THE NEWPORT BEACH.CITY PLANNING COMMISSION met
in adjourned session Wednesday,. March.23, 1938
at 7:30 p.m. in the Council Chambers, City Hell;

Meeting was called-to order by the Chairman.
The Secretary stated that this was an adjourned
meeting from March 16th.
ROLL CALL - Commissioners present: Hopkins, Seager,
Briggs, Schnitker, Patterson.
Commissioners absent: Findlay; Williams
and Whitson excused.
B1dg.Insp.Nelson attended. City Attny. Thompson
was excused.
Before taking up the business of the evening,
the commission discussed informally the matter
of the variance application of Gloria Gartz with
her architects. She wished to amend her application
from a 50% front yard variance to a 60% variance.,
The Secretary stated that the application had been
published but could be republished as a corrected
notice. The architects asked if they could be assure
of the variance being recommended and were advised
that the cosmaission.could not e6mmit themselves
to any . promiseof - recommendation until.a hearing had
been held. If no one objected, the variance might;
be granted. Mr. Hyer said he knew of two of the
adjoining property owners who would not object.
Mr. Burlingame also appeared informally to secure
advice in regard to how to divide his property on
Abalone Dr. and Abalone Place, Balboa Island. He
was advised by Com.Patterson.that the best way to
subdivide this property was to make 3 parcels of it
and that each lot must have an area of 4000 sq.ft.

HEARING - APPLICATION FOR VARIANCE
Application of Huston D. eager, owner of Lot 16,
Tract 742, Balboa Island, for a 5ft. 50% front yard
variance was read by the Secretary. As stated that
the application had been properly advertised, post-
ed, notices sent and all the requirements of the or-
dinance complied with; it was now presented for for'
mal hearing.
Chairman Hopkins asked if anyone present wished
to speak on this variance; any objections to the
granting of this variance. No response.

The conditions.surrounding_ this lot were dis-
cussed by the commissioners.and...a_thorough_in-
vestigation..made:.by Mr_._.Nelson was reported by
Mr. Nelson.
• Com. Schnitker moved that Resolution No. 118
be adopted recommending to the City Council iat
Huston D. Hager be granted.a.5£t., 50% variance in
front yard requirements on Lot 16, Tract 742, Bal-
boa Island and that the same be transmitted to the
City Council by the Secretary and a copy be filed
as a part of the minutes of this meeting.
Seconded by Com. Briggs. Passed; by the following
Roll Call vote:.
Ayes: Hopkins, Seager,- Briggs, Sehnitker,
Patterson.
Noes: None.
So ordered by the Chairman.
FINAL MAP OF TRACT 1026
The final map fo Tract 1026 which was_to have
been discussed and formally.ae.ted upon at this
meeting was not -- presented by- Mr. _Woolley.
Com. Paterson reported that it had been presented
directly to the City Council- .and`had been approved
by them. The changes in the lots which were sug-
gested at the hearing on March.16th had been made
and all the R -1 lots contain 6000 sq.ft. He said
Mr. Woolley had informed him that according to law
it was not necessary for the Planning Commission to
approve the final map.
Chairman Hopkins advised the commission that the
map had only been tentatively approved at a former
meeting and that it was not the intention of the
commission to have approved the. map finally until
the map was once again before the commission.
No action was taken at this time. The Chairman
stated that as Mr. Woolley had decided not to bring
the map .before the Planning Commission the matter
rests without final action and approval.
DISCUSSION OF REZONING PROPERTY FOR BUSINESS
Chairman Hopkins suggested that hereafter when
proposals are made to rezone property for business,
the business men should be notified. He felt that
all business men should b.e interested in any changes
creating more business_ property. This also was
the opinion of.the Secretary.
Secretary asked Mr. Vogel if the business men
would appreciate notices in regard to changes in
zoning. Postcards could be sent to the officers
and chairmen of committees who could in turn notify
their members. He felt that the Planning Commission
should know how the business. men as.a_ whole _feel
about it.
Mr. Vogel said he thought they would appreciate a
postoard.notios. There are80O_ business licenses .
in the city and "it would be difficult for the
commission to notify them all.
Aar. Story said he thought we have enough property
zoned for business.
Mr. Hyer thought not only the business men but
the property owners are interested.
Com. Seager said that a rumor is circulating on
Balboa Island that a chain store is coming-in and
that lots are to be zoned for business to allow
the building of such a store. He felt that the
residents should have some assurance that the `Plan-
ning commission does not favor extention,of business
zones and moved that this Planning Commission go
on record as discouraging rezoning which will in-
crease business areas In Newport Beach. Seconded
by Com. Schnitker.
Chairman Hopkins said it is good planning to adopt
such a policy. If one corner is zoned for business
you are reglly__zoning all four corners of the Inter-
section according to law, and perhaps unwillingly,,
unintended extension of_a business zone is _made.
Cam. Schnitker said he was opposed to rezoning
any more land for business as we already have plenty
of business property.
The motion was carried and so ordered by the
Chairman.
MAP OF MAJOR TRAFFIC STREETS AND THOROUGHFARES
Chairman Hopkins informed the commission that the
City Council had not adopted the map of Major'
Traffic Streets and Thoroughfares at thier last m-
eeting. It had been ordered filed as they felt there
were other streets which should be added before
adoption. After discussion of this matter and
explanation by Com. Patterson, Com. Schnitker moved
that certain streets, namely:
Mira Mar Drive in Tract 518 between Central'
Avenue and Channel Road; Santa Ana Avenue between
Newport Blvd and 15th St; County Road from Newport
Blvd to 14th St; 12th.St from Old County Road to
San Bernardino Avenue; San Bernardino Avenue from
State Highway to 12th St; Ocean Drive from San
Bernardino and 12th Streets to Irvine Avenue; Tustin
Avenue from Ocean Dr. to 15th_St; Irvine Avenue
from Ocean Drive to 15th St; be made part of the
Traffic Map submitted to the City Council.as of
March 16th, 1938 and that the Secretary be Instruct.

ed to submit this.amendment to_the City Council.
Seconded_by Com. Patterson. Motion. carried.
So ordered by the Chairman. -
•, RIDING ACADEMY
Chairman stated that Com. Whitson had asked for a'.
discussion on the matter of a Riding Academy to be
located within the city limits. He wanted the
opinion of the commission regarding the use of land
for this purpose.
Chairman stated that he could not find such a use
mentioned by name in the ordinance, although other
classifications which are similar are<'not allowed.
He did not know whether a thing of that kind could
be opened up here or not; he felt that under strict
regulation a well -kept stable would be a fine thing
for the community to have access to-
Com. Patterson said that under the present con-
ditions with most of the surrounding property vacant
it might be possible to secure a conditional permit
if none of the adjoining property owners object;
that would be the best way to handle it.
Chairman said the ordinance could be, amended to
allow such a land use.
It was the opinion of the commission after gen-
eral discussion that since all uses of a similar
nature.were prohibited that a riding academy could
not be allowed.
PLANS FOR BUILDING TO BE ERECTED ON COAST HIGHWAY
Bldg. insp. Nelson submitted plans of a proposed
building to be constructed on Coast Highway for the
inspection of the commission. He stated that the
building is to be used for boat storage and a xplain-
ed the plans to the commission,
Com. Seeger moved that this matter be referred to
the Architectural committee with power to approve
or disapprove same. Seconded by Com. Briggs.
Motion carried. So ordered by the Chairman.
PLANS FOR SAFEWAY STORE
Bldg. Insp. Nelson submitted the plans for the
Safeway store to be constructed on the corner of
Washington St and Central Ave. Plans were examined
by the commissioners. Mr. Nelson said that they w&
wish to build to the lot line in the rear.
The Chairman_ thought that in business zones there
should be an area in whieh.to place.trash boxes,
etc. at the rear of the building. - They will have t
make formal application for _a_ rear _ yard variance
or else set back 5 ft.
PLAN OF PROPOSED CIRCULAR DRIVE ARID PARKING AREA
Mr. Story presented the plans and_artist.te design
of the proposed circular drive and parking area on
Ooear Front for inspection by_the commission. He
expl ined the drawings and stated that the idea
is t beautify the Ocean Front as well as to provide
perk ng space and allow for circulation fo traffic.
The street as shown on the map would run out 210 ft.
from the present side walk, and be 60 ft. wide.
The parking space would aocomodate approximately
480 are. The cost of the complete project is as-
tima ed at $40,000, the main cost being the bridge
and iaving of the street. It could be built grad-
uall , first putting in the parking area which is
so b sly needed and adding the other improvements
later, the idea is to provide space for the public
to_p rk and get the cars off the streets. This is
not definite plan, but only a suggestion showing
the iossibilities for added parking space and also
mkki g the front more attractive.
Coil. Hopkins asked if any thoHght had been given
to a nominal.charge.for use of the parking area.
Some of the expense might -be taken care of in this
way. If there.is_no restriction the public will come
in and t ake all the space., He thought the oommissio
• shou d go as far as.they'can to help the people who
are in permanent business here. We would have to
have a bond issue to provide money for such a
prof et.
Mr. Story said they were anxious to get started
on tie parking area at least so as to relieve some
of tie parking problem before summef.
Mr. Patterson advised_him.it would take 3 months
to pit in the street and parking lot.
Mr. Day said there would not be such a parking
prob em 3-# a time limit on parking were enforced.
Mr VogSl said the business mien. feel the. need of
some hing of this kind as parking.lota are getting
fewe and cost of renting them is prohibitive.
C irman Hopkins suggested that_the members of
the ommission_ give this project serious_ thought
as a mething should be done to help the parking
situ tion.
Corl. Seeger thought the commission.should express
thei appreciation-to Mr. Story for his efforts
in p esenting this plan and so moved.

PETI ION FOR REZONING
A etition was presented to the commission for
the ezoning_of the area lying between the Westerly
lin of 19th at and the Easterly line of 30th at.

and, he Northerly line of Central Avenue and the Bag
Fron not already included-in the M-1 district from
0-2 o M -1 so as to permit the _smoking of fish as
a ho a industry.
The commission felt that the petition went too
far s rezoning of this area would allow fish smok-
ing`n a wholesale basis. This is not the purpose
or desire of the applicants. The ordinance_ permits
home occupations and some provision could be made
to include fish smoking as a permissible home occup-
ation.
By common consent, this matter was laid over until
next meeting for action because it was felt that a'
satisfactory solution could be Pound in the meantime
it being the desire of the commission to encourage
this activity on a home industry basis.

Brigs and duly carried, the meeting adjourned.
