MINUTES OF THE PLANNING COMMISSION MEEETING. THURSDAY, MhRCH 20, 1952
BOLL Commissioners Present: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd,
CALL: and Wightman. Commissioners Absent: Pleger and Smith.
MI s Upon motion of Commissioner Rudd, seconded by Commissioner Reed, the min -
utes of the last regular meeting of February 21, 1952 Vera approved as sub-
mitted to the Commission.
USE PERMITS -
Application of W..B. jVth to permit construction of garage only on Lot 18,
Block 23, Balboa ESA, (1414 Balboa Blvd.) This lot faces Balboa Blvd., and
the owner also has the lot directly in front of this lot which faces the Bay.
The alley is a narrow ten foot alley and the garage is to setback 181.
Mr. Briggs explained the application to the Commission and stated that this
practice was very customary in that area. Would recommend that the Use Permit
be granted. Chairman asked if anyone wished to speak for or against the
application- -none.
Commissioner Copelin made a motion that the application be granted, seconded
by Commissioner Ellerbroek and carried by the following roll call vote, to -wits
AYESs Commissioners: Briggs, Copelin, Ellerbroeki Longmoor, Reed, Rudd, ik
Wightman.
NOES: None
ABSENT: Commissioners: Pleger, and Smith.
Application of'Cavital Company to erect sign board on top of the.new Bank of
America building in Newport. The sign is to be placed on top of the building
and will reach a height of 41! exseeding. the height limit by 61. Chairman
Longmoor asked if anyone wished to speak for or against the application.
Commissioner Copelin said that he couldn't see any reason why the application
couldn't be allowed.
Commissioner Rudd made a motion that the application be granted, seconded by
Commissioner Copelin and carried by the following roll call vote, to-wits
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd,
and Wightman.
NCESs None
ABSENT: Commissioners; Pleger, and Smith.
Application of J. J. Harrington applying for reduction in offstreet parking'
area required under Section 9104.21 (b) of the Zoning Ordinance. The Chairman
asked if.anyone wished to speak for or against.
--A. H. Powers was present representing the applicaht and explained the plans.
' According to the proposed building and ordinance, eight parking spaces are
required. They show eight, but two spaces are inaccessible. After considerable
discussion, Commissioner Copelin made a moti:,n thit the application be granted
subject to eight,speces being furnished and that the Building.Department see
that the applicant does not have any buildings that will keep these eight

spaces from being usable; also that final approval of the ... application be held
in abeyance subject to the approval of a committee on complete plans to be
submitted. Motion seconded by Commissioners Briggs and..carried by the follow-
ing roll call vote, to -wit:
AYES:: Commissioners: Briggs,.Copel.in, Ellerbroek, Longnoor., Reed, Rudd, &
Wightman.
NOES: None
ABSENT: Commissioners: Pleger, and Smith.
Application of the Sam company to place sign boand on Lot 6, Block P.
Tract 323, Corona del Bear N6P cor Jasmine & Coast Blvd).. Chairman asked if
anyone wished to speak for or against. Commissioner Copelin made a motion to
set over to next meeting and wait for action.on Foster - Kleiser appeal before
the City Council. Notion seconded by Commissioner Rudd.
Commissioner Briggs wished to deny this application now, thereby 'sticking to
our guns' adding emphasis to our previous refusal.
Roll call vote on above motions
AYES: Commissioners: Copelin, Reed, and Rudd
NOES: Commissioners: Briggs, Ellerbroek, Longmoor, and Wightman.
ABSENT: Commissioners: Pleger, and Smith
Motion lob#. Commissioner Briggs then made s motion that the application be
denied, seconded by Commissioner Ellerbroek and carried by the following roll
call vote, to-wit:
AYES. Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger, and Smith.
Chairman Longmoor asked if there was any further business relative to Use Pammits
to come before the Commission.
--Mr. Lacy, 402 40th St, Newport Beach. Present on behalf of Er. Carson, owner
of Lot 25, on Balboa Blvd,zoned for R-3. Has two.units on now, wants to build
a third, but under new ordinance does not have the are per #ni.t required. Wants
Use Permit to put third unit up. Chairman informed his that he would need a
Variance to get relief from the strict application of the ordinance in this par-
ticular case.
VARIANCES:
Application of Nelson Holmwood to permit a 12t setback instead of 201 on NYC side
of Lot 36, Tract 1136. Chairman Longaoor declared the hearing open and asked if
anyone wished to speak for or against the application- -none. No. discussion.
The Commission bad been up to look at.it and was familiar with it.
Commissioner Briggs made a'motion that the bearing beelosed, seconded by Commis-
sioner Wightman and carried. Commissioner Copelin said that the original sub- ,
divider had a ten foot setback on this lot because of it being a curved lot,
and the original map shows a ten foot setback, and thought applicant was per -
fectly justified in asking for it to be returnedtto the 101.
Commissioner Copelin made a motion that the application be granted, seconded by
Commissioner Rudd and carried by the following roll call.vote, to -wit:

Application of C. M. Sovde. Sr.., for a 50% Variance to permit a V frontyard
setback instead of required 101 on Lot 19, Block 4, Section TV. (122 Sapphire
Ave, Balboa Island).
Chairman declared the hearing open and asked if anyone wished to speak for or
against application. Chairman stated that he and Commissioner Reed had looked
At it. Is a one story building, owner desired to remove building and put up
new structure.
Commissioner Ellerbroek'made a motion that the hearing be closed, seconded by
Commissioner Copelin and carried. Commissioner Rudd then made a motion that
the application for Variance be granted on condition that the old building be
demolished and Variance applies to new building only. Commissioner Ellerbroek
seconded the motion and was passed by the following roll call vote, to -wit:
AYES:. Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger, and Smith.
Application of John F. Mab for a change in rear yard setback from 101 to 7P
on second story only on Lot 24, Block 21,. Section .Three, (112 Amethyst Ave,
Balboa Island.) Chairman Longmoor. opened the hearing and askd if anyone wished
to speak far or against.
«J. F.'Lieb, applicant, will in no way obstruct traffic. Two units on prop-
arty. Commissioner Ellerbroek said that it was customary on Balboa Island to
grant such requests.
Commissioner Copelin melds a motion that the hearing be closed, seconded by
Commissioner Briggs and carried. Commissioner Reed then made a motion that the
application be granted, seconded by Commissioner Wightman and carried by the
following roll call vote, to-wit-
AYES: Commissioners: Briggs, Copelin, Ellerbrosk, Longmoor, Reed.-Rudd, &
Wightman.
NOES: None
ABSENT: Commissioners: Pleger, and Smith.
AMENDMENTS:.
SECOND HEARING- Arthur 0. Hovey at al to rezone Lots 1 - 8, Block 329, Corona
del Mar & portion Block "D ", CDM from R-1 to R-2. Hearing was declared open
and asked if anyone wished to speak for or against.
Chairman Longmoor read -the Letter addressed to Planning Commission from Mr.
Hovey stating that it is entirely agreeable with him and applicants in allow-
ing a ninety day extension of time so that it will coincide with Resolution
of Intention initiated by Planning Commission at .last meeting to also rezone

additional property in that area from Rrl to R-2.
Commissioner Reed made a motion to continue the second hearing until the next '
regular meeting of the Commission. Motion seconded by Commissioner Briggs and
carried.
FIRST HEARING:- Resolution of Intention of Planning Commission to rezone.Blooks
3299 429, and 430.. Corona del Mar from present R -1 zone to R2.
Chairman declared bearing open and asked if anyone wished to speak for or against.
- -Mrs. Giddings, 95 A. Holliston, Pasadena, owner of Lot 17, Blk 329, spoke at
last meeting in regard to rezoning of North half..of Blk 329. Noticed on develop-
ment of Blocks 429 and 430 on Acacia & Carnation, almost 50% already developed
as $-2. Out of 11 on Acacia, 5 already had two units. On Carnation, out of 119
3 already developed as Rr2. Two units had units on rear of lots.
- -Mr. W. B. Bilger, owner Lot 13, Block 329, wanted to know who initiated the
change from R-2 to R-1. Chairman explained tMt the planning consultants in making
their survey had recommended the change as.in regard to the way the property was
being developed at the time of their survey.
- -Mrs. A. W. Fisk, San Bernardino:- Owns a lot in Block "Dan, wants four unit'
dwelling, Chairman explained application and Rea®lution o f Intention is to change
from Rrl to R -2, and if they desire R-4 on their property, would have to make
application for a change in ordinance.
Commissioner Reed made a motion that this first hearing be closed and set over
to the second hearing. Motion seconded by Commissioner Briggs and carried. '
SECOND HEARINGS- Application of Nelson Stafford at al to. rezone from R-1 to R-2
Lots 1 - 12 ine., Block 12, Tract 277 .Chairman opened hearing and asked if any-
one wished to speak for or against. Mr. Stafford was present and spoke for the
granting of the application. Considerable discussion with Commission.
Commissioner Copelin made motion to close hearing, seconded by Commissioner Reed
and carried.
Commissioner Copelin then madea motion that the hearing be continued until the
next regular meeting of the Commission and that a letter be.sent to Mr. Larry Wise
for an opinion as to whether or not you could attach an Use Permit stipulation to
an R-2 zone. Motion seconded by Commissioner Rudd and carried.
The Chairman asked Mr. Still ndto submit a letter to the Commission agreeing to an
extension of time of the application.
FIRST HEARING: Application of Griffith Comrans to change setbacks on 401 streets
to -0- setbacks from 4' & 101 setbacks to coincide with -0- setbacks on other 40,
streets on Lido Isle. .Chairman opened the'hearing and asked if anyone wished to
speak for or against. After considerable discussion, Commissioner Ellerbroek
made a motion to close this hearing and set over until second hearing, seconded
by Commissioner Briggs and'earried. Chairman asked Mr. Nelson to submit a map ,
for the hext meeting showing what application is about.

COMMNICATIONSs
Secretary Copelin read a letter from the City Council regarding Foster- Kleiser
' Company denial of their Use Permit applications to erect billboards. Commis-
sioner Copelin made motion that Chairman make art report and appear before
City Council at hearing April L,.th.
Chairman then, dictated a letter to be sent to the City Council asking that
a'map of the City be placed in the Council Chambers.
AWCURNMMS : There being no Rather business, Commission Nightman made a
motion to adjourn, seconded by Commissioner Rudd and carried.
