HomeMy WebLinkAbout2026-14 - A Resolution of the City Council of the City of Newport Beach, California, Approving a Substantial Amendment to the 2025-2026 Annual Action Plan for the Federal Community Development Block Grant ProgramRESOLUTION NO. 2026-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, APPROVING A SUBSTANTIAL AMENDMENT TO THE 2025-2026 ANNUAL ACTION PLAN FOR THE FEDERAL COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM WHEREAS, the City of Newport Beach ("City") participates in the United States Department of Housing and Urban Development ("HUD") Community Development Block Grant ("CDBG") Program; WHEREAS, HUD requires the City to prepare a Five Year Consolidated Plan for the use of HUD grant programs outlining the use of the CDBG funds and the strategic vision for housing and community development in the City; WHEREAS, the City Council adopted Resolution No. 2025-51 on July 22, 2025, approving the 2025-2029 Consolidated Plan, the 2025-2026 Annual Action Plan, and the Citizen Participation Plan for the CDBG Program; WHEREAS, the 2025-2026 Annual Action Plan ("Action Plan") appropriates the CDBG annual grant and other available grant funds during the fiscal year; WHEREAS, subsequent to City Council approval of the Action Plan, staff identified an opportunity to utilize unallocated CDBG funds to improve public facilities and infrastructure with Americans with Disabilities Act ("ADA") accessible concrete sidewalks, parkways, driveways, access ramps, cross gutters, curbs and gutters; WHEREAS, a citywide ADA capital improvement project ("Citywide ADA Project") is a CDBG eligible activity and is consistent with the City's 2025-2029 Consolidated Plan; WHEREAS, a substantial amendment to the Action Plan is necessary to add the Citywide ADA Project capital activity not previously described in the Action Plan; WHEREAS, in the event of a substantial amendment to an annual action plan, the Citizen Participation Plan requires a thirty day public review period followed by a public hearing prior to adoption; WHEREAS, in accordance with the Citizen Participation, on January 24, 2026, the City published notices in the Daily Pilot newspaper and on the City's website, and provided an electronic mailing notification to interested stakeholders, announcing that the Draft Substantial Amendment to the 2025-2026 Annual Action Plan ("Substantial Resolution No. 2026-14 Page 2 of 3 Amendment") would be available to the public for review and comment from January 24, 2026 to February 24, 2026; WHEREAS, a public hearing was held by the City Council on February 24, 2026, in the City Council Chambers located at 100 Civic Center Drive, Newport Beach, California regarding the Substantial Amendment. A notice of time, place and purpose of the public hearing was given in accordance with California Government Code Section 54950 et seq. and 24 C.F.R. Part 91; and WHEREAS, the City Council desires to amend the 2025-2026 Annual Action Plan and approve the Substantial Amendment to the 2025-2026 Annual Action Plan. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council hereby approves the Substantial Amendment to the 2025-2026 Annual Action Plan as provided in Exhibit A, attached hereto and incorporated herein by reference. Section 2: The City Council does hereby authorize: (a) the City Manager, or designee, to: 1) submit the 2025-2026 Annual Action Plan as amended to HUD and 2) execute all subrecipient agreements with the organizations receiving allocations of CDBG funds in the 2025-2026 Annual Action Plan as amended; and (b) the Community Development Director, or designee, to be the official representative of the City to administer the program and submit the required environmental documentation to HUD for CDBG projects. Section 3: The City Council finds the approval of the Substantial Amendment to the 2025-2026 Annual Action Plan is exempt under 24 CFR Part 58, Section 58.34 of the National Environment Policy Act of 1969, as amended. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative portion of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Resolution No. 2026-14 Page 3 of 3 Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
