DISCUSSION: Study Session Aqenda Item No. 6 Attached you will find a copy of a letter from the State Division of . Highways concerning the City's inquiry about leasing certain property from the State on Cliff Drive. As a result of this letter the City is preparing a formal application. If this application can be prepared in time for Monday's agenda, it wi 11 be presented to the City Council . With respect to the adjacent property, Mr. Arthofer has been contacted and a number of meetings have occurred concerning the City's acquisition of the private property. Mr. Arthofer was to have prepared a written offer to the City, but this written offer has not been received. Basically, this offer involves the sale of the former City dump site property and the proceeds being used to acquire the private property on Cliff Drive. The City has requested "wind shield" appraisals for the Cliff Drive property and, hopefully, these appraisals can be received by Monday, February 28. Following receipt of the written proposal from Mr. Arthofer and the "wind shield" appraisals, further meetings will occur with Mr. Arthofer . Additional data can be given during the study session on February 28 . Wynn City Manager City of Newport Beach 3300 Newport Boulevard Newport Beach, California 92660 Dear Mr. Wynn: ORA-1-18.6 Parcel 40468 RONALD REAGAN, Governor Thank you for your letter of January 12, 1972 expressing your desire to acquire the above referenced parcel for view park purposeso It would appear that the California Highway Commis- sion would not approve a lease under Section 104.15 of the Streets and High~a ys Code for the City's use of said parcel for park purposes due to the higher market value of the pro- perty and because there are improvements located on the pro- perty. Final approval would be made by the California Highway Commission based on a formal application from the City sub- mitting detailed plans for the proposed park. To answer your specific questions: (1) (2) (3) We have not established a price for this parcel and said price would be established after an appraisal of market value is made. Under the criteria used by the Commission in accordance with Section 104.15 of the Streets and Highways Code, it would appear this property would not qualify on a lease basis at the term of $100 per year. · If your detailed proposal included the removal of existing buildings and this proposal was accepted by the Commission then the buildings could be removed. While leasing said parcel under Section 104.15 of the Streets and Highways Code does not appear to be feasible, we would be happy to process your formal application. We also would cooperate with your City for a direct sale based on the market value of the property~ when and if this property is released for sale.
