THE NEWPORT BEACH CITY PLANNING COMMISSION; met
in regular session Wednesday, March 16, 1938 at
• 7:30 p.m. in the Council Chambers, City Hall;
Chairman Hopkins presiding.
Meeting was called to order by the Chairman.
The Secretary stated that this was a regular
meeting.
ROLL CALL - Commissioners present.: Hopkins,'Seager,
Williams, Briggs, Sohnitksr, Whitson,
and Findlay.
Commissioners absent: Patterson.
City Attny. Thompson, Bldg. Insp. Nelson and Mr. ,
Sampson attended.
MINUTES
Com. Williams moved that the reading of the
minutes of the meetings held February 16, 23 and
Burch 2 be dispensed with as all members had re-
ceived copies thereof, and that they be approved as
written. Seconded by Com. Whitson. Motion carried.
So ordered by the Chairman.
. HEARING -
REQUEST FOR VARIANCE
The application of Huston D. Hager for 50% front
yard variance on Lot 16, Tract 742, Balboa `Island,
was read by the Secretary. He stated that he had t
ken the liberty of advertising the hearing for '
arch 23, as the applicants were anxious to start
their building. -Com. Briggs moved to send this
matter to hearing to be held on March 23, 1938.
Seconded by Com. Schnitker. Motion carried.
So ordered by the Chairman.
The Secretary said he did not like to assume the
responsibility of calling all members into special
session as these applications are presented to him;
he asked for an expression of opinion by the com-
mission.
Com. Whitson said he did not like to meet every
week and knew the other members did not; the com-
mission would be meeting every night in an attempt
to accommodate_ all requests for variance between
now and the summer serson if definite time for
• meetings was not established. He moved that the
commission meet on the first and third Wednesday
of each month from now to the lot of July.
Seconded by Com. Briggs. Motion carried.
So ordered by the Chairman.

SECOND HEARING ON MAJOR STREETS TRAFFIC.MAP
( FINAL HEARING)
The.Chairman- stated that the purpose of this
map is to outline our major.traffie streets and
. to recognize the streets along which most of our
traffic travels; it in no way shows needed changes
or improvements of these streets.
The map was presented for inspection by the
commission members and anyone interested.
Chairman inquired if anyone present wished a
further discussion of this map. No response.
Com. Seager moved that the Traffic Map showing
major streets and highways be accepted as it is,
and that it be sent to the City Council with the
recommendation that it be adopted. Seconded by
Com. Whitson. Passed by the following Roll Call
voter
Ayes: Hopkins, Seager, Williams, Briggs,
Sehnitker, Whitson, Findlay.
Noes: None.
So ordered by the Chairman.
The Secretary stated that two more applications
for variances had just been handed to him; one
from Mr. H.L. Johnson for a front yard variance on
• his lot on South Bay Front, Balboa Island, and one
from Miss Gloria Gartz for front and side variances
on her lot at Grand Canal and South Bay, Balboa
Island. Both parties were present and explained
their plans and requests to the commission.
Com. Briggs moved that both applicants be granted'
hearings.at the meeting to beheld April 6th.
Seconded by Com. Findlay. Motion carried. So order-
ed by the Chairman.
FIRST HEARING ON REZONING OF CITY PROPERTY
PARCELS "A" AND "B" FROM R -3.and R -1 to G -1.
Secretary stated that the application had been
returned to the City Council with a request for
more information concerning the reasons for such
rezoning and that he application had not been
returned.
Chairman Hopkins said thatas the hearing had been
advertised for this date, it was the proper time
to discuss the matter and the commission might
proceed with the first hearing. He inquired of Com.
Whitson why the city wished to rezone this property.
Com. Whitson said that they want to sell Parcel
"B" but no one would buy it as long as it is zoned
as R -1.

before the commission and talk over their. plans.
Attny. Thompson_ said_that.the city plans to
sell it in one parcel as a possible trailer camp
site for which it is ideally situated. In that
• case, it will not be in oompetitXon with other
business of the city. Anyone wishing to build a
trailer camp must submit their plans to this com-
mission for approval.
Chairman said that °when the city makes the
Traffic Map official by adiption any building in
a 0-1 zone will come under the supervision of the
Architectural committee. Mr. Thompson thought the
Planning Commission mould have perfect control
over an. building erected on this Rroperty. '
Com. Whitson said that Parcel "A takes in all
the property where the squatters are and adjoins
the Public Camp grounds. Although the camp grounds
are a non - conforming use, the public and business
meat of the city want it maintained.
Secretary Seager moved that the application of the
City for rezoning of Parcels "A" and "B" city
property be sent to second hearing to be held April
6th. Seconded by Com. Briggs.
Before, putting the question the Chairman inquired
if anyone present representing the public in any
• way wished to speak on this matter. No response.
Motion carried. So ordered by the Chairman.
HEARING ON FINAL MAP OF TRACT 1006
(To be known as Tract 1026)
Final map of Tract 1026, new subdivision in
Corona del Mar was submitted for approval by Mr.
Woolley, representing the subdividers.
- Secretary read the letter sent-to Mr. Harris
requesting his cooperation in regard to deed res-
trictions to be placed on this property and re-
questing his presence to discuss the matter with.the
commission. He was not present.
Mr. Woolley explained that it was impossible to
divide Lots 26,28,30,32 and 34 so that they would
contain the required 6000 sq.ft. as the planning
commission had requested.
Attny. Thompson said the commission could not
approve the map unless the R -1 lots contained at
least 6000 sq.ft. As far as the deed restrictions'
are concerned, they mean nothing as far as the app-
roval of this map is concerned. This commission
has nothing to do with deed restrictions. He felt
that the owners would put the proper deed restrict
ions on the property in order to protect the value
of their property and make it saleable.
Chairman.HApkins_.said ha_would_like. the assurance
of the owners that they are going to restrict the
property so that it will not be possible for the `
•purchasers to build on the bluff. He felt that this
is a vital point as far as the public is concerned;
we should be sure that no houses will come higher'
than the bluff; this is a good chance to develop
something very unusual and pleasing arohitectually'
and if the subdividera.would talk things over tith`
the commission we might make suggestions that would''
be helpful.
Com. Whitson expressed the opinion that if they
meet all the requirements of the ordinance, they can
build anything they want and the commission can not
stop #hem.
Mr. Woolley said it would be physically impract-
ical to build on the bluff.
Chairman Hopkins said that the matter of the lots
size was broughtup before; he also stated that: the
ordinance requires 6000 sq.ft. in an R -1 lot in new
subdivisions and that does not mean theaverage area
of the lots is 6000 sq.ft. but that each lot must
be 6000 sq.ft. or over.
Mr. Sampson's opinion was that the ordinance
might be interpreted as allowing less than 6000
• sq.ft. according to Sections 10 and 11.
Mr. Thompson said his interpretation of the ordin-
ance was that 6000 sq.ft. was the minimum area all-
owed for R -1 zone, otherwise, we are doing away with
the purpose for which the ordinance was established.
The Ordinance says nothing about average size of
lots.
The matter of ingress and egress to the lots and
the proper drainage on the street shown on the map
wqs also discussed.
Mr. Thompson thought that the subdividers would be
sure of all these things because of the value of
the property. Mr. Woolley said that the street and
utilities have been passed by the City Engineer,
Chairman Hopkins suggested that Mr. Woolley make
the suggested adjustments in the map making each
lot 6000 sq.ft. or greater and over.eome_ the con-
dition of some lots being substantially, less than
6000 sq.ft. and present it for approval at the
next meeting. Chairman Hopkins called to Mr.
Woolley's attention that the matter of lot size
• deficiencies was discussed when the map was first
submitted and that a tentative approval was given
only because Mr. Woolley represented Ghat he would
make the adjustments so that no lot in the R -1 zone
would be less than 6000 sq.ft.

Chairman_ Hopkins also suggested that.it would prob-
ably be better_ that.the.map be_ resubmitted for _final
approval at next meeting on March 23rd, rather than
to have the commission go on record as formally
• denying the final approval at this meeting.
Mr. Woolley said he would make the adjustments
and submit the map at the next meeting.
Gom. Findlay said that he was glad to see a sub
division with large lots being opened in this dist-
riot and if there was any way the commission could
be lenient with the owners he would favor it.
Com. Schnitker moved that the matter of approval
of the final map of Tract lo26 be held over until
next meeting. Seconded by Com. Williams.
Motion carried. So ordered by the Chairman.
Secretary Seeger suggested that some action be
taken regarding the resolutions and recommendations
sent to the City Council by the Planning Commission
He said he would like a copy of the Action taken
by the Council on these resolutionsfor the comp let-
ion of the files.
Com. Sehiitker moved that the Secretary request
the.City Council to give him a certified copy of the
• action taken on resolutions submitted by the
Planning Commission. Seconded by Com. Whitson.
Motion carried. So ordered.
ADJOURNMENT
on motion of Com. Schnitker, seconded by Com.
Seeger, and duly carried, the meeting adjourned
to March 23, 1938 at 7;30 p.m. in the.Council
Chambers, City Hall.
