NEGATiVE DECLARATION

CITY OF NEWPORT BEACH
1. Location: The proposed project is located in the Finley Tract near the
Newport Beach City Hall. The limits of the project are: Finley Avenue
from Newport Boulevard to 34th Street; 34th Street from Finley Avenue to
the Rivo Alto; the alley between Clubhouse Avenue and Newport Boulevard
from Short Street to 380' south of Finley Avenue; and the street ends at
35th Street, 36th Street, and 36th Street stub. An exhibit is attached.

2. Project Description: The project proposes:
a) Reconstruction of Finley Avenue from Newport Boulevard to 34th Street.
b) Reconstruction of the alley between Clubhouse Avenue and Newport
Boulevard from approximately 380' south of Finley Avenue to Short
Street.
c) Reconstruction of the 34th Street, 35th Street, 36th Street, and
36th Street stub street ends at the Rivo Alto. •
d) Construction of the storm drain system in Finley Avenue•and 34th
Street.
The above listed work will require the construction of new pavement; con
crate curb and gutter, sidewalk and drive approaches, street end bulkheads,
and storm drain system.
3. Purpose of Project: The purpose of the project is to improve storm drain—
age and minimize flooding at peak tides. In conjunction with the storm
drain work, street improvements will reduce maintenance problems, reduce
erosion, and upgrade the appearance of the entrance to the tract. The
prcaosed project is essentially a maintenance type project.
". Discussion of Environmental Impacts: Construction of the 'drainage system
will reduce silting and erosion. Storm water will continue to enter the
Newport Bay via the Rivo Alto.
Construction of the street end bulkheads will minimize the, flooding that
occurs at peak tides and provide for safer public access to the Bay:

Reconstruction of the existing streets and alleys does not require any
additional right -off -way. The project will not affect any existing building
or require the relocation of any people.
5. Basis for Negative Declaration: The proposed project has been reviewed in
conjunction with sections 15031, 15082, and 15083 of the California Environs
mental Quality Act of 1970. Criteria set forth in those sections indicate •
that the proposed project.will not have a significant environmental impact.

A. Conformance with City Goals
The project is in conformance with the City's long term goal of gradual
correction of storm drainage problems and flooding at peak tides on the
Balboa Peninsula. The storm drain facility.propcsed in this project con-
forms with the area -wide storm drainage system established when the 32nd •
Street storm drain facility was constructed in 1970. The proposed storm
drain facility will be designed to permit future improvement of the exist-
ing drainage. facilities under Newport Boulevard at Finley Avenue.
B. Land Use
Existing land use adjacent to the proposed project is predominantly resi-
dential, with the exception of the easterly side of the alley between
Newport Boulevard and Clubhouse Avenue Which is' commercial.
The project will be constructed within the existing street right of way,
requiring no additional right-of-way, and is essentially a maintenance
project.
C. Human Resources
The project does not affect any existing, building or require the _relodation
of any people. •
D. Geologic Hazards
Liquifaction is a potential hazard in the project area. However, since this
project only involves shallow excavations and reconstruction of existing streets
it would not increase or decrease the damage potential from this hazard_
E. Flooding and Water Quality
The project will minimize the problem of flooding at peak tides and improve
the storm drainage characteristics.
No pollution is anticipated as a result of the contractor's operations. It
is anticipated that some pumping to dew&ter*the excavations for installation
of the storm drain system will be required. Arrangements will be made with
the Orange County Sanitation District to discharge the ground water into the
sewer system.

No silting or erosion is anticipated as a result of the proposed project.
F. Noise Level
The project will neither increase nor decrease the level of noise in the
area.
G. Air Resources
This project will not significantly increase or decrease the total volume
of vehicle emissions.
H. Vegetation and Animal Life
There are no known rare or endangered species of animal or plant life with-
in or adjacent to the project area.
I. Water Course
Upon completion of the project, storm water will continue to enter the
Newport Bay via the Rivo Alto.
J. Long -Term Impacts
This project will have no long-term, irreversible or irretrievable effects
on the commitments of resources in the City. The proposed project comple-
ments the existing and on=going development in the adjacent area.
K. Short -Term Impacts
The only short-term impacts anticipated are those associated with any
street project. They are such items as noise and motorist inconvenience
to through traffic and ingress -egress to the residents adjacent.to the
project. These impacts are not considered to have a significant effect
on the environment.
L. Summary
The project does not appear to have a significant effect on the environ-
ment. In fact, it would seem that the decision not to construct the project
would have a more important effect on environment, as it would sustain the
poor drainage conditions and the problem of flooding at peak tides.

ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION
A preliminary environmental review of the proposed project for storm
drain and street improvements for Finley Avenue from Newport Boulevard
to 34th Street in the City of Newport Beach has been performed. The
review was conducted in accordance with the requirements of the Cali-
fornia Environmental Quality Act of 1970, the State "Guidelines for
Implementation of the California Environmental.Quality Act of 1970",
and the City's "Policies and Procedures for Implementing the California
Environmental Quality Act."
As a result of the preliminary review it has been determined that:
1. The project is approved.
2. The project will not have a significant effect on the environment.
3. An environmental impact report has not been prepared. A
Negative Declaration has been prepared and is attached hereto.
