TO: MAYOR AND CITY COUNCIL FROM: City Manager SUBJECT: ADJUSTMENT OF MEAN HIGH TIDE LINE RECOMMENDATION: That the Council authorize the introduction of a State bill adjust- ing the mean high tide line as described herein. DISCUSSION: On March 22 the City Attorney and I met with Mr. James F. Trout, District Manager of the State Lands program of the State Lands Division, and a representative of the Attorney General's office. It was called to every- one's attention that the adjudicated mean high tide line in Beacon Bay had been established in 1928. Since that period permanent residential structures have been constructed on a portion of the tidelands. This portion is illus- trated as Section "A" on the attached map. Inasmuch as permanent residential use is not an authorized tidelands use, it was suggested that the mean high tide line be modified to remove as tidelands the two parcels shown in Section "A" in exchange for the parcel shown as Section "B". Section "B" contains the Balboa Marina and such uses as storage garages, slip rentals, restaurant, marine hardware store, boat yard, yacht brokerage, parking and similar uses. It is obvious that Section "B" complies with the granted tidelands uses. As a result, Section "A" will become uplands and Section "B" will become tide- lands. The leases currently in effect by J. A. Beek, et al., would not be affected by the proposed modification. The State would grant to the City a tidelands grant for that new parcel shown as Section "B". Inasmuch as the two sections are in the immediate area and are relatively small, the modifi- cation is considered routine and will be supported by both the Division of State Lands and the Attorney General's office. These two offices consider the proposal as a "housekeeping" change. Homeowners association and lessees of the subject property have been contacted and they concur in the proposed solution. It appears, therefore, that all parties involved support the modification. A recent exchange was just accomplished in Alamitos Bay area with the City of Long Beach and is nearly identical to that proposed herein. RLW:mm ROBERT L. WYNN Attachment
