HomeMy WebLinkAboutF-5 - Correspondence - Request of Lido Park HomeownersCOUNCIL AGENDA NO./' "-5`4) CITY OF NEWPORT BEACH OFFICE OF THE CITY MANAGER September 22, 1986 TO: MAYOR AND CITY COUNCIL FROM: City Manager SUBJECT: REQUEST OF LIDO PARK HOMEOWNERS TO ESTABLISH A MOBILE HOME PARK OVERLAY ZONE On September 10, 1986, the City received a letter from a representative of the Lido Park Mobile Homeowners Association requesting immediate considera- tion for placing the Mobile Park Overlay Zone on the Lido Park Mobile Home area. Attached, is a copy of this request. Inasmuch as a similar request had been con- sidered on July 11, 1983, and on October 9, 1984, (copy of minutes attached) the subject request is being placed on the Consent Calendar for information and filing. Actual- ly, on July 11, 1983, the Council, constituting the same members that currently exist, formally voted not to initiate an Overlay Zone on the Lido Park property. If members of the City Council have changed their opinion and wish to establish an Overlay Zone, the item should be removed from the Consent Calendar. ROBERT L. They are reouesting immediate consideration of their second reouest for the granting of a Mobile Home Park Overlay Gone. The critical need for this overlay is based on the following considerations: 1. An overlay would give the Park homeowners the assurance of a fair hearing with the City govern- ment if a major change in the Park is proposed by the owners. 2. The current Lido Park lease is structured to allow the owner of the Park to close it at any time arbitrarily chosen by him. 3. An overlay would help homeowners seek relief from the present blanket refusal of lending institutions to finance purchase of homes in the Park caused by the unreasonable aspects of the current leases. 4. rbitrary closin of the :'ark would cause extreme hardship to the majority of homeowners. In many cases ownership of their home constitutes a major financial investment which can not be recouped. 5. Closing of the Park would be highly detrimental to senior citizens whose sec _city lies within this community. 6. The present rent increases of 9% compounded; annually, specified for the duration of the lease, is unreasonable, works particular hardship on the elderly on fixed incomes and should be brought into line with the Cost of Living Index applied by the City to their park on the Balboa Peninsula. 7. Also, an overlay could feasibly slow the program of increasing rental costs and decreasing property values being perpetuated by the Park owner wherein home owners do not have a fair opportunity to represent their interests. The overlay would provide a forum for this purpose. 8. 7 precedent has been established by the granting of overlays to other comparable parks in the city. 9. P.n overlay would provide for the continuance of additional reasonably affordable mobile home living within the Newport Beach City limits. The granting of an Overlay would further the expressed intent of the City in Chapter 20:20 of the Ordinances of the City of Newport Beach which states, "...The purpose of the mobile home park zone is to designate existing mobile home parks in appropriate locations for mobile home park uses in order that these uses may be encouraged, maintained, and protected. The regulations of this district are designed to achieve an environment of stable, desireable residential character and preserve areas or communities developed with mobile home residential uses." We feel that the current publicly documented lease was forced on the homeowners. The lease has been extremely detrimental to the homeowners' interests. A Mobile Home Zone Overlay we feel is the best mitigating alternative to the Park operators' unilateral, unconstitutional practices. The councils' consideration of the homeowners request for a Zone Overlay for the Lido Mobile Home Park would be deeply appreciated. Also, the extent to which this matter could be placed as early as possible on the evenings' agenda of September 22, 1986, would be helpful due to the fact that many of the concerned Park homeowners are senior citizens and this would be important to them.
