SUBJECT: OVERLAY ZONE -LIDO MOBILE HOME PARK
By letter dated March 23, 1983, (copy attached) the
Lido Park Homeowners Association requested the establishment
of the Mobile Home Park Overlay Zone. On April 11th the City
Council considered the request, and instead of referring it to
the Planning Commission for the initiation of the hearing
process, requested the City Manager to obtain more information
from the Homeowners Association. On April 12, 1983, (copy at-
tached) I wrote a letter to the Homeowners Association request-
ing the additional information. I indicated to the Association
that their request would be placed on the evening agenda for
May 9th if the response was received in time. The response
was not received until June 30, 1983, (copy attached) and is,
therefore, being placed on this agenda for consideration and
action by the City Council.
In the interim I received a letter from Mr. John L.
Curci, the property owner, requesting that he would like to
meet and review the data from the Homeowners Association. This
letter is dated April 26, 1983, and is attached hereto.
The City Council has received in the past, several
requests to establish a Mobile Home Park Zone Overlay. On
May 10, 1982, the City Council declined to initiate the Mobile
Home Park Overlay Zone on the City-owned Marina Mobile Home
Park. On July 26, 1982, the City Council directed the Planning
Commission to institute the hearing process required to
impose the Mobile Home Park Overlay Zone on the De Anza
Mobile Home Park. Both the Planning Commission and the City
Council have approved of the Overlay Zone on the De Anza Mobile
Home Park. During the hearing process for the De Anza Mobile
Home Park, however, the lessee became actively involved in the
process.
Inasmuch as the City has received a request from Mr.
Curci to meet on this subject prior to the implementation of
the Overlay Zone, it may be desirable to grant this request
before referring it to the Planning Commission for action. It,
therefore, appears that the City Council has two alternatives.

The first is to request the Planning Commission to
initiate a Mobile Home .Park Overlay Zone on the Lido Park
pro p erty with the understanding that the property owner will
be duly notified and will be able to participate in the pro-
ceedings.
The second alternative is to refer the subject
matter to the Planning Department for the initiation of meet-
ings between representatives of the Association and the prop-
erty owner to determine if the issue can be resolved before
imposing the Overlay Zone.
