Olsen (White Horse Inn) Newport Beach Owner: Richard Ervin, Newport Beach Planning Director Wilson advised the Commissio that in addition to this use permit which allows live entertainment in conjunction with a restaurant, Use Permit No. 1419 which permit • dancing at this same location will expire on February 20, 1970, therefore staff recommends that this request be continued until February 19, 1970 in order that both matters may be considered concurrently. Mr. George D. Roberts,..attorney, represented the applicant and stated that his client had no objection to the continuation of the exten- sion request; however both Mr. Olsen and Mr. Roberts were under the impression that the closing hour for the restaurant had been estab- lished as 2:00 A.M. and consequently the res- taurant has been remaining.open until that hour. If Mr. Olsen were required to close at 12:00 midnight until February 19, 1970 it would create an undue hardship since about. 40% of his business takes place between the hours of 12:00 midnight and 1:30 A.M., therefo e unless the Commission will allow the continua- tion of the operation until 2:00 A.M. until the next hearing date, the applicant would prefer to have the matter considered immediately. City Attorney Seymour advised the Commission that if, after the records have been researche , the closing time stipulated by the Commission was 12:00 midnight and the applicant wishes to request a 2:00 A.M. closing hour, it_would necessitate a notice of public hearing and Page 2. APPROVED Location: Portion of Block 94 of Irvine's Subdivision located at 1100 East Coast Highway, north side of East Coast Highway easterly of Jamboree Road. • Zone: Unclassified Applicant: Boat Island, Inc., Newport Beach Owner: The Irvine Company, Newport Beach Mr. Leason Pomeroy, architect, represented the applicant. The Commission was presented with an "access and setback plan" map prepared by the Irvine Company showing a frontage road extending from the easterly corner of the subject property to Amling's nursery. There was a great deal of discussion regarding access to the property, curbs and sidewalks, lighting, major boat repair, signing and lands- caping. Mr. James E. Taylor of the Irvine Company stated; that if the frontage road is constructed, there would be no further need for a pedestrian side- walk across the front of the property. City Engineer Nolan stated that he had just learned about the frontage road concept; however the need for a sidewalk is also related to the development of the properties to the east. If these properties are developed, it is his opinion that there is need for a sidewalk. After further discussion, the application was Page 4. Item 8. VARIANCE Request to permit a reduction of the required parking spaces from 69 to 52, or to allow the NO. 982 additional 17 spaces required to be borrowed APPROVED from a common parking area. Location: Portion of Block 93 of Irvine's Subdivision located in the 300 Block of Newport Center at 1367 Avocado Avenue, south of San Miguel Drive on the west side of proposed Avocado Avenue. Zone: C -O -H Applicant: Milo Health Club - Rolly Pulaski Owner: The Irvine Company, Newport Beach Mr. John Bazacas, the owner of the Milo Health • Club was present and explained that originally the intent was to build only a men's club which required.52 parking spaces, which have been allotted; however, in the meantime, it was decided to include facilities for women, Page 6. Mr. Taylor of the Irvine Company stated that there are 275 parking spaces in the 300 Block of Irvine Center, most of which is occupied by office space, therefore after 5 o'clock, when the bulk of Mr. Bazacas' operation takes place the 17 additional spaces he requires would be available and they could have the same type of agreement as they have with Edwards Theatre. Chairman Jakosky stated that while he was not suggesting this as a condition of this particu- lar variance, he believed the time had come when the City should be advised of the status of the number of parking spaces and the uses between the various occupancies. Mr. Taylor said he believed that this type of agreement had been in the mill with former Assistant City Attorney Woodruff and that some type of an exhibit would be worked out on a large map which would indicate very quickly the number of • spaces being used in a certain block. Assistant City Attorney O'Neil stated that he was working on this with Mr. Woodruff. In answer to a question as to why the City's parking requirements should.not be enforced, Mr. Taylor responded that there are certain uses which because of the unique nature or time of their operation can be permitted to.operate without meeting the exact provisions of the parking ordinance. Asked about the overall parking situation in Newport Center, Mr. Taylor pointed out that parking facilities were being built in stages. After further lengthy discussion, the applica- Motion x tion was approved subject to the City receiving Second x an adequate parking agreement. AMENDMENT TO USE PERMI N0. 1285 APPROVED Request to add 37 psychiatric beds to an exist ing hospital unit (North Unit of Hoag Memorial Hospital). Location: Portion of Lot 169, Block 2, of Irvine's Subdivision, located, at 393 Hospital Road, north side of Hospital Road between Newport Boulevard and Placentia Avenue. Zone: R -3 and C -O -H Applicant: Hoag Memorial Hospital- Pr.esbyteri n Newport Beach Owner: Central Newport Healthcare Corp. % Mission Convalescent Hospital San Gabriel, California Associate Planner Nuzum explained the applica- tion and parking in relation to the existing facilities. Assistant Planner Gunn pointed out the following adverse conditions existing along Newport Boulevard and Hospital Road in connection with this application: 1. Equipment located at the northeast corner of the building is exposed to public view along Newport Boulevard. The equipment.is enclosed by a chain link fence: 2. A 10" storm drain pipe at the north- east corner of the building runs above ground down the slope to an existing drain and presents a very ugly appearance from Newport Boule- vard. This was not shown on the plot plan at the time the use permit was.ac.ted upon.by.the Planning.Commis- sion. 3. A pile of excess earth material has been allowed to remain near the corner of Hospital Road and Newport Boulevard. • 4. The existing grading pattern along the property line adjacent to Newport Boulevard is not a desirable condi- tion. At present the grade slopes Page 8. CITY OF NEWPORT BEACH lanuary 15. 1970 COMMISSIONERS a V11\01Z)1r_1�1\a:5 N � \ sharply downward toward Newport Boulevard, reverses and slopes sharply upward to the property line where there is a State Division of Highways chain link fence, and then again slopes sharply downward to Newport Boulevard. 5. The existing landscaping does not conform to the approved landscape plan as to type, number and size of trees or other plant material. Planning Director Wilson stated that as far as the department has.been able to determine, the Central Newport Healthcare Corporation has failed to complete their responsibilities unde Use Permit No. 1285 in terms of site cleanup, completion of the landscaping, etc., and they have a responsibility in this matter which should be fulfilled. Mr. William Hudson, Administrator of Hoag Hospital, stated that since their last appear- ance before the Commission, they now have 89 additional parking spaces located on the point however they are aware that they still are short in their parking requirements. He state further that they are attempting to obtain more parking at other locations and are still negotiating with Mr. Cagney in an attempt: to obtain more parking. The Commission suggested that the doctor's parking.area be opened to the public and that the doctors park on the point, however Mr. Hudson said he doubted that he could get the doctors to park on the point since the parking problem exists during visiting hours. Chairman Jakosky stated that the hospital keep growing but the parking facilities are not growing with it. Mr. Hudson said he felt that during this.con- struction period they should be allowed some leeway;, they are not looking for a long term . deviation and intend to comply with the regula tions. Upon being questioned as to the length of time it would take to complete the overall program, Mr. Hudson replied that they antici- pated that it would be in about 2; or 3 years. Page 9. CITY OF NEWPORT BEACH January 15. 1Q7n COMMISSIONERS "' ✓ '- - l 5 - r 1 1 l Mr. Hudson was asked if he had any comments on the 5 items previously listed and he said he would turn this discussion over.to a repre- sentative of Central Newport Healthcare Corpor ation who was present at the meeting as the hospital did not feel this was their problem. Mr. Kenneth W. McCulloch of ,2525 Ocean Bouleva d, Corona del Mar stated that he was not repre- senting the Central Newport Healthcare Corpor- ation but that this organization had purchased the property from him and these conditions seem to be a part of the original construction The majority of them he feels were approved tantamount to getting a certificate of occupan y. He also stated that the mound of dirt was left there by the Cable T.V. people and should be cleaned up by whoever was responsible for it being there. As far as the grading pattern is concerned, this involves approval from the State Division of Highways. • After a lengthy discussion, Planning Director Wilson suggested that Mr. McCulloch and the staff work together as closely as possible and if Mr. McCulloch could make arrangements with his engineering consultants at a convenient time within the next couple of weeks, staff would be happy to meet on the grounds or any other suitable place. Planning Director Wilso stated further that the obvious solution is for Mr. McCulloch to prepare the kind of plan that needs to be submitted to the State Division of Highways for the work to be done and staff will assist in every way possible to expedite approval of this by the State Division of High- ways in order that the job can be completed. In addition, the following conditions of approval were imposed on this application: • 1. That parking be provided to the satisfaction of the Planning Commis- sion. 2. That approval of this amendment is limited to a period of time, expiring November 20, 1972 (expiration date of- previous amendment), unless the Plan- ning Commission subsequently approves an extension thereof. 4. That the previous conditions of approval remain in effect to the extent they are still applicable. 5. That the doctor's parking lot be opened to the general public after 1:00 P.M. and that the number of spaces that presently exist be accepted during the interim period of the life of this use permit. Chairman Jakosky called a 10 minute recess after which the meeting reconvened with all members • present. Commissioner Glass left the dais during dis- cussion of the following two items in order to avoid a conflict of interest. The following two items were discussed simul- taneously. Item 10. Request to permit a Planned Residential Develo ment of 49 residential lots and one green area lot. - USE PERMIl NO. 1422-F APPROVED Location: Portion of Block 51 of Irvine's Subdivision located on the north side of Vista del Oro (extended) and westerly of Eastbluff Drive. Zone: R -3 -B and R- 4- B -2 -UL Applicant: I.D.H., a Joint Venture (Holstein Co.) Costa Mesa • Owner: The Irvine Company, Newport Beach William Foley of the Planning Department des- cribed the significant features of this use permit and Tract 7166. Page 11. Planning Director Wilson pointed out the parking situation and the Commission agreed that not more than one space per driveway should be allowed. Tentative Tract Map No. 7166 and lot Votinc x conditions pertaining thereto be approved. 2. A pedestrian walk be constructed on the exterior perimeter of the develop- ment to provide adequate pedestrian access to the common areas. 3._ That not more than one parking space in any driveway be counted toward meeting the parking requirement. Item 11. TENTATIVE Request to permit a subdivision of.9.15 acres MAP TRACT into 49 residential lots and 1 green area lot. 7166 Location: Portion of Block 51 of Irvine's APPROVED Subdivision located on the north side of Vista del Oro (extended) and westerly of Eastbluff Drive. Zone: R -3 -13 and R- 4- B -2 -UL Applicant: I.D.N., a Joint Venture (Holstein Co.) That Section 19.20.110 of the Subdivi- sion Ordinance regarding size and shape of lots be waived in accordance with the provisions of Section 19.32.030. 4. That the requirement for a perimeter of public streets be waived in accord- ance with the provisions of Section 20.50.080 of the Subdivision Ordinance. 5. That Section 19.16.030 of the Subdivi- sion Ordinance regarding map scale be waived provided maps drawn accurately to a scale of 1" = 100' are furnished the Public Works Department. 6. That the boundary of the final tract map be checked by the County Surveyor before being submitted to the City for approval. 7. That all grading be in accordance with grading plans and reports approved by the Public Works Director and a qual- ified Soils Engineer. Upon completion of the grading, the Civil Engineer and the Soils Engineer shall certify that the grading has been completed according to the plans and the-require- ments of the grading ordinance. Re- producible copies of the plans on stand and size sheets shall be furnished to the Public Works Department. 8. That the design of the proposed private streets be approved by the Public Works Department. 9. That construction of the proposed pri- vate streets be inspected by the Public Works Department and that a standard plan check and inspection fee be paid. 10. These specifications include: Size: 15 gallon Specie: To be determined by PB & R Spacing: One per lot or 50` maximum Staking: Two 2 "x4 "x8' redwood stakes for each tree. All Aye Planning Director Wilson informed the Commis- sion that the landscaping plan for the Newport Beach Tennis Club and revised plans for the self- service post office in Newport.Center had been received by the Planning Department. ** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** Planning Director Wilson also informed the Commission of a workshop for planning commis- sioners to be held at the State College in Fullerton on Saturday; on that same date a meeting is scheduled in San Clemente, the • subject being "Beach Profiles of the 70's - Future of Orange County Beaches ". ** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** The Commission was advised that the Cooperatio Committee with the City of Costa Mesa had as its representative from the Planning Commissio David W. Curtis, who is no longer in the area, therefore we have been asked to designate another member from the Planning Commission to serve on.this committee which is a liaison committee consisting of two councilmen and one planning commissioner from each city. Chairman Jakosky was appointed to serve on the committee. The Planning Commission recommended that the Motion x Private Street Policy be forwarded to the City Second x Council with the recommendation that the City All Aye Attorney's office review it in regard to any possible City liability. Chairman Jakosky suggested that the time limit for completion of the Newport Tomorrow Report be no later than February 19, 1970 even though Page 15. The Commission concurred in this opinion. Commissioner Martin stated that he would be absent on February 5, 1970. On motion of Commissioner Adkinson, seconded by Commissioner Watson, and carried, the meet- ing was adjourned to February 5, 1970 at 8:00 P.M. in the City Council Chambers. Don R.
