The Public Works Department will supply the Committee with any additional information which may be required to make findings and recommendations in this matter. The tentative project schedule calls for construction to start in May 1977; final design is nearing completion. seph Tj blic W :jd Att. vlin 's Director CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT REFURBISHING OF EXISTING CONCESSION STAND ON THE NEWPORT OCEAN PIER ENVIRONMENTAL REVIEW•- NOTICE OF DETERMINATION NOTICE: A preliminary environmental review of the proposed project to refurbish the existing concession stand on the Newport Ocean Pier has been completed. The review was conducted in compliance with the requirements of the California Environmental Quality Act of 1970, the State "Guidelines for Implementation of the California Environmental Quality Act of 1970", and the City's "Policies and Procedures for Implementing the California Environmental Quality Act." As a result of the preliminary review, it has been determined that: 1. The project is approved. 2. The project will not have a significant effect on the environment. 3. An Environmental Impact Report has not been prepared. A Negative Declaration has been prepared and is at- tached hereto. Joseph T. THE NEWPORT OCEAN PIER APRIL 1977 I. LOCATION The existing Newport Ocean Pier is located at the southerly end of McFadden Place in the City of Newport Beach, California. The pier extends approximately 1000 feet southerly into the Pacific Ocean. The concession stand is located at the southerly end of the pier. The building is a wood frame,one-story sturcture with an unenclosed observa- tion deck on the roof. The floor area of the building is approximately 730 square feet. The area surrounding three sides of the pier is ocean. At the north end of the pier is the McFadden Place and Ocean Front business district, a public beach, and a public parking lot. Immediately adjacent -to the north end of the pier are the Newport Beach Marine Safety Department (Lifeguards), public restrooms, and the Newport Dory Fishing Fleet. II. DESCRIPTION OF PROJECT The project will consist of painting the exterior of the building, repairing the roof, installing new panelling, partitions, counters, fixtures; replacing a live bait tank; and replacing the sewage holding tank. The estimated cost of the refurbishing is $17,000. All work is designed to harmonize with the recreational uses made of the pier. The pier is used primarily by recreational fishermen and tourists. The activities conducted in the concession stand consist of selling bait, tackle, and•snacks; plus renting of fishing tackle. The activities are a - continuation of activities that have been carried on at the concession stand for.many years. III PURPOSE OF THE PROJECT The existing building is structurally sound, but needs to be cleaned up and repaired. IV. DISCUSSION OF ENVIRONMENTAL IMPACT A. Land Resources This project will not require the use of any additional land area. • • B. Human Resources There will be no effects on human resources caused by the project since the work is the addition of a second story to an existing building, and no relocation of residences will be made. C. Air Resources This project will not increase'or decrease the total volume of vehicle emissions in this•air quality region. Dust control procedures will be required during construction by the, project specifications. D. Geologic Hazards There are no known significant geologic hazards within the area encom- passed by the project. Grading will not be required. E. Flooding, Erosion, and Siltation Project planning calls for construction of this project to occur during the spring and summer, prior to the normal rainy season in this area. Construction at that time should preclude the possibility of flooding, erosion, and any subsequent siltation of Newport Bay. F. Groundwater • There are no known aquifers in the area of the project. The nature of the construction is such that contamination or blockage of aquifers will not occur. G. Noise Level Remodeling of the building should not substantially alter the ambient noise levels for the surrounding area. During remodeling, noise levels may rise due to operations which are necessary to construct the project; however, these operations will be limited as to working hours:to create the minimum of disturbance to the public using the pier; and the operations will cease upon completion of the project. H. Vegetation and Animal Life There are no known rare or endangered species or habitats of such species of animal or plant life within or adjacent to the project area. I. Short -Term Impacts • The only short-term impacts anticipated are those associated with any similar remodeling project. They are such items as noise during con- struction. These impacts are not considered to have a significant effect on the environment. 2 J. Summary The project does not appear to have a significant effect on the environment. V. BASIS FOR NEGATIVE DECLARATION The proposed project has been reviewed in conjunction with Sections 15081 • and 15082 of Article 7, Chapter 3 (Guidelines for Implementation of the California Environmental Quality Act of 1970), Title 14, Division 6 of the California Administrative Code. Comparison with the criteria set forth in the above sections indicates that the proposed project will not have a significant environmental impact.
