The review was conducted in compliance with the requirements of the California Environmental Quality Act of 1970, the State "Guidelines for Implementation of the California Environmental Quality Act•of 1970," and the City's "Poli- cies and Procedures for Implementing the California Environmental Quality Act." As a result of the preliminary review, -it has been determined that: 1. The project is approved. 2. The project will not have a significant effect on'the environment. 3. An Environmental Impact Report has not been prepared. A Negative Declaration has been prepared and is at- tached hereto. Devlin, RCE 9537 ks Director SAN DIEGO CREEK BICYCLE TRAIL FROM JAMBOREE ROAD TO NEWPORT BEACH/IRVINE CITY BOUNDARY ENVIRONMENTAL STATEMENT NEGATIVE DECLARATION BY PUBLIC WORKS DEPARTMENT CITY OF NEWPORT BEACH 1. LOCATION: The proposed project is located within the City limit of Newport Beach on the southerly levee of the San Diego Creek. The project length is approximately 1,600 feet. ' 2. PROJECT DESCRIPTION: The work consists of constructing a 10-foot-wide, 3-inch thick asphalt concrete bicycle trail on the existing levee and in areas pre- viously graded for the bicycle trail. Included is a 94-foot-long by 4-foot- high timber bridge over Bonita Canyon Creek. The bicycle trail is on the City of Irvine and City of Newport Beach Master Plan of Bikeways and the Orange County Master Plan of Arterial Bikeways. 3. PURPOSE OF PROJECT: The purpose of the project is to provide a separated bikeway along San Diego Creek to connect the present terminus of the San Diego Creek Trail at California Avenue with the Jamboree Road Bike Trail which in turn will allow bicyclists to ride on a bicycle trail from Coast Highway in Newport Beach to the Harvard Avenue/A.T. & S.F. Trail in the City of Irvine, a distance of about nice miles. 4. DISCUSSION OF ENVIRONMENTAL IMPACTS: The short-term impact related to construc- tion noise is the only apparent impact. The construction of the trail should take four or five days and the equipment used will be adequately muffled to minimize the adverse effect. 5. BASIS FOR NEGATIVE DECLARATION: The proposed project has been reviewed in conjunction with Sections 15081, 15082, and 15083, Chapter 3--Guidelines for Implementation of the California Environmental Quality Act of 1970, Division 6, Title 14, California Administrative Code. The project is not in conflict with environmental plans and goals of the communities; it does not have a substan- tial and demonstrable negative aesthetic effect; it does not affect rare and endangered species of animal or plant life, it does not interfere with movement of migratory fish or wildlife; and it will not result in a substantial detri- mental effect on the air or water quality, or on ambient noise levels for adjoining areas. Review of the criteria set forth in the above noted sections indicates that the proposed project will not have a significant environmental impact. FACT SHEET TO DETERMINE IF PROJECT HAS SIGNIFICANT ENVIRONMENTAL EFFECT BY PUBLIC WORKS DEPARTMENT CITY OF NEWPORT BEACH A. CONFORMANCE WITH GENERAL PLANS The project is in conformance with the Master Plan of Bikeways for the City of Newport Beach and the City of Irvine as well as the Master Plan of Arter- ial Bikeways of Orange County. B. LAND USE The project will utilize an existing unpaved levee roadway and be within right-- of-way currently owned by public agencies. C. HUMAN. RESOURCES The project will not displace any people or buildings. . D. GEOLOGIC HAZARDS Most of the levees have been in place for several years and have experienced no problems. The bridge piling will be drilled in place and backfilled to avoid distubrance of M.W.D., C.M.C.W.D. and Southern California Gas Co. lines. No geologic hazards are known of or anticipated. E. FLOODING, EROSION, OR SILTATION The grading for the trail is limited'to leveling for paving and'will not dis- turb vegetated slopes. The gap in the levee between Jamboree Road and MacArthur Boulevard will be bridged to allow free flow of runoff from Bonita Canyon. No flooding, erosion, or siltation are anticipated as a result of the project. F. GROUND WATER The trail will not effect ground water conditions. G. NOISE LEVEL The bicycle trail will not change the ambient noise levels for the surrounding area. Fact Sheet: San Diego Creek Bicycle Trail Page 2 H. AIR RESOURCES The trail will not increase or decrease the volume of vehicle emissions except that it may encourage more bicycle usage. I. WATER RESOURCES The trail will not effect the water resources of the area. J. SHORT-TERM IMPACTS The short-term impact anticipated for this project is construction noise. This impact is not considered to be significant. K. SUMMARY The project does not appear to have a significant effect on the environment. DLW 6-1-77
