Planning Commission questioned whether construc-

association and staff advised that the City had

Public hearing was opened in connection with this
matter.
Ray.Kelder,.applicant, appeared before the Commis-
sion and concurred with the staff report and
recommendations.
Virginia O'Brien, 621 Via Lido Nord, appeared
before the Commission and disputed the property
line, claiming that 2 feet of the subject pro-
perty was hers by right of adverse possession as
well as title by prescription. It was brought
out, however, that there were no legal documents
to establish ownership of the 2 feet and the
staff and.Planning Commission advised Mrs. O'B.rien
that this was a civil matter between her and the
Kelders and the City would have to abide by
recorded data as to legal title.

Planning Commission and commented on the parking
problem which still exists in the area. He did,
however, state he had no objections to the request
for installation of gas pumps for company vehicles
Planning Commission discussed the parking problems
in the area however it was pointed out that Hughes
Aircraft Company was presently providing more
parking than was required by the Municipal Code.

An amendment to the Circulation Element as it
pertains to recommended improvements for Coast
PLAN
Highway. (Initiated by the City of Newport Beach

Community Development Director Hogan clarified the
direction of the City Council in that only three

segments should be considered at this time, namely

from Newport Boulevard to Dover Drive; from the

east end of the Bay Bridge to Jamboree Road; and
REVISED
from Jamboree Road to MacArthur Boulevard. Mr.
Hogan also commented on erroneous information
contained in several newspaper articles and
clarified the City's position with regard to
Coast Highway and the Circulation Element.
City Engineer Nolan reviewed the staff report and
recommendations regarding the three segments of
Coast Highway under consideration. He also pointe
out that the figures contained in the ADT column
of Exhibit 4 reflected summer traffic volumes
derived from counts made in July, 1974, and were
considerably higher (5,000 to 10,000 cars) than
the traffic experienced over a year -long average.
Mr..Nolan advised of the City's concern with
additional factors outside the control of the
City which would have an effect on future traffic
demands. These factors included land use planning
outside the City, difficulty in effecting some of
the proposed elements of the traffic circulation
system outside the City (particularly the Corona
del Mar Freeway) and the point of time in the not
too distant future when the San Diego Freeway
reaches it's capacity and will be unavailable to
absorb traffic from the coastal corridor. He also
pointed out that some of the consequences of
exceeding highway capacity included delays to
motorists, difficulty and hazards to pedestrians
and bicyclists, more noise, more smog, poor access
to adjacent businesses, higher accident rate, .
higher user cost and community cost, diversion of
traffic to parallel routes which may be available
(such as that being experienced through Corona del
Mar), difficulty in surface maintenance as well as
utility maintenance, and difficulty in providing
emergency service.
Planning Commission discussed project funding and
procedures for obtaining funds; grade separation
as opposed to the proposed one -way couplet; the

effect of the one -way couplet on traffic in the
area; the traffic study by Alan M. Voorhees &
Associates; and the segment of Coast Highway
through Corona del Mar as to right -of -way width
and development.
Public hearing was opened in connection with this
matter.
Michael Gering, 1350 Sussex Lane, appeared before
the Commission on behalf of the Newport- Harbor
Chamber of Commerce. He requested that the
traffic deficiency on Coast Highway through Corona
del Mar also be considered in conjunction with the
other segments of Coast Highway and requested that
John Barry be given the opportunity to make a
presentation in this regard. Mr. Gering also
advised of the Chamber's support of the Avocado/
MacArthur one -way couplet as well as whatever
technical solutions were best for the City in
order to alleviate the traffic congestion on
Coast Highway.
At this point, Community Development Director
Hogan reviewed the direction of the City Council
in initiating this amendment and advised that the
reasons for eliminating the Corona del Mar segment
of Coast Highway at this time was the uncertainty
of the route for the extension of the Corona del
Mar Freeway through Bonita Canyon as well as the
results of the traffic study for the southeast
section of Orange County which should be complete
within the near future.
Planning Commission discussed whether or not the
Corona del Mar segment of Coast Highway should be
included in the public hearing and consideration
given to any presentation made in this regard.
Following discussion, motion was made to allow

10 minutes for a presentation on the Corona del

Mar segment by John Barry.
John Barry, residence at 605 Via Lido Soud and
office at 3020 Newport Boulevard, appeared before
the Commission to make a presentation on the
traffic through Corona del Mar and suggested an
alternate solution for alleviating traffic con-
gestion by means of a village by -pass such as that
utilized by the Cities of Carmel and Palo Alto.

Richard Stevens, 1221 West Coast Highway, appeared
before the Commission on behalf of the Balboa Bay
Club and Tract 1210 Limited. He commented on the
issue at hand and felt there was a need for a
freeway through the City.
Ned McCune, one of the owners of the Mariners Mile
property which was destroyed by fire, appeared
before the Commission in opposition to the taking
of 24 feet for additional right -of -way. He com-
mented on the proposed plan to rebuild, the need
for additional parking, opposed abandonment of the
alley in exchange for the required right -of -way,
and stated that 12 feet would be the maximum he
could agree upon.
Mr. Jorgenson, another Mariners Mile property
owner, appeared before the Commission to answer
questions regarding the redevelopment of the pro-
perty which.was destroyed by fire, the Edison
easement within the alley and and reduced setbacks
in exchange for right -of -way on Coast Highway. He
commented on the changing character of Newport
•
Beach and felt that an attempt should be made to
maintain a village atmosphere oriented towards a
marine center with slower traffic rather than a
high -speed thoroughfare.
D. T. Daniels appeared before the Commission on
behalf of Ardell Investment Company. He commented
on the widening of Coast Highway and felt that
parking lanes should be eliminated rather than the
taking of additional property on the north side of
Coast Highway. He also voiced opposition to any
freeway along Coast Highway.
City Engineer Nolan commented on the acquisition
of property along Coast Highway, the availability
of funds for the project and the time element
involved to complete construction..
John Troupy of United California Bank, appeared
before the Commission and advised that they could
agree to 12 feet for additional right -of -way along
Coast Highway, however, anything more would render
the remaining property useless for their purposes.
He also commented on the need for a decision as
soon as possible in order to prevent further
delays with respect to reconstruction of the
•
businesses which were damaged by the fire on
Mariners Mile.

Lawrence Snow, partner of Newport Marine Radio,
appeared before the Commission and commented on
the philosophical aspect in that the more the City
provides for cars, the more cars will come into
the City.
John Carson, Setting Sun Drive, Corona del Mar,
Vice President and Municipal Affairs Director of
the Harbor View Hills Community Association,
.
appeared before the Commission and urged endorse-
ment of the Circulation Element as originally
adopted with the exception of the amendment
relating to the Avocado /MacArthur one -way couplet
which they endorse.
J. R. Blakemore appeared before the Commission on
behalf of the Harbor View Homes in Broadmoor Hills
Broadmoor- Harbor View - Corona del Mar Civic Assoc-
iation and Newport Hills. They felt that nothing
has happened to warrant a change in the "Circulatio
Element with the exception of the Avocado /MacArthu
one -way couplet which they endorse and emphasized
that the Circulation Element should be reaffirmed
•
as adopted.

Following comments by the Commission relative to
the issues under consideration, motion was made
recommending to the City Council the adoption of
General Plan Amendment No. 23 with a right -of -way
width of 124 feet as shown in Plan C.
Planning Commission discussed the motion, Plan G
as an alternate and rerouting of the bicycle trail
along Coast Highway.

Substitute motion was made recommending to the
City Council the adoption of General Plan Amend -
ment No. 23 with Plan G as a alternate and that a
study be undertaken regarding bicycle trails on
Coast Highway and a reduction in the width of the
sidewalks. The substitute motion was then modi-
fied to cover consideration of Plan G only with
112 feet of right -of -way (the study to be con-
sidered at a later date).
It was suggested that separate actions be taken
•
on the various issues, therefore the original
motion was withdrawn by Commissioner Heather and
the substitute motion was withdrawn by Commissione
Parker.

The following persons appeared before the Commis-
sion in support of the amendment as proposed:
Shirley Knudsen, 321 Coral;
Bill Vosburg, 433 Vista Grande;
Pope Hilburn, 2195 Vista Entrada;
Sue Ficker, 110 - 9th Street; and
Steve Donaldson, 2201 Vista Bogard.
Ray Watson, President of The Irvine Company,
appeared before the Commission in opposition to
the request and commented on the Back.Bay and
Senate Bill 386 relative to its acquisition. He
also commented on the lack of opportunity to begin
implementation of the existing General Plan and
the need for his firm to be able to rely on
decisions of the City in order that plans may be
made on something other than a piece -meal basis.
Other comments included vacant land vs. redevelop-
ment of property and the density involved; and
life -style vs. density. He voiced concern that
their options for development were being reduced
to that of single family dwellings and felt that
the existing General Plan should be implemented
and that the project level approval together with
the required environmental impact report should
be sufficient to control whatever problems may
arise.
Planning Commission discussed broad -base planning
vs. piece -meal planning and the control and
flexibility of development on larger parcels of
land.
Other persons appearing in favor of the proposed
amendment included the following:
Tom Houston, 206 Ruby Avenue, Vice President of
the Balboa Island Improvement Association;
Claudia Hirsch, 30 Harbor Island; and
Bob Millard, 116 Crystal Avenue, Balboa Island,
President of the Little Island Property Owners
Association.
Bill Banning, representing Beeco Limited, owner of

approximately 400 acres of land presently outside
the City Limits but within the sphere of influence
of Newport Beach, appeared before the Commission
in opposition to the amendment and commented on

the possible effects to their property and the
City as a whole.
There being no others desiring to appear and be
heard, the public hearing,was closed.

Motion was made recommending to the City Council
that Amendment No. 21 be adopted as proposed.
Planning Commission discussed the motion and it
was suggested that the various proposals to the
text be considered individually and then consider-
ation be given to their specific application.
Further comments were made with regard to any
additional reduction in density;.the many public
hearings which were held on the subject of density
within the past several years and the efforts
which went into the preparation of the present
General Plan; and discrimination against the two
landowners involved.

Following discussion, motion was modified recom-
mending the adoption of Amendment No. 21 pertain-
ing to the Land Use Element only and that the
applicable changes be made to Statistical Division
J, K, and L as proposed.
Community Development Director Hogan advised the
Commission to keep in mind the fact that unless
the new definitions to the text which may be
adopted were applied to specific parcels on the
map, there would be conflicts between the General
Plan text and the map.
Following further.discussion on the subject of
density throughout the City, the above motion

ing,to the City Council the adoption of the new
definitions of Low - Density Residential and Medium -
Density Residential and that the land use map be
revised to reflect the changes.
The motion was discussed in order to clarify the
intent because of the discrepancy which would
occur regarding maximum number of dwellings units
