G-1 TO: CITY COUNCIL FROM : Public Works Department SUBJECT : ACQUISITION OF 202 29TH STREET FOR THE WIDENING OF BALBOA BOULEVARD RECOMMENDATIONS: 1 . Authorize the staff to retain an appraiser to determine the fair market value of 202 39th Street: 2. Autho r ize the purchase of 202 39th Street at the appraised fair market value , subject to the approval of an environ- mental impact statement for the widening of Balboa Boulevard from 38th Street to 42nd Street. DISCUSSION : The Council has directed the Community Development Department to have substandard conditions corrected at 202 39th Street. The property owner, Helen W. Mauldin, has been given a notice to repair or demolish the building. In response, Ms. Mauldin has requested that a 120-day extension be granted and that the City purchase the property. A copy of a letter from the property owners is attached for reference. This parcel is one needed for the proposed widening of Balboa Boulevard. County AHFP funds can be used to fund 50% of this purchase if an acceptable environmental impact statement is approved for the widening of Balboa Boulevard in thi s area . On June 1 , 1972, the Planning Commission approved an environmental impact statement for the widening of Balboa Boulevard from Coast Highway to 42nd Street . A supplemental report covering the area between 42nd Street and 38th Street would have to be prepared and approved prior to the use of AHFP funds for this pur- chase ·. Funds are currently budgeted in the Gas Tax Fund and Gas Tax Contribu- tions Fund (AHFP contribution) for the purchase of property on a hardship basis for the widening of Balboa Boulevard. 202 39th Street was constructed by M·s . Mauldin's grandfather about 60 years ago . The Mauldin's feel that they will hav e to sell this parcel because they are unable to make the major structural modific a tions necessary to bring the building up to current day standards. If the City purchases the property, the tenants will become eligible for re l ocation assistance of up to $4500. We have received notification of substandard conditions concerning our property located at 202 39th St., Newport Beach. The notification letter from your department states that repair shall commence w&thin 15 days of notification, or the structure vacated and damolished within 30 days to avoid legal action by the City of Newport. The cabin was constructed approximately 60 yeavs ago ubder building re~ulations then in force by my wife's grandfather, and has been owned by the family since that date. vfo readily admit that by today's standards, the bmilding and facilities are sub- marginal and should be improved or demolished. We have considered the cost of updating and/or demolition and replacement with a modern income unit, and have decided that we would prefer to sell the property in it's present state. The building is presently on a monthly rental pending arrangements to sell. The fact th ht the tenant is apparently using a loft area over the garage for living l{Uarters will be corrected by notification irnmediatelyo We requewt that major structural modifications be deferred for a period of at least 120 days to allow us sufficient time to arrange for an equitable sale. Per our telephone conversation of Sept. 14, 19?3, you seem to feel that such an arrangement can be reached and stated that you were quite sure that this will be satisfactory provided that the escrow terms provide for correction at the time of closure. I also mentioned the possibility of the City of Newport Beach acquiring the property in the near future, and you stated that you would refer the matter to Jim Webb upon receipt of formal request from µs. Please consider this letter as a formal request to defer action for 120 days minimum, and also as a formal request for the City of Newport Beach to negotiate for the property at this time .
