Location: Lots 29 and 30,.B1ock 18; Tract B located at 109, 111 and 113 - 18t Street, at the southwest corner of Balboa Boulevard and 18th Street. Zone: R -3 Applicant:. Lenon I. van Torne, Riverside Owner: Same as applicant Planning Director Wilson presented the applica- tion to the Commission and stated that after receiving a copy of the department staff report, the applicant submitted written comments re- garding the recommendations of the staff, a copy of which had been given to each Commissio er • at the afternoon study session. Request to subdivide parcel for purpose of creating a site for a car wash. Commission. After a discussion, the application was Motion x approved, subject to the following''conditions: Second x All Ayes 1. That a parcel map be filed. 2. That approval of this tentative map shall be null and void if a parcel map is not recorded within one year from the date of approval of the tentative map. 3. That all improvements be completed as required by ordinance and the Public Works Department. 4. That the full width of the north /south streetbe dedicated.and improved. 5. Zone: C -1 -H Applicant: Ali Roushan, Newport Beach Owner: Balboa Bay_C1ub, Newport Beach Mr...Roushan was present at the meeting and answered questions of the Commission, especial 'He y regarding a 24 hour operation. stated that he wanted to establish a service center and wanted people to know that it would be open at night. He also stated that there would not be any boat trailers parked on. the premises overnight. USE PERMY, Request to permit wine to be served in connec- 473 tion with a bonafide eating establishment. APPROVED Location: Lot 2, Block E, Tract 323, located at 2721 East Coast Highway on the southerly side of East Coast Highw y between Fernleaf Avenue and Goldenrod Avenue. Zone: C -1 Applicants: Suzanne Megroz and Mireille Clave, Laguna Beach Owner: Arvo Haapa, Corona del Mar Planning Director Wilson explained that this is an existing nonconforming use because no off- street parking is provided. The Municipal Cod allows a use to continue at the same size with- out off- street parking, however if the seating capacity were increased it would create a prob- lem.as to the expansion of the nonconforming use. Miss Mireille Clave was present at the meeting and stated that the present operators of the restaurant use tables in the patio during the summertime and they intend to continue this practice. She further stated that the seating capacity.would not be changed. Mr. Earl Freeman Kick, the present operator of the restaurant, spoke in favor of the applica- tion and stated that as far as he knew, chairs had been used on the outside for many years, The application was approved. Bren Company, Sherman Oa <s Owner.: The Irvine Company, Newport Beach Mr. Robert Bein,.engineer, and Mr. Harry Merri 1 of the Bren Company were present at the me.etin and answered questions of the Commission. Mr. Merrill displayed a rendering showing the accepted park and the proposed park. The Commission expressed some concern as to the narrow width of the proposed park and the placement of the pools and recreation area in relation to the residences. In reply to a question, Mr. Merrill stated that the recrea- tion area will not be open at night, that 520 homes will have the use of the pool, and that there will be two different community associa- tions. During the summer months they have a. man in attendance at the pool from 9:OO A.M. until 5:00 P.M. Mr. Bein stated that MacArthur Boulevard would • be improved from the entrance to this tract to San Joaquin Hills Road; when completed it will be possible to drive from Ford Road to San Joaquin Hills Road. The Commission also expressed concern about two streets with the same name (MacArthur Boulevard) running parallel to one another. Both Mr. Bein and Mr. Merrill agreed and said they had no objection to a street name change and asked for suggestions. After further discussion, the final map of Motion x Tract 7030 was approved subject to the follow - Second x ing conditions: All Aye 1. Completion of the.remaining appli- cable conditions of approval as established for Tentative Map No. 6938. 2. Decision regarding public or private status for park area abutting Tract 7030 on the west. • 3. That the previous conditions of approval numbers 12 and 13, of Tentative Tract 6938, regarding realigned MacArthur Boulevard be modified as follows: Page 5., CITY IF NEWPORT BEACH A ril 2, 1970 COMMISSIONERS 12. That the half -width of realigned MacArthur Boulevard be dedicated and improved southwesterly of the tract to a connection with San Joaquin Hills Road. 13. That the half -width of realigned MacArthur Boulevard adjacent to the tract be dedicated and im- proved; with the improvement of the southerly pavement transition area being accepted as fulfilling the developer's obligations in lieu of the permanent improve- ments adjacent to the southerly portion of the tract, except that the developer shall complete the curb and sidewalk. Item 6. EXTENSION Request for extension of a previously approved VPjIkANCE variance permitting additions to an existing N 54 nonconforming building. Location: Lots 19 & 20, Block 14, Balboa Island Tract, located at 1407 Nort Bay Front, Balboa Island, on the south side of North Bay Front, between Marine Avenue and the Grand Canal. Zone: R -2 Applicant: Mr. & Mrs. George'Newton, Balboa Island Owner: Same as applicant Mrs, Newton was present at the meeting and after a discussion, the application was ex- Motion x tended for a period of one year. Second x All Ayes Chairman Jakosky appointed the following Commi - sion members to serve on the local study com- mittee to work with the State Division of High- ways on planning for the route 57 (Orange) freeway: William B. Martin Dr. George W. Brown, alternate Page 6. CITY OF NEWPORT BEACH ,h April 2, 1970 COMMISSIONERS 10,11, and the following Commissioners to serve on the City's Project Task Force in connection with the comprehensive planning study for the Upper Newport Bay area: Curt Dosh Gordon. Glass, alternate.. Commissioner Adkinson stated that it would be helpful if the Commissioners were advised of all items appealed to the City Council prior to the Council meeting. A discussion ensued in which an opinion was expressed that if conditions imposed by the Con- mission on such iterrls as tentative maps are changed by the City Council, the matter should be referred back to the Commission. Chairman Jakosky reminded the Commissioners that the Commission is only a recommending body in certain instances and hopefully the Council . will abide by its recommendations, but they may choose not to. The Commission discussed adding a.cover sheet to the agenda advising applicants that the Commission will adjourn at 11:30'P.M. and any items not heard by that time will be held over until the next meeting: This cover sheet should also advise persons attending the meet- ing of -the availability of staff reports in the Council Chambers and of the 15 day waiting period before an application becomes final, during which time the decision of the Planning Commission may be appealed to'the City Council On motion of Commissioner Brown- seconded by Commissioner Adkinson,.and carried, the meetin was.adjourned.
