NEGATIVE DECLARATION
FOR
STRUCTURAL SUPPORT OF BULKHEAD AT 1201-1325 BAYSIDE DRIVE
BY
THE IRVINE COMPANY
SEPTEMBER, 1976
I. LOCATION
The project site is located at 1201-1325 Bayside Drive in the City of
Newport Beach, California.
The surrounding areas are residential structures to the north, using the
subject bulkhead as support for existing patios; California Recreation
Yacht Basin to the west; .across the channel to the south are residential
structures on Balboa Island; and easterly is the Bahia Corinthian Yacht
Basin.
II. DESCRIPTION OF PROJECT
The work required is to replace the sand at the toe of the bulkhead which
may have been slowly eroded by tidal action or maintenance dredging in
the past.
It is the opinion of the Structural Engineering and Civil Engineering
consultants for the project that• unless this work is completed in accordance
with their recommendations and specifications in a timely manner, the possi-
bility of partial or total failure of the subject structural complex could
be imminent, thereby endangering the health, safety and welfare of the
general public.
III. PURPOSE OF THE PROJECT
To provide structural support with a minimum factor of safety at toe of
existing bulkhead (strengthening the toe of the bulkhead to minimize the
possibility of the sheet piles rotating away from the land fill) in order
to better protect adjacent structures, boats, slips, and human life or limb.
IV. DISCUSSION OF ENVIRONMENTAL IMPACT
A. Land Resources - This project will not require the use of
any additional land.
B. Human Resources - There will be no effects on human resources
caused by the project.
C. Air Resources - This project will not increase or decrease the
total volume of vehicle emissions in this air -quality region.
D. Geologic Hazards - There are no known significant geologic
hazards within the area encompassed by the project.
E. •Flooding, Erosion and Siltation - Due to the nature of this
project, flooding and erosion are not a consideration. Siltation will be
controlled during placement through the use of spreader spoon at the end
of the discharge line.
F. Groundwater - Due to the nature of this project, groundwater
is not a consideration. There are no known fresh water aquifers in the
area of the project. The nature of the construction is such that conta-
mination or blockage of aquifers will not occur.
G. Noise Level - Construction of the project will not alter the
ambient noise levels for the surrounding area. During construction, noise
levels may rise due to operations which are necessary to construct the
project; however, these operations will be limited to the working hours
to create the minimum of disturbance to neighboring residential. The
operations will cease upon,completion of the project.
H. Vegetation and Animal Life - The proposed sand fill area is
devoid of algae and eel grass and lacks evidence of significant molluscan
population. (See attached Marine Biological Consultants, Inc. report).
I. Short Term -Impacts - The only short term impacts anticipated
are those associated with any similar construction project. They are such
items as noise during construction and turbity during sand placement which
will be controlled as explained in Paragraph E. These impacts should not
have a significant effect on the environment.
J. Long Term Impacts - The project will provide a much needed
beneficial long term impact in that it will protect the health, safety
and welfare of persons in the vicinity of the project as well as possible
providing additional beneficial results by protecting the economic and
natural resources that would havetobe expended if the existing structure fails.
K. Summary - The project does not appear to have a significant
effect on the environment.
V. BASIS FOR NEGATIVE DECLARATION
The proposed project has been reviewed in conjunction with Sections 15081
and 15082 of Article 7, Chapter 3 (Guidelines for Implementation of the
California Environmental Quality Act of 1970), Title 14, Division 6 of the
California Administrative Code.
Comparison with the criteria set forth in the above sections indicates
that the proposed project will not have a significant environmental impact.

RE: Biological Reconnaissance of Balboa Channel 31 August 1976
Dear Mr. McCarthy:
A biological reconnaissance of a proposed sand fill site was made
on 31 August 1976 by personnel of Marine. Biological Consultants, Inc.,
at the request of the Irvine Company. The site occupies the southeastern
edge of the Balboa Channel adjacent to 1201-1325 Bayside Drive, Newport
Beach.
The area canbe characterized as a sandy intertidal area whose upper
tidal levels are represented by an existing concrete bulkhead running the
length of the site. The base of the existing bulkhead was approximately
one foot above Mean Lower Low Water.
The bulkhead structure was nearly devoid of encrusting organisms
usually associated with similar structures elsewhere in Newport Bay.
The mussels (Mytilus edulis), sea squirts (Styela sp. ), barnacles (Balanus
sp. and Chthamalus sp.) and their associated encrusting growths, while
obvious on adjacent docks, were absent on the bulkhead.
The remaining portion of the area which would be affected by the
proposed sand fill operation is largely below MLLW, with relatively
small portions being exposed by outgoing tides. The fauna at the base
of the bulkhead and seaward reflects a benthic rather than an intertidal
community.
The silty sand bottom was covered by athin mat of filamentous algae
and tube dwelling organisms, typical of local shallow water embayments.
The tube dwelling isopod crustacean, Leptochelia sp., was the domi-
nant member of the community. Polychaete annelids of the families

Capitellidae and Spionidae were expectedly abundant as were caprellid and
gammarid amphipods. A lack of shell debris in the sediment implies
that the area does not support a substantial molluscan population.
Large algae or• marine grasses (e.g., Zostera marina eel grass)
typically encountered in Newport Bay were not observed at the study site.
Overall, the area subject to coverage by the sand fill operation was
essentially typical of shallow benthic areas of southern California ern-
bayments. Since the area was devoid of algae and eel grass and lacked
evidence of significant molluscan populations, the area should be con-
sidered as one upon which, a sand fill operation would have only a minor
and temporary adverse environmental impact. The pre-existing com-
munity should become re-established in a relatively short time.

MAINTENANCE DREDGE AND PLACE MATERIAL AGAINST BULKHEADS AT
1201-1325 BAYSIDE DRIVE
RECOMMENDATION
If desired, approve the Harbor Permit subject to 1) the approval of the
U. S. Army Corps of Engineers, 2) The Irvine Company provide for the
continued surveilance of the existing bulkheads and 3) The Irvine Company
provide for continued maintenance of dredging and bulkhead support.
DISCUSSION
This application is for maintenance dredging of 1,000 cubic yards of material
from beneath slips with the material to be placed against adjacent bulkhead
for stabilization.
The blanket maintenance dredging permit obtained from the Corps of Engineers
limits dredging to 100 cubic yards with the material disposed of at sea.
Because this project exceeds the 100 cubic yard limit and the material
is to be disposed within Newportilay, a separate permit is required from
the Corps of Engineers. City Council approval is required prior to submittal
to the Corps of Engineers.
The Irvine Company has performed maintenance dredging in this area within
the past five years, however the spoils from that operation were hauled
to sea. A recent survey of bulkhead lengths has revealed some shallow
depth panels which could be seriously jeopardized by additional removal of
material. The project, if approved, will provide for adequate depth for the
mooring of boats and will provide protection for the bulkhead. To satisfy
City requirements, as well as State and Federal permit agencies, for a project
of this scope, The Irvine Company has performed certain surveys and tests
in the dredge zone. Based on these tests a Negative Declaration has been
prepared and approved by the Environmental Affairs Committee, a copy of
which is attached.

Conditions 2) and 3) are suggested in view of the bulkhead depth, the
