TEN YEAR MAINTENANCE DREDGING PROJECT
ENVIRONMENTAL REVIEW - NOTICE OF DETERMINATION
August 30, 1973
A preliminary environmental review of the proposed project for
the maintenance dredging of Newport Harbor in the City of New-
port Beach has been performed. The review was conducted in ac- -
cordance with the requirements of the California Environmental
Quality Act of 1970, the State "Guidelines for Implementation
of the California Environmental Quality Act of 1970", and the
City's "Policies and Procedures for Implementing the California
Environmental Quality Act".
As a result of the preliminary review it has been determined that;
1. The project is approved.
2. The project will not have a significant effect on the
environment.
3. An Environmental Impact Report has not been prepared.
A Negative Declaration has been prepared and -is attached
hereto.

ENVIRONMENT STATEMENT
NEGATIVE DECLARATION
BY
CITY OF NEWPORT BEACH
1. Location: Newport Harbor is a nagivable waterway with es- .
tablished U.•S. Army Corps of Engineers' Harbor tines
within the City of Newport Beach.
2. Project: The work consists of maintenance dredging of sand
which has sloughed (due to tidal actions, littoral,•
drift, normal boating activity, etc.) from areas ad=
jacent to bulkheads and from non-bulkheaded tidelands
between existing project lines and bulkhead lines
bayward into the Harbor. This. sand will be disposed
of by three -(3) methods:
a. placement back against the seawall, -
b. placement landward on non-bulkheaded
shores or beachesy ;
c. transported by barge and dumped. into,the-
Pacific Ocean within a 500 foot radius. of.
Latitude 33°33'00"N,-Longitude 117°55'0'0"W.
The actual maintenance dredging will be done by private
contractors hired by individual property owners under
,a permit procedure agreed upon by the City and the'U.S.
Any Corps of Engineers. -

3. Purpose of Project: The purpose of this project is as follows:
a. Raise the level of the sand adjacent to existing and
future seawalls to insure proper structural stability
of the seawalls.
b. Increase the depth -of the water under existing and
future boat slips to allow utilization of these slips
and to prevent damage to the slips and moored vessels
at low tide.
c. Retard the growth of algae, ie. enteramorpha, and the
eutrophication of the Harbor bottom.
d. Rrograde existing shoreline preventing possible
property damage.
4. Discussion of Environmental Impacts:
a. Marine Environment:. Due to the ongoing nature of the
project, assessment of the possible environmental lap;
pact of the project was accomplished by reviewing en-
vironmental reports prepared for similiar work else
where in Newport Bay. These projects are identified,
as the Coves Development, the Bayshores Marina and
the Grand Canal dredging.
These reports did not identify any significant en-
vironmental impacts resulting from the dredging work
associated with those projects. Brief mention was.
made of short term localized siltation and water dis-

coloration. It was concluded that the limited pop-
ulation of bottom dwelling organisms which would be
disturbed would be restored -within •six to nine months
after dredging.
at is felt the same conclusions are applicable to this
project. Our experiences in past maintenance dredging
projects supports this conclusion.
b. 'Water Quality: There will be some short term water
turbidity during the dredging operations. Past ex
periences in dredging has shown that the proposed hy-
draulic dredging method, with the discharge spout being
kept under water, when alternates 2a and 2b are used,
minimizes water turbidity outside of the project area..
5. Basis for Negative Declaration: This project has been reviewed
in conjunction with Sections 15081 and 15082 of the
State Guidelands. Comparison with criteria set forth
in those sections indicates that the proposed project
will not have a'significant environmental impact.' In
addition this proposal is made with cognizance of the
Federal Water Pollution Research and Sancturies Act of
1972, the Coastal Zone Management Act of 1972 and per-
tinent sections of the River and Harbor Act of 1899.

SUBJECT: APPLICATION - 10 Year Maintenance Dredging
APPLICATION
The City of Newport Beach and County of Orange Harbor, Beaches
and Parks District jointly requests that the Department of the
Army, Los Angeles District, Corps of Engineers issue a' Blanket
Maintenance Dredging Permit to the above local governmental
bodies for maintenance dredging landward of the U. S. Project
Lines. The subject permit if granted will be administered by
the City of Newport Beach and/or County of Orange Harbors, Beaches
and Parks District for maintenance dredging projects over their
respective granted tidelands.
DISCUSSION
With the current siltation occurring in Newport Harbor, it is
now recognized by both the City of Newport Beach, Marine Safety
Department, and the County of Orange, Harbors, Beaches and Parks
District that maintenance dredging must be an ongoing process to
assure safe navigation and the protection of private property.
A continuous maintenance dredging activity is necessary primarily
because of two factors. These are: 1) Siltation - resultant
from both the San Diego Creek run-off and numerous storm drain
terminus within the harbor. 2) Beach Profile Erosion or Sluff-
ing - resultant from tidal changes, normal boating activity,
wave refraction off deep water bulkheads, and littoral drift of
material from one zone to another.

Based on past maintenance dredging experience (within the Harbor
Lines) for both City and County Tidelines, the Marine Safety
Department and Orange County Harbor District estimate approxi-
mately two hundred (200) annual maintenance dredging applications.
The combined annual quantity of dredgedimaterial will average
approximately 20,000 cubic yards. This estimate is based on
calculations obtained from Shellmaker, Inc. the only dredging
company located at Newport Harbor. '

The dredged material will be disposed of at 117° 55' longitude
and 33° 33' latitude at a location beyond the 100 fathom line
or in accordance with an approved disposal site stipulated by
the Regional Water Quality Control Board and the Environmental
Protection Agency.
The attached drawings illustrate the zones within Newport Harbor
(between the U. S. Bulkhead Lines and U. S. Project Lines and
Private Waterways without Harbor Lines) where the proposed main-
tenance dredging will be an on -going process administered by an
implementation guideline. The maintenance dredging permit is
proposed to maintain existing in use navigable waterways. The
attached'Implementation Guideline' defines in greater depth the
parameters of the "Blanket Dredging Permit".

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH REQUESTING THE U.S.
ARMY CORPS OF ENGINEERS TO ISSUE AN EME -
GENCY PERMIT TO ALLOW MAINTENANCE DREDGING.
IN DOVER SHORES
WHEREAS, the Dover Shores waterways have silted up
making the operation of boats in the channels extremely dan-
gerous and in some instances impossible; and
WHEREAS, this situation has created a serious need
to perform maintenance dredging in and around the areasoc-
cupied by the pier or float installations; and
WHEREAS, the Newport Beach Marine Safety Department
has been advised that any dredging activities in navigable
waters will require a permit from, the U. S. Army Corps of
Engineers; and
WHEREAS, because of the many review procedures by
various Federal, State, and local agencies that must occur
before a dredging permit will be issued, it may be many months
before the necessary permit to dredge the Dover Shores water-
ways may be obtained; and
WHEREAS, the City Council finds that an emergency
situation currently exists as a result of the siltation in the
Dover Shores waterways which emergency must be corrected im-
mediately in order to protect the health, safety, and general
welfare of the citizens living in this area.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby respectfully requests the
U. S. Army Corps of Engineer to issue an interim emergency
permit to allow maintenance dredging toothe original designed
depths in the Dover Shores waterways.
BE IT FURTHER RESOLVED that the City Council of the
City of Newport Beach requests that the U. S. Army Corps of

Engineers issue a blanket dredging permit for t.'.c existing
approved waterways, landward of the Federal project lines,
to be accompanied by justifying documents and P_ccedural outlines
which will be provided' in a coordinated effort with tne Harbors,
Beaches, and Parks District for the County.of Orange.

COMPENDIUM
With the current siltation occurring in the Newport Harbor, it is now
recognized by the local governing agencies that maintenance dredging must
be an ongoing process, if navigation is to continue. The City of Newport
Beach and the County of Orange, Harbors, Beaches, & Parks District if
issued a conditional "Blanket Maintenance Dredging Permit" will administer
same as defined in the preceding. text. To honestly administer such a per-

mit, the City and County are agreed that the subject permit should be
immediately revoked by the U. S. Army Corps should the conditions stated
in the following "TEXT" not be complied with.
PREFACE
A) The maintenance dredging permit is limited to include only those
tidelands between existing project lines and bulkhead lines which are
already developed for the safe navigation of boats. Also, it is limited
to navigable waterways constructed upon private lands which now have
piers, slips, and other floats already constructed and in use.
t) This permit does not extend to any undeveloped tidelands, nor to
any additional projects, within already developed navigable zones, wherein
new construction would alter existing use of these navigable zones.
C) The permit is presented to prevent grounding of vessels either while
underway, or while moored at docks, in only those tidelands which have
been approved for navigation and previously dredged for navigable use within
the limits described by (A).
d) Within the Newport Harbor there are approximately 1,200 privately owned
piers and slips, by homeowners, and approximately 200 commercial piers and
floats. The City and Harbor District anticipates approximately 200 main-
tenance dredging applications (of less than 100 cubic yards each) which will.

be processed annually according to the following procedures:
TEXT
"The U. S. Army Corps of Engineers, Los Angeles District, conditionally
authorizes the City of Newport Beach and County of Orange, Harbors, Beaches
and Parks District to approve or disapprove, maintenance dredging within
Newport Harbor on City and County granted tidelands respectively.
APPLICATION PROCEDURE:
A) 200 Cubic Yards, or Less:
1. The dredging contractor submit's a standard harbor permit applica-
tion to the Newport Beach Marine Safety Department (in duplicate if County
Tidelands are involved) including drawings. The complete permit applica-
tion will show:
a. The location of the project
b. The current situation
c. The amount of material to be removed
d. The dredging's effect upon the design -profile within the
immediate zone.
e. The dredging's effect upon the stability of contiguous
bulkheading.
f. The disposal location of spoil, and method.
g. A signed guarantee that the dredging will not occur because
of any altering of existing use of the affected zone.
The City Council and/or County of Orange, Harbors, Beaches and Parks District
dependent on local agencies jurisdiction may then either approve commencement
of work, or disapprove. If approval is granted, the permit copies will be
immediately forwarded to the Los Angeles offices of the U. S. Army Corps
of Engineers for their review, information, and option to inspect the opera-
tion. Further, upon receipt of the permit copies, the Corps of Engineers
may notify any other interested agency who may wish to inspect the project.

If, for any reason, the Corps of Engineers disapproves the project, the
work will be immediately halted by the City of Newport Beach, Marine
Safety Department and/or the County of Orange, Harbors, Beaches and Parks
District.
B) 1,500 Cubic yards, or less, on Navigable Waterways wherein Federal
Harbor Lines have not been established. I
1. The dredging contractor submits a standard harbor permit applica-
tion to the City of Newport Beach, Marine Safety Department, including
drawings. The permit application will show:
a. The location of the project.
b. The current situation (including proof that the existing depth
is at least 3 feet less than the design depth)
c. The amount of material to be removed.
d. The dredging's effect upon the design profile within the
immediate zone.
e. The dredging's effect upon the stability of contiguous bulk -
heading.
f. The disposal location of spoil.
g. A signed guarantee that the dredging will not occur because
of any altering of existing use of the effected zone.
h. Approval by the local community association, if applicable.
The City Council may then either approve, or disapprove, commencement of
work after the following procedure is completed:
a. Approval by the Public Works Director, Community Develop-
ment Director, and Marine Safety Director, under the direct-
ion of the City Manager.
b. Approval by the Orange County Harbor Commission.

to the Los Angeles offices of the U. S. Army Corps of Engineers for their
review, information, and option to inspect the operation. Further, upon
receipt of the permit copies, the Corps of Engineers may notify any other

the Corps of Engineers, disapproves the project, the work will be immed-
iately halted by the City of Newport Beach Marine Safety Department.
It is understood by the City of Newport Beach-4nd County of Orange Harbors,
Beaches, & Parks District that this entire dredging permit system is revo-
cable, at will, by the U. S. Army Corps of Engineers".

This proposal is made with cognizance of the Federal Water Pollution
Control Act Amendments of 1972, the Marine Protection Research and
Sanctuaries Act of 1972, the Coastal Zone Management Act of 1972, and
pertaining sections of the River and Harbor Act of 1899.
