THE NEWPORT BEACH CM PALNNING C0121ISSION met 'in
regular session 'Vednesday, February 16, 1938 at
•7:30 p.m. in the Council Chambers, City Hall.
Chairman Hopkins presiding.
Meeting was called to order by the Chairman.
ROLL CALL - Commissioners present: Hopkins, Seager,
Briggs, Williams, Findlay, Schnitker,
Patterson.
Commissioners absent: Whitson.
City Attny. Thompson attended.
The Secretary stated that this was a regular
meeting.
MIN[ITES
Cogan. Briggs said that he had a correction to, `
make in the minutes of the last adjourned meeting
held January 26. He had been excused when the dis-
cussion on the proposed Circular Drive was held so
could not have expressed an opinion. With this
correction made, Comm. Briggs moved that the minutes
of the regular meeting held January 19, 1938 and
the adjourned meeting held January 26, 1938 be
approved as written. Seconded by Comm. Schnitker.`
Motion carried.
COP:IMITTEE REPORTS
Chairman inquired if there were any committee
reports.
Mrs. Williams reported having written to the
State Park Department regarding the replacing of
trees on the Coast Highway and said that she had
received a letter thanking her for calling their
attention to the matter. Dr. Seager said that the
trees are being replaced now.
HEARINGS
REZONING OF LOTS 304,5 and 6 at 6600 Coast High-
way. SECOND HEARING
Secretary read the application of Yr.;Riddle for
rezoning of Lots 3,4,5 and 5 and presented the
map showing their location for examination by the
commission. Chairman inquired if notices had been
sent to the surrounding property owners. Secretary
said there had been no notices sent.
Chairman asked if there was anyone present who
wished to ask questions or object to the rezoning
of these lots. No one objected.
Comm. Patterson inquired what the commission

was going to do with the rest of the property in
this section; he thought perhaps it should all
be rezoned for business. Mr. Thompson said that
the City owns most of the property in this district.'
Chairman Hopkins thought the commission should try
to restrict the spreading of business zones and
should only rezone for business as the demand arises.
Comm. Patterson moved that Resolution No. 113
be adopted recommending to the City Council that
Lots 3,4,5 and 6 at 6600 Coast Highway in West
Newport be rezoned from R -3 to C -1 and that the
same be transmitted to the City Council by the
Secretary and a copy be filed as apart of the
minutes of this meeting. Seconded by Comm. Findlay.
Passed by the following Roll Call vote:
Ayes: Hopkins, Seager, Briggs, Williams, Findlay,
Schnitker,`Patterson.
Noes: None.
So ordered by the Chairman.
AMENDMENT TO ORDINANCE 440 - FIRST HEARING`
Secretary presented for discussion the following
proposed amendment to Ordinance 440 having to do
with rear yard requirements as ordered at the last
meeting;
Subdivision "c" of paragraph "1" of Subsection
C of Section 10, appearing in column 3 on page 5
shall be amended as follows:
after the word "feet" a comma, and the words
"except in such streets, alleys, public
parks, or beaches in any block of which
buildings have been erected upon the rear
Property line upon fifty percent of the
lots, the rear yard requirements shall
be fixed by the City Council upon recommend- -
ation of the Planning Commission as here-
in provided,"
Chairman inquired if anyone wished to discuss
this amendment from the floor. No one responded.
Comm. Schnitker moved to send this matter to the
second hearing to be held February 23, 1938.
Seconded by Comm. Findlay. Motion carried.
So ordered by the Chairman.
HEARING ON TENTATIVE L4AP OF TRACT 1006.
Mr. 'i "Dooley, representing the— subdIviders
Tract 1006 presented the map for examination
the Commission. He explained that the tract

Chairman Hopkins suggested that the matter be -
tabled until IIr. Tilton could be•_present to look
over the map and advise the commission on any
action taken.
• Mr. V";ooley said he would like the commission to
take some action on the map as soon as possible so
they could go ahead with the preparation of their
detail maps. Comm. Findlay said that he had visit-
ed the property and approved of the development,
he "thought it an improvement to the community.
Dr. Seager said that he had visited the property
and also approved of the project. The lots are to
!re 50 ft. wide and will allow plenty of room for
building.
The opinion of the commission was that the resi-
dence property should be extended to Iris St. in-
stead of leaving the corner lots zoned for business.
Comm. Patterson moved that the tentative map of
Tract 1006 be approved by the commission with the
provision that lots.26,28,30,32 and 34 of Block A36 .
be included in the proposed subdivision.
Seconded by Comm. Findlay. Motion carried.

APPLICATION FOR VARIANCES
Application of Mrs. Clarinda C. Smith, owner
of Lot 17, Blk 3, Sec. 2, Balboa Island for 50,%
front yard and 66% side yard variance was read by
the Secretary. He explained that this was the
corrected application for the variances discussed
at the last meeting. He stated that the applications
had been republished and posted and that notices
had been sent to the surrounding property owners.
Chairman inquired if there was anyone present"
who wished to speak on this matter. No one respond-
ed.
Secretary said that the property had been visited
by the Building Inspector and himself. There are
9 houses in the block and none of them conform to
the set back requirements of the ordinance; both
variances requested are on public ways; it has been
the practice of the commission to grant variances
on Park Avenue and nearly all of the houses on Park
have been granted 50% variances.
Chairman Hopkins said the commission is not im
powered to grant more than a 50% side yard variance,
the owners of this property are asking for a 660
variance. The Commission felt that a 50% side
yard variance could be allowed.
Comm. Patterson moved that Resolution No. 114
be adopted recommending to the City Council that
a 500 front yard variance and a 50o side yard
variance be granted to Mrs. Clarinda C. Smith on
Lot 170 Blk 31 See. 2, Balboa Island, and that
the same be transmitted to the City Council by the
Secretary and a copy be filed as a part of the
•minutes of this meeting. Seconded by Comm. Briggs.

Findlay, Schnitker, Patterson.

HEARING ON THE TRAFFIC MAP SHOWING MAJOR STREETS
AND HIGIRVAYS - - FIRST HEARING - -
The map showing Major streets and thoroughfares
was presented for the examination of the commission
and anyone interested.
Chairman Hopkins explained that this map of the
major streets is the beginning of the Traffic Plan
and the first step in getting the traffic plan in
graphic form. < It is negessary to designate the
major thoroughfares and have them before us in some
graphic form before we can decide where changes and
improvements are needed." On this map we are taking
the present streets and establishing which are major
streets. This is necessary in order to make a pro
•per study of existing conditions and possible sol-
utions for traffic problems. This map will become
part of the Master Plan.
Secretary read the paragraph from the Statutes;
having to do with the Master Plan for the informa-
tion of those attending the meeting.
Comm. Findlay moved to send this matter to the
second hearing to be held at the next regular meet-
ing March 16, 1938. Seconded by Comm. Schnitker.
Motion carried. So ordered by the Chairman.
Attny. Thompson suggested that the map be post-
ed on the bulletin board so that any one interest-
ed might have access to it.
Mr. Maxwell, owner of a lot on 9th and Bay Front
appeared before the commission with a request for
a variance but had made no ap-olication. He said
that he did not know the procedure required but
wished to start his building as soon as possible.
Mr. .Thompson suggested that he start his foundation
and apply for the variance in the proper tanner;
' when the variance is granted he can file an amend-
ment to the pl ans.
PIr. Harris, subdivider of Tract 1006 spoke brief
-
17 of their plans for the development of the tract.
He said they wish to cooperate with the Commission
in every -way. The development is to be a high
class subdivision and will be an asset to Corona
del Mar; all plans are to be submitted to an archit-
ectural board for approval and restrictions placed
• on the property exceed those established by Ordin-
ance 440.
ADJOURNI ENT
Secretary Seager moved that the meeting adjourn
to meet February 23, 1938 at Bay Shore Cafe on
Coast Highway. Seconded by Comm. Schnitker.
