Subject: ZONE CHANGE/TRACT 3867/ USE PERMIT 1466 -
NEGATIVE DECLARATION
This letter is submitted requesting the finding of a negative declaration
on subject project.
Subject project is in conformance with the City General Plan policy state-
ments developed to this point in time and is compatible with the adjacent
development, being an extension of same. All necessary utilities are
existing adjacent to the site, therefore, this development will not result
in the expansion of same. Finally, the realignment of Bayside Drive in
conjunction with the development of Promontory Bay make the revision of
the present access to the existing development mandatory. Subject project
will provide for this access revision in accordance with City standards.
We submit that the above mentioned factors combined with the more obvious
factors of no vegetation, no wildlife, no geologic significance, etc.
result in our properly requesting a negative declaration on subject
property.

AMENDMENT NO. 380
ENVIRONMENTAL REVIEW - NOTICE OF DETERMINATION
A preliminary environmental review of the proposed project
for Amendment No. 380 in the City of Newport Beach has been
performed. The review was conducte4'in accordance with the
requlrements'of the,Callfornia Environmental quality Act of
1970, the State "Guidelines for Implementatipn of the Calif-'
ornia Environmental, quality Act of 1970" and the City's
"Policies and Procedures:for Impjementi,ng the California
Environmental quality Apt".
As a result of the preliminary review ti has been determined.
that:
1. The project will not have a significant effect
on the environment.
2. An Envlron'mental.Impact Report has not been
prepared. A Negative Declaration has been
prepared and is attached hereto.
