This review was conducted in accordance with the. requirements of the California Envi— ronmental Quality Act of 1970, the State "Guidelines for Implementation of the California Environmental Quality Act of 1970," and the City's "Policies and Procedures for Implementing the California Environmental Quality Act." As a result of the preliminary review, it has been determined that: 1. The project is approved. 2. The project will not have a significant effect on the environment. 3. CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT ENVIRONMENTAL IMPACT STATEMENT NEGATIVE DECLARATION • THE RHINE WHARF PARK 1. Location: The proposed project is located in the City of Newport Beach, adjacent to the Rhine Turning Basin at Lido Park Drive. An exhibit is attached showing the location of the project. 2. Project Description: The project proposes: a. Construction of a timber wharf and boardwalk overhanging the existing concrete bulkhead at the Rhine. The wharf will be supported on re- inforced concrete bearing piles, andequipped with timber fender piles. It is approximately 350 feet long, and projects 6 feet beyond the existing bulkhead; b. Installation of landscaped street islands adjacent to the wharf in Lido Park Drive; c. Minor alterations and street improvements to Lido Park Drive. 3. Purpose of Project: This project will provide a public view park and pedes- trian walkway along the southerly side of Lido Park Drive. The wharf park, together with the adjacent street improvements, will enhance and unify the surrounding developments. 4. Discussion of Environmental Impacts: The proposed project is consistent with the City's General Plan Policies, requires no additional right-of-way, and will not cause the -relocation of any people 'or the disturbance of any buildings. Drainage patterns will not be altered, and the wharf should not affect the quality of the water in The - Rhine. There should be•no additional noise.or polution as a result of this project. Marine life and navigation will not be significantly affected by the presence of the wharf.. : • The bottom of the Rhine Channel adjacent to the bulkhead will be disturbed temporarily during placement of the piles. This disturbance should not have a significant effect on Marine organisms as the bottom is essentially sterile in the project area. There will be no long-term, irreversible or irretrievable effects on the environment, and no significant short-term effects. Temporary impact during construction of the wharf and its pile supports will not be to the disadvan- tage of long-term environmental goals. vClegative Declaratiorehe Rhine Wharf Park Page 2 5. Basis for Negative Declaration The proposed project has been reviewed in conjunction with Sections 15081, 15032, and 15083 of the "Guidelines for Implementation of the California Environmental Quality Act of 1970." Criteria set forth in these sections indicate that the project will not have a significant environmental impact. • • FACT SHEET TO DETERMINE ' IF PROJECT HAS SIGNIFICANT ENVIRONMENTAL EFFECT THE RHINE WHARF PARK A. Conformance with City.Goals This project conforms to the City's General Plan Policies of providing and encouraging the use of pedestrian ways and view parks, and protecting and enhancing visual access to the water front. The new wharf will connect those existing at either end. B. Land Use Existing land use adjacent to the proposed project is multiple residential and commercial. The project will be constructed within existing City right- of-way (street, channel and turning basin), requiring no additional right-of- way. Construction of the wooden wharf boardwalk and the landscaped street islands will greatly enhance the appearance of this picturesque "fishing village." C. Human Resources The project does not affect any existing building or require the relocation of any people. D. Geologic Hazards Liquefaction is a potential hazard in the project area. However, construction of the wharf boardwalk will not affect the damage potential of this hazard; nor will liquefaction affect the design or construction of the wharf. E. Flooding and Water Quality There will be no change in the'existing runoff patterns on Lido Park Drive adjacent to the proposed project. No pollution is anticipated as a• result of the contractor's operations. In- stallation of the piling for• the wharf will be performed in accordance with the requirements of the California Regional Water Quality Control Board -- Santa Ana Region, and the United States Army Corps of Engineers. Mitigation measures will include a floating scum control curtain to confine any surface debris during construction. No silting or erosion is anticipated as a result of the proposed project. F. Noise Level The project wilt neither increase nor decrease the level of noise in the area. Fact Sheet --The Rhine harf Park Page 2 G. Air Resources This project will not affect the air quality. H. Vegetation and Animal Life There are no known rare or endangered species of animal or plant life within the project area. The construction of the wharf park should not significantly affect the marine life in The Rhine. I. Natural Resources The proposed wharf will not significantly affect the navigability of the Rhine Turning Basin, since the area immediately adjacent to the existing bulkhead is relatively shallow. Features are to be incorporated into the design of the proposed wharf to insure the continued operations of the commercial fishing fleet adjacent to the turning basin. J. Long -Term Impacts This project will have no long-term, irreversible or irretrievable effects • on the commitments of resources in the City. The proposed project will en- hance and complement the existing and on -going development in the adjacent area. K. Short -Term Impacts._ The only short-term impacts anticipated are those associated with any similar construction project. They are such items as noise and restricted access within the construction area, and temporary disturbance of The Rhine bottom during pile installation. These impacts are not considered to have a sig- nificant effect on the environment. L. Summary This project does not appear to have any significant adverse environmental effects. In fact, the proposed view park should beautify and upgrade the appearance of the. area, as well as permit greater pedestrian and visual ac- cess along the scenic Rhine and to the nearby "Cannery village."
