Attached for the Committee's review and comment are drafts
of the Notice of Determination, the E.I.R. Negative Declaration and
the Environmental Fact Sheet for the subject improvements.
The Public Works Department will supply the Committee with
any additional information which may be required to make findings and
recommendations in this matter.

WEST NEWPORT PARK BASKETBALL COURT
ENVIRONMENTAL REVIEW --NOTICE OF DETERMINATION
A preliminary environmental review of the project for the con-
struction of the West Newport Park Basketball Courts between Pacific
Coast Highway and Seashore Drive approximately 100 feet westerly of
59th Street has been performed. The review was conducted in accor-
dance with the requirements of the California Environmental Quality
Act of 1970, the State "Guidelines for Implementation of the California
Environmental Quality Act of 1970," and the City's "Policies and
Procedures for Implementing the California Environmental Quality Act."
The environmental statement has been reviewed and was approved by
the City's Environmental Affairs Committee.
As a result of the preliminary review, it has been determined
that:
1. The project is approved.
2. Theyproject will not have a significant effect on the
environment.
3.
An environmental impact report has not been prepared. A
negative declaration has been prepared and is attached
hereto.

NEGATIVE DECLARATION
BY
CITY OF NEWPORT BEACH
PUBLIC WORKS DEPARTMENT
1. PROJECT LOCATION: The basketball courts construction will occur in an
undeveloped sand area between Pacific Coast Highway and Seashore Drive
approximately 100 feet westerly of 59th Street in the City of Newport
Beach.
2. PROJECT DESCRIPTION: An 84-foot by 52-foot sand area will be cleared
of vegetation, compacted and paved with portland cement concrete. Steel
basketball standards and backboards will be installed, and the court
will be striped for basketball games.
3. PROJECT GOALS: The project will provide a portion of the need for acti-ve
sports recreation facilities in West Newport Park.
4. EFFECT ON THE ENVIRONMENT: There will be no significant long-term irrevers-
ible or irretrievable effects on the environment. There will be minimal,
acceptable short-term disturbances of the environment due to construction
activity.
5. BASIS FOR NEGATIVE DECLARATION: This project is consistent with the General
Plan Policies of the,City of Newport Beach and could not have a significant
effect on the environment.
6. INITIAL STUDY: The City of Newport Beach Public Works Department has
prepared this Negative Declaration and its Initial Study in accordance with
Article 7, Chapter 3, Guidelines for Implementation of the California Environ-
mental Quality Act of 1970. Copies of the Initial Study may be obtained from
said department during normal business hours.

INITIAL STUDY

A. CONFORMANCE WITH THE GENERAL PLAN
This project is in accord with the General Plan Policies of the City of Newport
Beach, in particular the "Land Use Element" and the "Recreation and Open Space
Element."
B. ENVIRONMENTAL CHECKLIST FORM
An Environmental Checklist Form has been completed and is attached hereto. The
following statements, referenced to questions presented on the checklist, ex-
plain all "yes" and "maybe" answers:
II.I.b. & c. An 84-foot by 52-foot unimproved sand area will be compacted
and paved with portland cement concrete; Steel basketball
standards and backboards will be installed, and the court
will be striped as necessary for basketball games.
II.3.b. The basketball court paving will prohibit absorption and increase
surface runoff. Basketball court surface runoff will be absorbed
by the adjacent sand areas.
II.6.a Sports activity on the proposed basketball area may increase
existing noise levels in the area. Any increase in noise may
be atticipated during daylight hours only since the court will
not be lighted for nighttime use.
II.8 Present undeveloped sand area land use will be altered into its
planned land use, i.e., as a•neighborhood park facility.
II.14.d.& e. Proposed basketball courts will help satisfy the need for active
sports recreational facilities in West Newport Beach; however,
the courts will require periodic cleaning, restriping and repair
by City maintenance forces.
II.19 Proposed basketball courts will help satisfy the need for active
sports recreation facilities in West Newport Beach.
