Zoning Administrator Hewicker explained that this amendment proposes a minor adjustment in the resi- dential densities of -Areas 4 and 5 which will result in a net reduction of 138 dwelling units and a population decrease of 55 persons. It was noted that while the statistical reductions are minor, there would be a significant change in.visual im- pact, especially.from San Joaquin Hills Road,. created by the change from apa.rtments.to attached single family dwellings. Mr. Hewicker also re- viewed the requested changes in text relating to setbacks,.noting that flexibility in calculating the front and rear property lines are common with the golf course or other forms of permanent open space. Zoning Administrator Hewicker presented the applica- tion to the Commission. Mr..Abel.Lopez, Engineer for the Humble -Oil Company, was present and answered questions of the Commission. He stated that the suggested conditions of approval are acceptable but there were questions regarding signs and the interior orientation of the service bays. With respect to the service bays, it was felt that an interior.orientation would be a security Problem and give the impression that the station was closed. Regarding signs; Mr. Lopez stated Humble Oil does not use large signs on their.buiIdings, only the "Humble" sign:and' "Happy Motoring" which are under 18 sq.ft. in area, therefore they would like.to retain the existing 72 sq.ft. free standing sign now on the property in lieu of the 50 sq.ft. (each face) recommended by the staff. The Commission discussed these matters and felt that the conditions as outlined met the concept x for service stations in Newport Beach;.therefore X approval was recommended subject to the following conditions: Page 3. Lubrication of motor vehicles. D. Sale and installation of batteries and minor automotive accessories. E. Sale, mounting and repair of tires. F. Auto washing and waxing when done entirely within a building.but not including any automatic or self service car wash. G. Motor tune up service, the sale, re- placement, and installation of brake shoes, cylinders, and minor replace - ment.brake parts, and air conditioning service. There shall be no major engine and transmission overhaul or repairs, nor shall there be any upholstery work, glass replacement, painting, welding, . • dismantling or body and fender work. 2. This service station shall not be operated in a.self- service manner. No sale, lease or rental of items, eog., trailers, trucks, toys, peat moss, dolls or other items not clearly incidental to the automotive in- dustry, shall'be permitted. Soda pop, candy and cigarettes may be sold via dis- pensers if such dispensers are housed within a building and are not visible from the public rights -of -way. 3. All tires, oils,.additives and other auto - motive items shall be housed within the main building. No outside displays of merchandise of any kind shall; be permitted, except as provided under Item 5 -13. 4. There shall be no flags, banners, spinners, streamers or other attention - attracting devices permitted at any time on the site. 5. A maximum of two signs, not exceeding 100 square feet; shall:be permitted on the main • building:. In addition, one sign not ex- ceeding.50 square feet (each side) may be permitted in a freestanding location subject to.approval.by the Community Development Page 4. No rotating flashing or animated signs shall be per - mitted. A. One price sign not to exceed 3' x 4'. shall be permitted. Said sign.must be approved by the Community Develop- ment Director insofar as materials, colors and location are concerned. B. On reasonable sized outside tire rack . shall be allowed, subject to.the approval of the Community Development Director. 6. All outside lighting shall be so arran9ed and shielded as to prevent any glare or reflection, and any kind of a nuisance; in- convenience.and.hazardous interference on nearby property or streets.: No direct illumination sources shall be visible from adjacent properties or public rights -,of -way 7. A detailed landscaping plan shall be sup - mitted to and approved by the Community Development- .Director: Such plan shall include the names•of all. plants, container size, spacing andthe irrigation; system' proposed. Adequate trees shall be included to screen the station from nearby residen- tial development..' All landscaping shall be installed in. accordance with the approve plan and shall be permanently maintained in good condition. 8, All landscaped areas shall be separated from paved areas.,by a concrete curb 6 inche higher than the adjoining paving. 9. All utilities serving the site shall be installed underground.. 10, The entrance to the service bays shall be from the interior of the lot and the front elevation shall:be redesigned accordingly. • 11. The development shall comply substantially with the plans filed with the application, and shall comply specifically with these - conditions of approval: Page 5. No delivery tanker shall be permitted to park on public rights -of -way during gasoline delivery. 14. A total of 17 off - street parking spaces shall. be required. 15. The Commission may require the construc- tion of six foot high decorative walls utilizing materials similar in color, texture and module to those used on the building, at such time as the property adjacent is proposed for development by virtue of a building permit. Such walls shall be.reduced to not more than 3 feet in height within 20 feet of the street property lines. Such walls need not be erected when building walls already exist • on the property lines. 16. Appropriate street widening shall be pro- vided as required by the Community Develop- ment Department and Public Works Depart- ment. 17. The Planning Commission shall reserve the right without.necessity of further hear- ings to require or to allow minor modifica- tions of any of the foregoing conditions or the working drawings if such modifica- tions will achieve substantially the same results and will in no way be detrimental to adjacent properties and improvements than will the strict compliance with said conditions and preliminary plans. 18. A resubdivision map shall be recorded, showing the entire service station site as one parcel, together with any adjacent remaining portions of Lots 80 and 81 of Tract 706 and all easements and rights -of- way of record appurtenant thereto. PERMIT' N0. 523 Location: Portion of Block 50, Irvine's Subdi- vision, located north of Palisades. APPROVED Road, west of Jamboree Road and MacArthur Boulevard and southeasterl of Birch Street. Zone: P -C Applicant: Emkay Development Company, Inc:, South Gate Owner: Same as applicant. Zoning Administrator Hewicker presented the applic - tion to the Commission and explained that the sign would.be located at the four corners of the Emkay property. Mr: Bill Kraft -of Langdon & Wilson, Architects, displayed a model showing the relationship of the signs to the site. He explained that these were identification signs for the entire project and not for any particular building. After a general discussion, the application was x approved subject to the following conditions: X 1. The sign text pertaining to the architect and contractor shall be deleted. 2: The signs may be illuminated subject to plans approved by the Director of Commun- ity Development. 3. This permit shall extend for a period of time not to exceed two years from date of final determination of this applica -: tion. 4. Zoning.Administrator Hewicker explained that this is the initial map filed in connection with Tenta- tive Map of Tract 7382 (The Newport Project) and represents the first unit to be developed. The final map as submitted has been checked with the approved tentative map and found to be in complete compliance therewith. x After a short discussion, the Final Map of Tract x No. 7394 was recommended to the City Council for approval subject to the conditions of approval applied to Tentative Map Tract 7382. P-RMIT NT--T'5r25 Location: Lot 6, Block 8, Seashore Colony Tract, located at 207 Orange Street WITHDRAWP on the west side of Orange Street, north of West Coast Highway and sout of the extension of Newport Shores Drive. Zone: C -1 -H Applicant: Patrick O'Connor, Newport Beach Owner: Mr. & Mrs. S. Beniche; Los Angeles These applications were withdrawn at the request of the applicant, who submitted a letter from Mr. Raymond Putnam; owner . of the intervening parcel (Lot 7, Block 8, Seashore Colony Tract) X stating his support to rezone Lots 6, 7 and 8 to an R -2 District. The Commission moved that the x_ filing fees for Use Permits 1524 and 1525 be applied to a zone change application. Item 10. Request to permit two duplexes to be relocated on two C -1 lots, and one duplex constructed on a third contiguous C -1 lot. Zone: C -1 Applicant: Earl G: Corkett; Balboa Owner: Edward Gold, Glendale Zoning Administrator Hewicker explained that the applicant was proposing to move two existing duplexes from the expansion area of the Newport Harbor Yacht Club parking lot to two C -1 lots in the 500 block of West Balboa Boulevard and, in addition, to construct a duplex, similar to the two existing — structures on an adjacent lot. COMMISSIONERS A 6 0 0 f w � > w OCALL CITY OF NEWPORT BEACH April 15, 1971 MINUTES INDEX Mr. Richard Brown, attorney, represented the appli- cant and stated that the proposed change would greatly, improve the appearance of the property. It was noted that the duplexes which are to be moved will be completely refurbished and redecorated. There was a discussion regarding rezoning the enti.e frontage between 6th Street and Island Avenue to the R =2 District so as not to leave commercial zoning in the middle of the block. With respect to the laundromat, Mr. Brown stated that the tenant of the laundromat and abandoned service station was on a month to month lease. Mr. Rembert Ray, the owner of the laundromat on th subject property, addressed the Commission and staled he has consulted an attorney and has been informed that he has a valid lease on the property. In addi- tion, he referred.to petitions of opposition to this proposed change which had previously been sub • mitted to the Commission, one signed by business the area (4 signatures) d people.in and another sign by residents (69 signatures). Mr. John Meurs, who owns the adjoining property, lots 17,18 and 19,.the site of Bill's Market, spoke in opposition stating that this property has been commercial for at least 50 years and that., people walk to the other shops while their laundry is being washed. Mr: Jensen, another neighbor., substantiated Mr. Meurs statements. Mr. Brown noted that they do not.want to interfere with the operation of Bill's Market or the other businesses in the area. However, the condition of the subject property is extremely unattractive and this is an opportunity to improve it. Motion x After a lengthy discussion, Commissioner Adkinson Second x made the following motion: "Without commenting on Ayes x xx x a change of zone, the subject corner is one of the Noes xx x most unsightly areas on the peninsula and therefore I move that Use Permit No, 1526 be approved, sub- ject to the following conditions: 1. That all driveway approaches on West • Balboa Boulevard and Island Avenue shall be replaced with standard curb, gutter and sidewalk in a manner meeting the approval of the City Engineer. Zoning Administrator Hewicker presented the pro- posal to the Commission and explained the feelings of the Modifications Committee. Mr. Hewicker note further that since the staff report was written another plot has been submitted to the Depart .plan ment indicating a similar treatment on 21st Place between Mr. Rapp's property and the Alley West on the Ocean Front. Mr..Stan Kohlenberger, architect, representing Mr. Rapp, answered questions of the Commission and the question of a Mall was discussed. City Engineer Nolan addressed the Commission at length as to the use of this particular alley and minimum setbacks desirable. He stated that the concept of a pedestrian mall would be quite work- able from Ocean Front to the intersecting "T" alley but not beyond that point. It was explained: that in order to accomplish this the Council would have to determine that the right- of- way.is -no long (r needed for vehicular use. Mr. Rick Lawrence, owner of the Alley West,.spoke in favor of the pedestrian mall stating that the Page 11. He stated further that he is willing to contribute his share of money to develop it. City Engineer Nolan stated he shared Mr. Lawrence' enthusiasm, however, the interests of the people facing on the 9 foot alley extending westerly from 21st Place should be.considered. The Commission questioned Mr. Rapp as to whether he would be willing to contact the property owners involved to determine if they are in favor of this concept.. Mr. Rapp replied that it is almost im- possible to get all of the property owners togethe at one time and asked if the Assistant City Attorn would prepare a document that he could take to eac one: The Commission also asked the Assistant City y Attorney to check the law regarding definite pro- cedures for creating pedestrian malls. x Pending the outcome of these inquiries, the appli- cation was continued until May 20, 1971. Commissioner Glass noted that some staff reports have not been getting to the Commission on time be-, cause of-late submittals.
