EIR NEGATIVE DECLARATION
Attached for the Committee's review and comment are
drafts of the Notice of Determination, the EIR.Negative Declare-
' tion, and the Environmental Fact Sheet for the subject improve-
ments.
The Public Works Department will supply the Committee
with any additional information which may be required to make
findings and recommendations in this matter. .
The tentative project schedule calls for construction
to start in August or September. 1977; final design is nearing
completion.

ENVIRONMENTAL REVIEW - NOTICE OF DETERMINATION
NOTICE:
• A preliminary environmental review of the proposed project to •
construct a bike trail adjacent to West Coast Highway (SR1) from Newport
Boulevard has been completed. The review was conducted in compliance
with the requirements of the California Environmental Quality Act of
1970, the State "Guidelines for Implementation of the California Environ-
mental Quality Act of 1970", and the City's "Policies and Procedures
for Implementing the California Environmental Quality Act".
As a result of the preliminary review, it has been determined that:
• 1. The project is approved.
2. The project will not have a significant effect on the environ-
ment.
3. An Environmental Impact Report has not been prepared. A
Negative Declaration has been prepared and is attached hereto.

NEGATIVE DECLARATION
BY
CITY OF NEWPORT BEACH
PUBLIC WORKS DEPARTMENT
1. Location
The proposed project is located within the corporate limits of the City of
Newport Beach.
2. Project Description
The work consistsof construction of a 6- to a -foot -wide bike trail in the
parkway area adjacent to West Coast Highway (SH1) on the northerly side from
Newport Boulevard to 59th Street and on the southerly side, a shoulder bike
lane from Balboa Boulevard to 58th Street (projected).
3. Purpose of Project
To provide a separate bicycle facility adjacent to West Coast Highway to increase
the safety of bicyclists traversing this high vehicular traveled route. .
4. Discussion of Environmental Impacts
a. Land Resources
The proposed project is, entirely located within existing public right-of-way.
b. Geologic Hazards
There are no known significant geologic hazards within the project area.
c. Secondary Consequences
There will be no long-term secondary consequences arising from the minor
short-term effects of the project.
5. Basis for. Negative Declaration .
The proposed project has been reviewed in conjunction with Sections 15051, 15082,
and 15083, Chapter 3--Guidelines for Implementation of the Californis Environ-
mental Quality Act of 1970, Division 6, Title 14, California Administrative Code.
The project is not in conflict with the environmental goals and plans of the
community; it does not have any aesthetic effect; it does not affect animal or
plant life; and it does not affect air quality, water quality, and the ambient
noise levels of the adjoining areas. Review of the criteria set forth in the
above noted sections indicates that the proposed project will not have a signi-
ficant environmental impact. A copy of the informational fact sheet is attached
for reference.

FACT SHEET
TO DETERMINE IF PROJECT HAS A SIGNIFICANT ENVIRONMENTAL EFFECT
A. PROJECT DESCRIPTION AND PURPOSE
This project will provide for the construction of an asphalt concrete bike
trail and bike lane within the subjectlimits which varies from 6 feet to 8
feet in width. The project also includes construction of portland cement concrete
sidewalk, provide a separated bike trail facility for bicyclists using West Coast
Highway. Bicyclists currently must use the highway for travel. This project
will give them a safe alternate route.
B. CONFORMANCE WITH CITY'S GENERAL PLAN
The City's Master Plan of Bikeways includes this route as a backbone bikeway and
the route is a part of the. County Plan of Arterial Bikeways.
C. LAND USE.
Existing land use adjacent to the route is vacant and residential. The project '
is all within public right-of-way of either the State of California or the City
of Newport Beach.
D. HUMAN RESOURCES
This project will not require the relocation of any persons.
E. GEOLOGIC•HAZARDS
The project lies in an area of possible ground shaking, which is not a signi-
ficant geologic hazard. Extensive grading will not be required.
F. FLOODING, EROSION AND SILTATION
Project planning calls for construction of this project during the summer •
months prior to the normal rainy season for this region. Construction during
that period should preclude the possibility of flooding, erosion and any sub-
sequent siltation of materials. The project specifications will require the
contractor to employ erosion control measures during construction to further -- •
reduce the possibility of siltation.
G. GROUNDWATER 1
The work will not require excavation which will affect the groundwater condi-
tions.
H. NOISE LEVELS
The construction of the proposed bike trail should not change the ambient noise
levels in the area since these facilities are for bicyclists. The construction
activities will create a short-term increase in noise levels.

I. AIR RESOURCES
The project will not increase or decrease the volume of vehicle emissions.
J. ARCHEOLOGICAL AND PALEONTOLOGICAL SITES
There are no known archeological or paleontological sites within the project
limits. However, should grading operations encounter significant fossils or
artifacts, construction scheduling will be altered to allow sufficient time
for investigation and recovery of funds in line with Council policy.
K. VEGETATION AND ANIMAL LIFE
There are no known rare or endangered species or habitats of such species of
animal or plant life within or adjacent to the project area.
L. WATER RESOURCES

The proposed project will not affect the water resources in the area.
M. SECONDARY CONSEQUENCES
This project will not have any secondary consequences arising front the minor
primary consequences related to the project.
N. SHORT-TERM IMPACTS
The only short-term impacts are those associated with any construction. These
are specifically noise and motorist inconvenience during construction. These
impacts are not considered to have a significant effect on the environment.

This project does not appear to have a significant effect on the environment.
