ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION
A preliminary environmental review of the proposed project for storm
drain and street improvements for the streets listed above in the City
of Newport Beach has been performed. The review was conducted in accord-
ance with the requirements of the California Environmental Quality Act
of 1970, the State "Guidelines for Implementation of the California
Environmental Quality Act of 1970", and the City's "Policies and Proced-
ures for Implementing the California Environmental Quality Act".
As a result of the preliminary review it has been determined that:
1. The project is approved.
2. The project will not have a significant effect an the
environment.
3. An environmental impact report has not been prepared.
A Negative Declaration has been prepared and is attached
hereto.

STORM DRAIN AND STREET IMPROVEMENTS
FOR
"K" AND—'T." STREETS
FROM
MIRAMAR DRIVE TO NEWPORT BAY
1. Location: The proposed project is located in the City of Newport Beach
toward the end of the Balboa Peninsula, encompassing the three streets
listed below. An exhibit is attached showing the limits of the project.
2. Project Description: This project proposes:
a) Reconstruction of existing storm drain system in "K" Street
from Balboa Boulevard to Newport Bay;
b) Extension of the storm drain system into Balboa Boulevard from
"K" Street to "L" Street, and into "L" Street from Balboa
Boulevard to Miramar Drive.
c) Reconstruction of portions of "K" Street, Balboa Boulevard, and
"L" Street as required in conjunction with the new storm drain
system.
The above listed work will require the construction of new pavement, concrete
curb and gutter, sidewalk and drive approaches,•a gated tidal structure, and
storm drain system.
3. Purpose of Project: The purpose of this project is to improve storm drainage
and minimize flooding at peak tides. In conjunction with the storm drain work,
the existing portland cement concrete streets will be reconstructed, reducing
maintenance requirements, and upgrading the appearance of the streets. This
project is essentially a maintenance project.
4. Discussion of Environmental Impacts:
This project is in conformance to long-range City goals, requires no additional
right-of-way or relocation of any people. Drainage patterns will not be altered,
so there will be no change in water quality. There will be no additional noise
or pollution as a result of this project.
There will be no long-term, irreversible or irretrievable effects on the environ-
ment, and no significant short-term effects.
5. Basis for Negative Declaration:
The proposed project has been reviewed in conjunction with Sections 15081,
15082, and 15083 of the California Environmental Quality Act of 1970. Criteria
set forth in those sections indicate that the proposed project will not have a
significant environmental impact.

A. Conformance with City Goals
The project is in conformance with the City's long-term goal of gradual
correction of storm drainage problems and flooding at peak tides on the
Balboa Peninsula. This project involves the replacement of an inadequate
storm drain system and the extension of the system to alleviate flooding.
B. Land Use
Existing land use adjacent to the proposed project is residential. The
project will be constructed within the existing street right-of-way, requir-
ing no additional right-of-way; and is essentially a maintenance project.
C. Human Resources
The project does not affect any existing building or require the relocation
of any people.
D. Geologic Hazards
Liquefaction is a potential hazard in the project area. However, construc-
tion of the storm drain will not affect the damage potential of this hazard,
nor will liquefaction affect the design or construction of the storm drain.
E. Flooding and Water Quality
The project will minimize the problem of flooding at peak tides and improve
the storm drainage characteristics.
No pollution is anticipated as a result of the contractor's operations. It
is anticipated that some pumping to dewater the excavations for installation
of the storm drain system will be required. Arrangements will be made with
the Orange County Sanitation District to discharge the ground water into the
sewer system.
No silting or erosion is anticipated as a result of the proposed project.
F. Noise Level
The project will neither increase nor decrease the level of noise in the area.
G. Air Resources
This project will not significantly increase or decrease the total volume of
vehicle emissions.

H. Vegetation and Animal Life
There are no known rare or endangered species of animal or plant life with-
in or adjacent to the project area.
I. Water Course
Upon completion of the project, storm water will continue to enter the Newport
Bay via the "K" Street drain outlet.
J. Long -Term Impacts
This project will have no long-term, irreversible or irretrievable effects •
on the commitments of resources in the City. The proposed project complements
the existing and on -going development in the adjacent area.
K. Short -Term Impacts
The only short-term impacts anticipated are those associated with any street
project. They are such items as noise and motorist inconvenience to through
traffic and ingress -egress to the residents adjacent to the project. These
impacts are not considered to have a significant effect on the environment.
L. Summary
The project does not appear to have a significant effect on the environment.
In fact, it would seem that the decision not to construct the project would
have a more important effect on environment, as it would sustain the poor
drainage conditions and the problem of flooding at peak tides.
