The review was conducted in accordance with the requirements of the California Environmental Quality Act of 1970, the State "Guidelines for Implementation of the California Environmental Quality Act of 1970," and the City's "Policies and Procedures for Implementing the California Environmental Quality Act." The environmental statement has been reviewed and was approved by the City's Environmental Affairs Committee. As a result of the preliminary review, it has been determined that: 1. The project is approved. 2. The project will not have a significant effect on the environment. 3. An environmental impact report has not been prepared. Nolan Public Works Director AIM:dw 11-15-88 MACARTHUR BOULEVARD TO SEA LANE SIDEWALK CONSTRUCTION NEGATIVE DECLARATION BY CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT 1. PROJECT LOCATION: The proposed sidewalk is to be built within existing right-of-way along the east side of MacArthur Boulevard between Sea Lane and San Miguel Drive in the City of Newport Beach, County of Orange. 2. PROJECT DESCRIPTION: Approximately 250 linear feet of curb and gutter will be built along the east side of MacArthur Boulevard from Sea Lane northerly to join curb and gutter southerly of San Miguel Drive. The area behind the new curb and gutter will be graded as necessary to construct a 10-foot wide sidewalk. A beige slumped block retaining wall with exposed face ranging from 3 to 7 feet in height will be built to support the embankment behind the sidewalk. The outer 6 feet, approximately, of MacArthur Boulevard pavement will be reconstructed to join the new gutter. 3. PROJECT GOALS: The project will provide sidewalk continuity for 'pedestrians and bicyclists where none presently exists. The walkway should provide increased safety for travel to old Corona del Mar or to the beach. The new curb and gutter should facilitate roadway drainage and maintenance. 4. EFFECT ON THE ENVIRONMENT: There will be no significant long-term irreversible or irretrievable effects on the environment. There will be minimal, acceptable short-term disturbances caused by construction activity. 5. BASIS FOR NEGATIVE DECLARATION: This project is consistent with the General Plan of the City of Newport Beach and will not have a significant effect on the environment. 6. INITIAL STUDY: The Public Works Department of the City of Newport Beach has prepared the Negative Declaration and its Initial Study in accordance with Articles 6 and 5, respectively, of Chapter 3, Guidelines for Implementation of the California Environmental Quality Act. CONFORMANCE WITH THE GENERAL PLAN This project is consistent with the environmental plans and goals of the City of Newport Beach; in particular, the Master Plan of Street and. Highways, Circulation Element of the General Plan. B. ENVIRONMENTAL CHECKLIST FORM An Environmental Checklist Form (attached) has been completed as a portion of this Study. The following statements, referenced to questions presented in the Checklist, explain all "yes" and "maybe" answers: II.1.b. & c. - A 12-foot width by 250-foot length, approximately, of street right-of-way adjacent to the east side of MacArthur Boulevard will be excavated, compacted and covered with a 10-foot wide sidewalk, plus curb and gutter. II.3.b. - The construction of sidewalk, curb and gutter over this previously -graded right-of-way should result in an increased rate and volume of surface runoff. II.13.d. - Pedestrians and bicyclists should use the proposed sidewalk for 2-way transit along MacArthur Boulevard. They presently travel along the paved or graded shoulders on both sides of the highway.
