. There will be minimal, acceptable short-term disturbances of the environment due to construction activity during beach nonseasonal months. 5. BASIS FOR NEGATIVE DECLARATION: On the basis of the Initial Study, the project is found not to have a significant effect on the environment, but may provide for increased personal safety of the beach visitor and City resident. 6. INITIAL STUDY: The City of Newport Beach Public Works Department has prepared this Negative Declaration and the attached Initial Study in accordance with Article 7, Chapter 3 of the Guidelines for Implementation of the California Environmental Quality Act of 1970. An Environmental Checklist Form, attached hereto, has been completed as 'a portion of, this study. The following statements, referenced to questions presented on the Check- list, explain all "yes" and "maybe" answers: II.I.b. Landscaping removals along Balboa Boulevard will change median island topography between 33rd and 44th Street. Also, the palm tree installation in West Newport Park will change the park topography; however, such changes in topography will have no adverse effect on the earth therebelow. 11.18. Landscaping removals from Balboa Boulevard medians may result in an aesthetically offensive site open to public view. How- ever, an aesthetically offensive opinion may be mitigated since (1) the removals are considered "short-term" inasmuch as the reconstruction of Balboa Boulevard, including land- scape placement, should occur by 1988 and (2) the palm tree installation in West Newport Park will retain the desirable landscape materials within the neighborhood. 3/22/83 • • CITY OF NEWPORT BEACH P.O.
