Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Kevin Riley, City Traffic Engineer - 949-644-3329, kriley@newportbeachca.gov TITLE: Resolution No. 2026-13: Limiting the Parking of Vehicles on Certain City Streets ABSTRACT: The Balboa Island Improvement Association (BIIA), with support from the Balboa Island Merchant Association and the Little Island Homeowners Association, is seeking City Council approval to implement an on -street golf cart parking time limit of two hours between 8 a.m. and 6 p.m. on the southside of Park Avenue and the northside of Balboa Avenue, just west of Marine Avenue where the parking is striped for golf carts. The request is due to concerns related to long-term golf cart parking and the lack of available parking for other island residents and visitors. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2026-13, A Resolution of the City Council of the City of Newport Beach, California, Limiting the Parking of Vehicles on Certain City Streets. DISCUSSION: The BIIA contacted the Public Works Department with concerns related golf carts being parked long term in the designated street spaces striped for these types of vehicles on the first block west of Marine Avenue on Park Avenue and Balboa Avenue. These golf cart spaces are adjacent to restaurants and other commercial businesses. A common activity associated with long-term golf cart parking along these two street segments includes golf cart sale advertisements, resulting in a vehicle parked in a spot for multiple days, preventing others from using the parking space. Public Works Department staff communicated with the BIIA and the association provided a letter noting support from the Balboa Island Merchant Association and Little Island Homeowners Association to ask the City of Newport Beach to implement an on -street parking time limit for the designated golf cart spaces. Staff reviewed this request and recommends a Resolution No. 2026-13: Limiting the Parking of Vehicles on Certain City Streets February 24, 2026 Page 2 daily two-hour time limit between 8 a.m. and 6 p.m., consistent with Marine Avenue parking time limits, to allow parking space turnover adjacent to businesses. Educational enforcement may be necessary to advise on the new parking restriction before implementation. FISCAL IMPACT: The adopted budget includes sufficient funding for the sign installation. It will be expensed to the Traffic Signage Striping Marking account in the Public Works Department, 01201927- 980000-24T03. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). This adjustment aims to address ongoing concerns, including: • Long-term parking of golf carts listed for sale. • Overnight parking. • Extended use of spots. • General misuse that detracts from availability for residents and visitors. This change is expected to better serve the community and enhance visitor access. Additionally, we have consulted the Balboa Island Merchant Association and the Little Island Homeowners Association, and they have expressed no opposition to this proposal. Dan Abbott, President, by Susan Pearl Vice President Attachment B RESOLUTION NO. 2026- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, LIMITING THE PARKING OF VEHICLES ON CERTAIN CITY STREETS WHEREAS, Section 200 of the City Charter, of the City of Newport Beach ("City"), vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the City Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges or procedures granted or prescribed by any law of the State of California; WHEREAS, Newport Beach Municipal Code Section ("NBMC") 12.44.010(B) provides that when authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of time longer than two (2) hours upon such streets or portions thereof as the City Council shall designate by resolution; WHEREAS, Section 12.44.010(E) of the NBMC authorizes the City Council to vary the hours or days of parking restrictions when special parking or traffic conditions exist; and WHEREAS, pursuant to the authority found in Sections 12.44.010(B) and (E) of the NBMC, the City Council now desires to limit the parking of vehicles on certain sections of Park Avenue and Balboa Avenue. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby amend the parking regulations based upon the special parking and traffic conditions that currently exist within the City. The following parking restrictions shall apply to the parking of vehicles. Parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m. daily is limited to two (2) hours on the following streets: Park Avenue South side of Park Avenue, from the alley west of Marine Avenue 70 feet east to Marine Avenue Balboa Avenue North curbside of Balboa Avenue, from the alley west of Marine Avenue 70 feet east to Marine Avenue Resolution No. 2026- Page 2 of 2 Section 2: The City Traffic Engineer is hereby directed to erect all necessary signs at the above locations to indicate the parking restrictions contained herein. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the substantive/operative portion of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
