' THE NEWPORT BEACH CITY PLANNING COMMISSION met in reg-
ular session, Wednesday evening, March 26th, 1941, 7.30 P.M.
in the Council Chambers, City Hall, Chairman Johnson presid-
ing. Meeting called to order by the Chairman.
Commissioners -present: Hopkins, Seager, Johnson, Patterson FOLL CALL
Nelson.
Commissioners absent: Hall, Findlay, Estus, Allen
Minutes of meetings of February 19th and March 5th, 1941
were considered. Chairman Johnson called attention to a
discrepancy in the use of the word "elected" instead of "ap
pointed" in the last line of the 3rd paragraph of Page 2 of
the minutes df February 19th. Com. Hopkins moved that the
minutes be corrected and filed. This motion was seconded
by Com. Patterson. So ordered by the Chairman when the
motion carried,
Chairman Johnson called attention to Page 2 of the
'minutes of.'March 5th and suggested that the following par -'
agraph be added as the third paragraph under the heading,
'New Business' on Page 2: MINUTES
"Com. Hopkins :moved that the.Planning Commission snit -
late the necessary procedure for an amendment to Ord.
440, rezoning those lots on the Highway in Corona Del
' Mar which are not now Zoned C -2, from R -3 to 0-2. Com.
Pattersdn'seconded.,-Motion carried and so ordered."
Com. Patterson moved that the minutes of March 5th be
corrected with regard to.the rezoning of Coast Highway in
'Corona, Del Mar. Com. Hopkins seconded. Motion carried and
so ordered by the Chairman. Com. Patterson moved to approve
the minutes of March 5th, as corrected. Com. Seager second-
ed the motion. Motion carried. So ordered.
The Secretary read the.following communications: CC�MMUNICATIO
Letter from the Balboa Yacht Club requesting that the
restrictions regarding setback be suspended in order that
they might build as close to the property line, alongside
Bayside Drive; As possible. They further stated-that the
property is of such a size and shape that it will be impos-
sible to build according to present plans, unless the build -
ing is allowed to go very close to the property line..
After some discussion, it was brought out that the
property has not yet been surveyed: Sec'y_ Seager advised
that he had offered to meet with Mr. Boyd and help him
make out his application as prescribed in Ordinance 440.
Mr. Healy, who was present; stated that Mr. Irvine and sev-
eral of the Irvine engineers had met on the property in ques-
tion and paced it off. It is apparent, he advised, that
'there will not be much room as it is very narrow. Com. Pat-
terson moved that the Secretary advise the Balboa Yacht
Club that they send a sketch and more detailed information
so that we can have something to act upon. Seconded by Com.
Hopkins. The motion carried and was so ordered.
14 As Mr. Harvey was present, reading of communications was
suspended in order to take up the matter of the request of
NELLIE C. HAGER for a 50% setback, front yard, on Lot 21, Blk
4, Sec. 5, Balboa Island. Having been called to talk on the
_subject, Mr. Harvey stated that the main body of the house
is 10 ft, back, but that the porch posts, lattices and the
overhanging roof were in question at the moment. `Com. Patte
NELLIE C. HAGER som moved,tafter Secretary Seager advised that plane had
REQUEST FOR VAR -been posted and notices.sent to surrounding property owners,
LANCE. the adoption of Resolution No. 183 recommending a 50% front
yard setback'be granted Nellie C. Hager on Lot 21, Block 4,
Section 5, Balboa Island and that the same be transmitted to
the City Council by the Secretary advising that it was recom-
mended by the Planning Commission and that a copy be filed as
part of the record. Seconded by Secretary Seager. The Chair-
man called for a Roll Call vote.
Roll Call: Ayes: Patterson, Hopkins, Nelson, Seager,
Johnson,
Noes: None.
Motion carried and so ordered by the Chairman.
COMMUNICATIONS

Chairman Johnson made a motion to resume the regular or-
der of business. Seconded by Com. Hopkins - Motion carried.
Letter from'Dr. Flagg of 10365 Fairgrove Ave. Tujunga,
California inquiring if the State Highway property in Corona
Del Mar, `Lots 1Z -5U and 4U had been zoned for business. ,
Letter from Planning Commission of Orange County, Calif:
which, before reading, Seely Seager stated we should consider
very carefully. The letter concerned the future development
and protection of Orange County beaches and requested the
co- operation and help of various bodies, boards, committees,
engineers, park and recreation experts and others who can
help in offering suggestions that may be used to" evolve a
final master plan of beach protection and development. Com.
Seager stated that he had attended the'Orange County Coast
Association meeting and a preliminary master plan.was present-
ed. He advised that he had suggested to Harry Welch, Seely.
of the Orange County Coast Assn, that they Communicate with
the Newport Beach City Planning Commission and suggest a com-
mittee of five, to be composed of two members from the Planning
Commission, a member suggested by the Chamber of Commerce, a
member from the Orange County Coast Assn, and a citizen at
large ,so that each committee will be representative of each
community. 'Secretary Seager stated that Com. Patterson's name
_was mentioned but that he suggested Coma Patterson be left off
of the committee as he would undoubtedly be a Consultant of
both our Committee and the Orange County Planning Aes'.n, as he
probably posaessee more knowledge of beach erosion than any
other man in the Bounty. Secretary Seager stated that Mr. Welch
approved of the suggestion. He further stated that he had re-
quested Willis Warner tb provide us with a preliminary master
.plan but that it had not arrived.
Com. Hopkins made a motioV that in accordance with-the
request of the Orange Co. Planning Commission, a committee of
five in the community* be appointed by-the Chairman of the '
Planning:Cbmmission and further, that one member be a men
ber of the Orange Co. Coast Ase'n; that a second member 1%
a member of the Chamber of Commerce, that a third and fourth
member be appointed from the citizenry in the County, outside
of Newport Beach. This motion was seconded by Seely. Seager
Motion carried and it was so ordered.
A letter from Mrs. Georgette L. Maxwell suggesting the
establishment of a zoned center for amusements if located in.
a section more accessible to transient crowds and away from
the residential areas in connection with the rewriting of the
new ordinance. Com. Seager moved that Mrs. Maxwell's letter CO
be filed. Seconded by Com. Nelson. Motion carried.
A letter from Orange County Planning Commission dated
3/10/41 enclosing a copy of an amended tentative map of a
proposed tract to be located on Coast Highway, outside of the
city limits, and a further letter from the Orange Co.Planning
Commission with a further amended tentative map of the propos-
ed tract - this letter dated 3/14/41. Com. Seager stated
that the map is misleading in that water and sewerage are not
- available as indicated and.that it is deceptive in that.it
does not state that the water lines belong to the City of
Newport Beach. After some discussion, Com. Hopkins moved that
the Secretary be instructed to forward a protest to the Orange
.CCuhty Planning Commission that the map does not show adequate
sanitary conditions having been made for the tract and that
the attention of the Orange County Planning Commission be call-
ed to the fact that the map is misleading and even deceptive in
that water and sewer lines shown on the map, are not available
to the prospective owners. Com. Seager stated that the necess-
ary.arrangements have.not been made to make these utilities
.available to this property so as to provide adequate sanitary
_facilities. Com. Patterson stated that further grounds for
protest would be that the triangular shape of the lots at the
northerly edge of the channel to be dredged, make them unde-
' sirable..Com. Nelson seconded the above motion.
After some discussion on the above.sub,ect, Com.Hopkins
withdrew his second in favor of Dr. Seager's motion which was
that the tentative map, as submitted not be approved and it's
recommendation to the Board of Supervisors be protested and
that the protest as written by a Committee of three members
of the Commission. He suggested Com. Hopkins as one of the
members. Com. Patterson seconded this motion. Motion carried_
and so ordered by the Chairman.
A letter from Al Anderson of the Balboa Fun Zone request
ing the Fun Zone Block in Balboa be rezondd to permit a shoot-
ing gallery license. Secretary Seager stated that this letter
was addressed to the City Council and referred to this body
by them. Secretary Seager moved that the Secretary be instruct-
ed to communicate with the City Council acknowledging receipt
of this letter and conveying to the City Council the opinion
of the Planning Commission that to so zone that block would
be very poor planning, not in conformity with conditions de-
sirable in the nighborhood. Com. Hopkins sedonded. Motion
carried and so ordered.
Letter from W. T. Jefferson of 212 Ocean Blvd. Corona
Del Mar. dated 3/10/41 requesting that he be advised of future
developments indicate that the 10' setback along the souther-
ly frontage of Ocean Blvd. is to be eliminated. With his let-
'ter, Mr. Jefferson enclosed a copy of letter sent to John
Harris of Properties, Inc., on the same date. Com. Patterson
moved that the Sec'y be instructed to answer this letter using
his own discretion. Com. Nelson seconded. Motion carried and
so ordered.

Com. Seager stated that a citizen had approached him

wanting to know if he.could get a permit to build a miniature
golf course on the corner of Marine and Park Avenues on Balboa
Island. On being told that the 0-1 Zoning prohibited the con-
struction of amusement resorts, he replied that since the
City Council had nullified C -1 Zoning as it applies to Karin
Avenue, might it not be possible to get a permit at.this tim
He requested Secretary Seager to bring the matter before the
Planning Commission. Com. Patterson moved that the Secretary
request an opinion from the City Attorney in writing. Com.Hop-
kins seconded the motion. Motion carried and so.ordered.
FIRST HFA RING ON I The matter of the proposed amendment on the Rezoning
REZONING OF COAST of Coast Highway in Corona Del Mar was called for hearing.
HIGHWAY It was discussed by the Committee. There were no protests re-
CORONA DEL MAR ceived by mail and no protestants appeared in person. Com.
Patterson moved that the matter be ordered for.a second hear-
ing at the next meeting of the Planning Commission. This motion
was seconded by Com. Hopkins. Motion carried and so ordered.
Com. Hopkins stated that the suggestions of the City
Attorney were so much in variance with the ideas of the Planning
Commission regarding the proposed new ordinance, that he would
suggest that the Planning Commission attend the Council Meeting
in a body to protest on Monday evening, March 31st, 1941.
Com. Hopkins moved that the meeting.adjourn to next
ADJOURNMENT_ Monday night, March 31st, 1941 at 7.30 P.M. to meet with the
City Council with regard to matters bearing upon the.new ,
ordinance. Com. Patterson seconded. Motion carried. -
