regular session at 7:30 P. M. in the City Hall,
January 20, 1937. Chairman H. L. Parks presided.

A.M.Nelson, L.W.Briggs and Consultant
L.Deming Tilton.
ABSENT: Coma. Clarence H.Lind, R.L.Patterson,
and Roland Thompson. Com. L. W. Briggs
announced that due to other business
Mr. Thompson was unable to attend this
meeting, but could be reached at
Santa Ana 195-W, if needed on any
matters.
MINUTES: Com. L. W. Briggs announced the follow-
ing corrections made in minutes of last
meeting held December 18, 1936:
AUTO COURT APPLICATION: To be deleted:
"An amendment to the Ordinance changing
that particular property from 0-2 to C -1
was published recently by the Council and
Is now awaiting final approval. On this.
basis."
R.S.BUTLER REQUEST: To be deleted: "The
boundary of this.lot is Central Ave.,
on the south and the shoreline of the
bay on the north. ".
J.B.McNALLY APPLICATION: This to be
added to last sentence, "subject to
evidence that may be presented at public
hearings."
MOTION: Com. Parks moved that minutes of previous
meeting be adopted as copy received and
subject to these corrections of the
Secretary. Seconded by Com. Whitson.

PUBLIC HEARING (MANNING SIEMON): Mr. Siemen's
.request for rezoning Lot 16, Block 14, Sec. 41
Balboa Island, from.0 -1 to R-2 was submitted, also
his check for $10 for application. Judge Granger
Hyer, representing Mr. Siemon, appeared before
the Commission and filed a letter from Mr.
5lemon, and also letters from Mr. and Mrs. E. J.
Bishop, owners of Lots 19, 20 and 21, Block 14,
See. 4, requesting this change. Judge Hyer stated
•Mr. Siemon s reason for this change was that he
wished to build a D -Class dwelling, now prohibit-
ed under the fire district ordinance for Balboa
Island in that location. This building would face
north and would require a set -back variance. The
change of the fire ordinance automatically takes
place when this lot is taken out of the business
zone.
Chairman Parks asked if others wished to be
heard on this matter, but there being no response,
Com. L. W. Briggs read several communications in
favor of the proposed change.
Chairman Parks announced the hearing closed, and
the second hearing to be held on February 17,
1937, and notice to that effect to be published
and posted.
PUBLIC HEARING (PETER LAWS): Com. L. W. Briggs
.announced this application had been before the
Commission for about six months. Mr. Laws being
present, was asked to present his plans for con -
struction of a single apartment over six private
garages on the West side of 9th St., north of the
Newport Beach Hospital, the garages to serve the
Bay View Court. Mr. Laws submitted plans de-
signed by Gordon B. Findlay, also a picture of a
similar structure showing how the contemplated
building would look when completed. He stated
that three entrances would open on 9th St., and
three off the alley, overhead doors to be used on
the 9th St. entrance. Mr. Nelson said there were
no complications in the neighborhood regarding
this.

Com. L. W. Briggs announced that Dr. G. M. Grundy,
owner of a 65' lot in-this zone, telephoned him
twice regarding this matter, he being concerned
with the appearance of the building, otherwise he
had'no other objection. Com. F. W. Briggs stated
that this district had been zoned to Rr2, therefore,
this would be a one - family dwelling in a two -
family dwelling district. It was brought out that
the ordinance does not limit the number of private
garages that may be constructed, connected with,
or appurtenant to a dwelling in any district. Mr.
Laws further stated there would be room for eight
cars, but it was not for commercial purposes,
and that he and his wife would be the only
occupants of the apartment above these garages.
40 A letter from E. H. Day, owner of a 65' lot in this
tract, to the effect that he believed a request
of this kind should be studied, as any variance
should be carefully gone into, was read.
Chairman Parks moved that the Commission indicate
its approval to the Building Inspector of the
plan presented by Mr. Laws, subject to the further
detail of the elevation suiting the people in the
neighborhood. After consideration the Chairman
ruled that any further action by the Commission
was not required.
PUBLIC HEARING (VALELLY REQUEST): Com.L.W.Briggs
brought up the matter of this petition to rezone
Lots 5 & 6, Blk. 9, Sec. 1, Balboa Island, from
R-2 to C -1. He stated the owners of Lots 1 & 21
Blk. 7, Sec. 11 favored this change. F.J.Fuller,
owner of Lot 31, Blk.. 7, See. 1, appeared before
the Commission opposing the change, saying he did
•not want to go into a business zone. He also
submitted a letter from Per. Baum, owner of Lot 27,
Blk. 7, Sec. 1, authorizing him to protest in
Mr. Baum's name.
Mr. Palmer asked that Lots 5 & 6, Blk. 5, Sec. 1,
and Lots 1 & 2, Blk. 11, Sec. 1, be notified for
the next meeting.
The Chairman announced the hearing closed, and the
second hearing to be held on February 17, 19379
and the Secretary was instructed to publish and
post notices and send cards re this hearing.
MRS. HELEN M. HARRICT: Mrs. Helen M. Harriot,
314 Coral, Balboa Island, Phone 330, representing
property owners on Balboa Island, presented a
plan to beautify the Island by planting trees.
She had contacted property owners who were willing
to do this at their own expense, but during the
months they were not here, wanted help on taking
care of these trees.. Her plan was deemed a
worthy one, but she was referred to Councilman
Gordon, Chairman of the Park Commission.
UNFINISHED BUSINESS: A report of Coma. Nelson and
. .Br ggs on survey of Balboa Island relative to
set - backs. The committee filed a map showing the
various distances that all of the houses facing
the water on Balboa Island are set back from their
front property linesv Considerable discussion re-
sulted regarding a possible alteration of the front
yard requirement on all of the water front lots
on Balboa Island, and upon advice of the Consultant,
no amendment was recommended, and each front yard
variance will be taken up upon application as
heretofore.
REQUEST (C.HAROLD HOPRINES�: Com. L. 19. Briggs
read a letter From Leon E. Yale on behalf of C.
Harold Hopkins re six foot set -back for house
moved to Lot 13, Blk. 26, 9"r. ESD, Base W11,
on "J" Street. The owner believed the ruling of
a ten foot set -back unreasonable.
The Chairman announced that a Public Hearing on
the Hopkins variance request would be held Febru=
ary 17, at 7:30 P.M., in the City Hall, and
instructed the Secretary to publish and post
notices as required by the ordinance.
PETITION CITY OF NEWPORT BEACH: A letter from the
ity Council filed reads: The City of Newport
•Beach has under consideration the leasing of
certain of its property hereinafter described to
Mr. McNally, for the purpose of conducting a boat
livery and business incidental thereto: This
property is shown on the District map as being in
Zone R -3, which would prohibit the leasing of the
property for the purposes contemplated or under,
consideration by the City of Newport Beach. The
City Council therefore respectfully requests your
consideration and recommendation in relation to
changing the property hereinafter described from
Zone R -3 to Zone C -1.
The City Council of the City of Newport Beach
believes that changing this property from Zone R-3
to Zone 0-1, will not injure other properties in
the vicinity as all properties lying between City
owned property and the Ocean front zoned under
the designation of 0-1. The property herein
mentioned is described as follows: A strip of land
50 feet in width lying westerly of and parallel to
15th Street, between the first alley Northerly of
rCentral Avenue and the United States Government
BuUhead line, between Stations 118 and 119.
This petition and letter is submitted to you in
accordance with a Minute Resolution No. of the
City of Newport Beach this day passed and
adopted.

Com. L. W. Briggs moved that two public hearings
be held on this matter, first one being Feb. 17,
seconded by Com. SchrAftr. Carried.
PARKING SURVEY: Consultant Tilton reported that he
ad received official notice from the City Clerk
of the approval by the City Council of his fee in
connection with the major street and highway plan,
also that an outline of the maps and survey re-
quired was in the hands of the City Engineer. He
stated further that he would communicate with Mr.
Patterson re arding these maps, etc., now that
the engineer s office was comparatively clear of
drafting work in connection with WPA improvement
jobs.
HAL WILL SMITH REQUEST: Mr. Nelson submitted a
plan of Hal WiSmith to build a house 65' long
on a lot 751 1 , with an open roofed porch
four or five fe t wide on the second floor. No
action taken on this.
