Foley Helen Herrmann MINUTES On motion of Commissioner Dosh, seconded by Commissioner Watson, and carried, the minutes • of January 15, 1970 were approved. Item 1. USE PERMir Request to permit retail sales and service of automobiles. NO. 1462 APPROVED Location: Lots 31, 32, 33, 34 and 35, Tract 1210, located at 1000 West Coast Highway, on the north side of West Coast Highway opposite the Balboa Bay Club. Zone: C -1 -H Applicant: Subaru of California, Inc. Newport Beach Owner: Balboa Bay Club Newport Beach Miss Sandra Heibel represented the applicant and stated that in connection with the staff. • recommendations, the landscaping had been renovated; however a wall or screen in front of the car storage lot would bar access to adjacent property which uses this area for the removal of boats. The Commission expressed concern about the number of signs on the property but were assured that in accordance with the City's Sig Ordinance, these signs were legal. However the Commission suggested that the applicant work with the Planning Department in an effort to work out a more appropriate sign program. Mr. William Neal was present at the meeting and answered questions of the Commission as to the type of repair work he would be doing. Mr. Neal stated that he intended to perform only minor tune ups and brake work and not major repair work. The Commission suggested that the application Motion x be continued until February 19, 1970 and that Second x in the meantime, the applicant meet with the All Aye Planning Department staff and outline exactly the type of repair work he is contemplating. It was pointed out to the C6mmi5sion that a condition of approval at the time the original use permit for the Harbor Service'Station was app.r.o.ved was "that the alley and street improv - men.ts be constructed in accordance with the specifications of the City Engineer ". The City Engineer stated that he strongly recommen s that these improvements not be completed due to a serious drainage problem and Commissioner Dosh suggested that this requirement should be waived. Zone: Unclassified, C -N -H and R -3 Applicant: The Irvine Company, Newport Beach Owner: Same as applicant. • Planning Director Wilson explained to the Commission Master Plan Amendment No. 25 which proposes to relocate an existing road ( Bayside Drive), and pointed out that Phase I of Use Permit 1466, as presently proposed, delineates on the submitted map the following reas: (1) Lagoon; (2, 3 & 4) Commercial; (9) Low Density Residential. Tentative Map No. 3867 is the proposed subdivi sion of the area covered under Phase I of Use Permit 1466. (62 single family residential lots, a waterway lot, a planted area, a common waterway access area, marina facilities and parking, a park site, and a commercial area.) Mr. James Taylor and Mr. David Kaylor of the Irvine Company addressed the Commission at length regarding this proposed project. Also present were Mr. Robert Bein and Mr. Jack Raub . engineers. The Commission expressed concern regarding several items; the width of the waterway, the • amount of traffic on Bayside Drive (suggesting a frontage road), access points, combined driveway access, preserving the natural contou of the bluff, the necessity for a lagoon and the wording of the use permit. The Commission inquired as to the number of units the Irvine Page 5. CITY OF NEWPORT BEACH Fehruary 5. 197n COMMISSIONERS v F o :5 q N s F_ 3 0 5 N Company planned for the upper portion of Promontory Point (Phase 2 of this development) and Mr..Taylor stated they anticipated to develop it to an R -3 density of 30 units to the acre, something in excess of 600 units. Mr. Kaylor stated that a traffic study of Bayside Drive revealed a daily traffic count of from 13,000 to 16,000 cars per day but this was expected to drop to 6500 per day after con- struction of the freeway. The Commission questioned Planning Director Wilson as to the timing of the freeway construction and he replied that under present financing capabil- ities, this portion of the Pacific Coast freew y may be under construction in 1976 -- and the freeway may be opened to traffic in 1978. Mr. Charles Griffin of Balboa Island spoke in opposition and Mr. Allan Beek of Beacon Bay spoke in favor of the proposed development. It was pointed out that unless the Commission • makes a favorable decision on Master Plan Amendment No. 25 and Use Permit 1466, there would be no point in proceeding with Tentative Tract 3867. Planning Director Wilson also explained that the Commission can act on any portion of the use permit that has been legally advertised; it does not have to act on the entire application but can act on any por- tion and condition the action accordingly. Planning Director Wilson asked the Commissione s to retain all the information they have receiv d on these items as the entire packet will be forwarded only to Commissioner Martin, who is absent. Chairman Jakosky called a five minute recess and the Commission reconvened at 11:20 P:M. with all members present. • Commissioner Glass left the dais during dis- cussion of the following two items in order to avoid a conflict of interest. Planning Director Wilson inquired when the use permit for the maintenance area would be • filed and Mr. Holstein replied as soon as they have the signature of the Irvine Company, whic should be sometime next week. That Section 19.20.110-of the Subdivi- sion Ordinance requiring that lots abut on a street be waived in accordance wit the provisions of Section 19.32.030 provided that adequate access is fur- nished. 3. That Section 19.20.110 of the Subdivi- sion Ordinance regarding size and shape of lots be waived in accordance with the provisions of 'Section 19.32.03 . 4. That the requirement for a perimeter of public streets be waived in accordance with the provisions of Section 20.50.08 of the Subdivision Ordinance. 5. That Section 19.16.030 of the Subdivi- sion Ordinance regarding map scale be waived provided maps drawn accurately to a scale of 1" = 100' are furnished the Public Works Department. 6. That the boundary of the final tract map be checked by the County Surveyor before being submitted to the City for approval. 7. That all grading be in accordance with grading plans and reports approved by the Public Works Director and a quali- fied Soils Engineer. Upon completion of the grading the Civil Engineer and the Soils Engineer shall certify that the grading has been completed accord- ing to the plans and the requirements of the grading ordinance. Reproducible copies of the plans on standard size sheets shall be furnished to the Public Works Department. 8. That the design of the proposed private streets be approved by the Public Works • Department. 9. That construction of the proposed pri- vate streets be inspected by the Public Works Department and that a standard Page 8. That all off - street parking meet the City's minimum standards. 12. That the tract boundary be extended to the center line of Eastbluff Drive. 13. Street trees to be installed on East- bluff Drive and Vista del Oro in accordance with PB & R Department specifications. PB & R Department must be notified at least 24 hours in advance to any parkway tree plant- ing. The slopes on Eastbluff Drive should be treated with sprinkler system and ground cover so that no erosive material will run off on the sidewalk or Eastbluff Drive. 14. That the number and location of fire hydrants shall be subject to the approval of the Fire Department. Commissioner Glass returned to the dais. The Commission took the following action in connection with the supplementary agenda. A. The Planned Residential parking policy was set over until the meeting on February 19, 1970. B. The discussion of the Newport Tomorrow recommendations had been covered in the afternoon study. session. C. The Corona del Mar State and City Beach park concession was approved.
