SUBJECT: BALBOA AVENUE STORM DRAIN IMPROVEMENTS, MARINE AVENUE TO
THE GRAND CANAL (C-1683) - EIR NEGATIVE DECLARATION
Attached for the Committee's review and comment are copies
of the Notice of Determination, the EIR Negative Declaration, and the
Environmental Fact Sheet for the subject improvements.
The Public Works Department will supply the committee with
any additional information which may be required to make findings and
recommendations in this matter.
The tentative project schedule calls for construction to
start in August 1975; final design of the project will occur this
fiscal year.

MARINE AVENUE TO THE GRAND CANAL
ENVIRONMENTAL REVIEW - NOTICE OF DETERMINATION
A preliminary environmental review of the proposed project to
construct storm drain improvements in Balboa Avenue from Marine
Avenue to the Grand Canal has been completed. The review was
conducted in compliance with the requirements of The California
Environmental Quality Act of 1970, the State "Guidelines for
Implementation of the California Environmental Quality Act of
1970", and the City's "Policies and Procedures for Implementing
the California Environmental Quality Act".
As a result of the preliminary review, it has been determined
that:
1. The project is approved.
2. The project will not have a significant effect
on the environment.
3. An Environmental Impact Report has not been
prepared. A Negative Declaration has been
prepared and is attached hereto.

MARINE AVENUE TO THE GRAND CANAL
EIR - NEGATIVE DECLARATION
BY
CITY OF NEWPORT BEACH - PUBLIC WORKS DEPARTMENT
1. Location: The proposed project is located on Balboa Island in the City of
Newport Beach.
2. Project Description: The work consists of construction of a stormwater pump
station in Balboa Avenue at The Grand Canal and construction of a gravity
storm drain collection system in Balboa Avenue from Marine Avenue to the
Grand Canal.
3. Purpose of Project: The project will provide for the replacement of an
existing deficient gravity storm drain system in Balboa Avenue at the Grand
Canal. During periods of high tides the system cannot function and, if a
rainstorm is concurrently occurring, flooding of adjacent private property
results. Construction of the project will alleviate the potential for severe
flooding.
4. Discussion of Environmental Impacts: -
a) Land Resources
The proposed project is located within existing public street right -
of way.
b) Geologic Hazards
The project lies within a seismic hazard area of potential liquefaction;
however, the contemplated construction will not increase or decrease the
hazard.
c) Secondary Consequences
The project will not increase or decrease stormwater flow into the Bay.
Siltation and floatable pollution will be reduced by collection prior to
discharge.
5. Basis for Negative Declaration: The proposed project has been reviewed in
conjunction with Sections 15081, 15082, and 15083, Chapter 3 -- Guidelines fdr
Implementation of the California Environmental Quality Act of 1970, Division 6,
Title 14, California Administrative Code. The project is not in conflict with
the environmental goals and plans of the community; it does not have any
aesthetic effect; it does not affect animal or plant life;, and it does not
affect the air quality, water quality, and the ambient noise levels of the
adjoining areas. Review of the criteria set forth in the above noted 'sections
indicates that the proposed project will not have a significant environmental
impact. A copy of the informational fact sheet is attached for reference.

FACT SHEET TO DETERMINE IF PROJECT HAS A SIGNIFICANT
ENVIRONMENTAL EFFECT
A. Conformance with the City General Plan
The project is in conformance with the Balboa Island Drainage Study, an area -
wide plan for drainage improvements on the island completed in 1974. The
plan was approved by the City Council in January 1975. This project is in
conformance with the City's General Plan.
B. Land Use
Construction of the project will not require acquisition of right-of-way. The
storm drain system will be located within existing public street right-of-way.
Land use on Marine Avenue i,s commercial, and on Balboa Avenue is residential.
C. Human Resources
The project will not require the relocation of any homes,businesses or people.
D. Geologic Hazards
A potential seismic hazard due to liquefaction exists in this area. However the
project involves shallow excavations and reconstruction of street surfacing and
will not increase or decrease any potential damage due to the seismic hazard.
E. Flooding, Erosion, or Siltation
Project planning calls for construction of this project to occur during the
summer and early fall months prior to the normal rainy season for this region.
Construction during that period should preclude the possibility of flooding,
erosion and any subsequent siltation of materials in Newport Bay. •The project
specifications will require the contractor to employ erosion control measures
during construction to further reduce any possibility for siltation.
F. Groundwater
Groundwater exists in the area from seawater tidal sources; subsequently de -
watering by pumping will be required for structure and pipeline construction.
A permit from the Sanitation Districts of Orange County will be obtained to
allow dewatering effluent to be discharged into the sanitary sewer system.
G. Noise Level
•
During construction, noise levels may rise due to operations which are necessary
to construct the project. However these operations will be limited as to working'

hours to ensure a minimum of disturbance to residents and commercial establish-
ments. During operation of the stormwater pump station noise levels may rise,
however noise attenuation will be considered of prime importance in the design
of the facility and acceptable noise levels will be maintained, during operation
of the station.
H. Archeological and Paleontological Sites
There are no known archeological or paleontological sites within the project
limits. However.should grading operations encounter significant fossils or
artifacts, construction scheduling will be altered to allow sufficient time
for investigation and recovery of finds.
I. Air Resources
This project will not affect the air quality of this region. Dust control
measures will be required during construction under the project specifications.
J. Vegetation and Animal Life
There are no known rare or endangered species of animal or plant life within
or adjacent to the project area.
K. Water Resources
The proposed project will not affect the water resources in the area.
L. Secondary Consequences
The proposed project will not cause an increase or decrease in the volume of
stormwater entering Newport Bay. The wetwell of the stormwater pump station
will provide for silt removal and collection of floatable materials, thus
improving water quality.
M. Short -Term Impacts
The only short term impacts anticipated.for this project are a slight amount
of motorist inconvenience and some construction noise. These impacts are not
considered to be significant.
N.' Summary
The project does not appear to have a significant effect on the environment.
