HEARING ITEMS SUBJECT: MINUTES of the regular meeting of December 4, 2008. ITEM NO. 1 Motion was made by Commissioner Hawkins and seconded by Approved Commissioner Unsworth to approve the minutes as corrected. Ayes: Eaton, Unsworth, Hawkins and Peotter Noes: None Abstain: Toerge and Hillgren Excused: McDaniel OBJECT: Avis (PA2008 -124) ITEM NO.2 4200 Campus Drive PA2008 -924 A Code Amendment to revise the Districting Map by applying the Interim Recommended Study (IS) Overlay District to the Administrative, Professional, Financial (APF) for approval District on the subject property. A Use Permit to allow the operation of a vehicle rental facility as sole use of the subject property. NEWPORT BEACH PLANNING COMMISSION MINUTES Melinda Whelan gave an overview of the staff report and distributed a memorandum to delete Condition Nos. 11 and 28 and Condition No. 9 revised to ensure that landscaping is consistent throughout the property and Condition No. 12 revised to allow flexibility for the use of the shuttle bus. Carol McDermott of Government Solutions, representing the Avis Budget Group, noted this application is consistent with the General Plan intent to support airport uses; and, landscaping will be provided for adjoining properties at staffs request. At Commission inquiry, she noted that they accept the revised conditions. Commissioner Unsworth asked about the chain link fence on Birch Street by the service area. Mr. Andrew Jaksich of Avis answered that entrance /exit is used periodically for truck deliveries to the site. Public comment was opened. Public comment was closed. Commissioner Hillgren asked about the use of the site related to car - washing and water treatment. Ms. Whelan answered the proposed rental facility will not have a car wash area, but there is a condition for a WQMP (Water Quality Management Plan) that will be reviewed by the Building Department at the time of building plan checks. The existing Avis service site will be performing this car wash service. Mr. Lepo added the Code Enforcement Division performs annual inspections for existing facilities so the existing facility at Avis is routinely inspected for compliance. Commissioner Hawkins asked about Condition No. 11 as it restricts an hourly and daily use. Mr. Tony Brine answered those were conditions that were brought to staff by the applicant's peak hours and days. Ms. McDermott noted that they were asked to be specific in their application and reflect their current operations. To the extent the Commission was to allow greater flexibility, that would be preferable. Chairperson Peotter asked staff if this operation shall be subject to review Engineer should problems arise? He then asked the applicant for clarification on the shuttle use. Public comment was opened. Ms. McDermott noted they accept that date reference. Also, the business plan is to accommodate the clients at the airport. The current projection is to use the shuttle operation no more than five days a week. Chairperson Peotter asked about and was answered: • Condition No. 12 - This condition addresses if this equipment was proposed to be changed at the time of the plan check. • Condition No. 23 — This is for the accommodation of other commercial tenants in the area. • Condition No. 24 — This condition is a standard condition that needs to be maintained for future use. • Condition No. 28 — This condition does not refer to vehicles but any other storage that would be affiliated with this use. • Condition No. 35 — This condition is a standard condition. Public comment was closed. Motion was made by Commissioner Hillgren and seconded by Commissioner McDaniel to recommend that the City Council approve CA2008 -002 and UP2008 -044 with modifications to: Condition No. 12 — Use of the customer shuttle bus shall operate between the Avis on- airport facility location and the Avis vehicle rental facility at 4200 Campus Drive only. Subject to approval of the City Traffic Engineer the shuttle bus shall be encouraged to operate during airport peak hour periods. Commissioner Hawkins noted this does not give staff any regulatory framework. He suggested the shuttle operation be expanded and suggested the following amendment to the motion: • Condition Nos. 7, 8 and 9 insert the date of 11/17/2008 on the plans. The maker of the motion agreed to this amendment. • Condition No. 11 to read, Use of the customer shuttle bus shall operate between the Avis on- airport facility location and the Avis vehicle rental facility at 4200 Campus Drive only. Subject to the approval of the Traffic Engineer the shuttle bus shall be permitted to operate no more than six days per week. The maker of the motion noted it is appropriate to encourage opportunities for shuttle whenever possible and it should be subject to the review and approval of the traffic engineer. Page 3 of 5 NEWPORT BEACH PLANNING COMMISSION MINUTES 01/08/2009 shuttle bus shall be encouraged to operate no more than six days per week. This operation shall be subject to the review and approval of the Traffic Engineer. Staff noted that the original submittal referenced peak periods of Monday and Tuesday and that is what we were focusing on. If the applicant wants to have an ability to operate other days, a defined plan should be submitted. Commissioner Unsworth suggested an edit to Finding 2 in the Use Permit resolution. Add the following language, by reducing vehicular traffic between the Avis Service Facility and the airport facility. The maker and second of the motion agreed to this edit. Commissioner Hawkins then suggested the following to Condition No. 11. The last sentence would be, Subject to review and approval of the Traffic Engineer, the applicant shall submit a revised shuttle transportation plan including shuttle operations not more than six days per week prior to operation. The maker and second of the motion agreed to this edit. Public comment was opened. Ms. McDermott noted they agree to these changes. Public comment was closed. Chairman Peotter noted the motion stands with the added language reducing traffic on the roadways in Finding 2 of the Use Permit Resolution; modifying Condition Nos. 7, 8, and 9 by adding date; Condition 11 clarified to read, "Use of the customer shuttle bus shall operate between the Avis on- airport facility location and the Avis vehicle rental facility at 4200 Campus Drive only. The operator shall be encouraged to use the shuttle bus in its operations. Subject to review and approval of the Traffic Engineer, the applicant shall submit a revised shuttle transportation plan including shuttle operations no more than six days per week prior to operation." Planning Commission reports. — Commissioner Hawkins noted EDC had an Executive Committee meeting and there is a proposal to form a new citizens' Page 4 of 5 NEWPORT BEACH PLANNING COMMISSION MINUTES 01/08/2009 advisory committee for the Council in connection with special events. This committee would be comprised of marketing professionals. Commissioner Eaton noted the General Plan Implementation Committee met and there was approval to separate the Coastal Plan Implementation from the Zoning. The Zone Code will move forward. Commissioner Toerge noted the Green Building Task Force met and they are working on incentive programs to encourage people to build environmentally friendly and there is a public outreach component being formulated to inform the public. Announcements on matters that Commission members would like placed on a future agenda for discussion, action, or report — none. Staff noted there is no meeting scheduled for January 22n° due to lack of business.
