Foley Helen Herrmann On motion of Commissioner Glass, seconded by Commissioner Watson, and carried, the minutes of April 16, 1970 were approved. Item 1. VA ANCE Request to permit a reduction in the number of Ego 88 parking spaces required for the Newport Arches Marina property in order to provide drive -up HELD OVER television banking facilities for the Centinel Bank in the parking lot. UNTIL MTT71 Location: Portion of Lot 170, Block 2, Irvine's Subdivision, located at 3333 West Coast Highway, on the south side of West Coast Highway between Newport Boulevard and Riverside Drive. Zone: C -2 Applicant: Centinela Bank, Inglewood Owner: City of Newport Beach and .County of Orange Mr. Gene Bothwell of the Newport Arches Marina was present at the meeting and asked that the application be set over until May 21st as they, have a meeting scheduled with the Building Director and State Division of Highways and hope to have more information available after . that _time. AMENDMENT Request to permit the sale of alcoholic bever- ages (beer only) in conjunction with an exist - TO USE PERMI ing theatre. Location: Lot 22,.Block 225, Section.A, NO. 1116 APPROVED Newport Beach Tract,..located at 2815 Villa Way on the west side of Villa Way between 28th Street and 29th Street. Zone; M -1 Applicant: Open End Theatre Workshop, Newport Beach Owner: Alice Emmes,.Costa Mesa Mr. Foley explained that the applicant was pro posing to present a melodrama during the summe months, removing the theatre seats and re- placing them with small tables and chairs. Mr. Walter Phelps, President of the Open End Theatre Workshop addressed the Commission and stated they are trying to attract the tourist business with this informal melodrama producti n. They have always served coffee but would like to serve beer and packaged food. In the fall, they intend to replace the theatre seats. After discussion, the Commission approved the Motion x application subject to the following condi- Second x ti.ons: All Ayes 1. All furniture and sets to be stored inside the building. 2. Seating and plot plans to be approved by the Fire Marshal and Building Depart- ment. 3. All laws concerning the sale of alco- holic beverages to be strictly observed 4. Balboa Blvd., on the north side of East Balboa Blvd , between "A" Street and Main Street Zone: C -1 Applicants: Bruno H. Moeckli and • Hermann 0. Figge, Balboa Owner: Robert G. Andrews, Costa Mesa Mr. Foley explained that the current use permit No. 1418 permits the sale of beer and dancing to recorded music. This application would permit live entertainment in place of the recorded.music. Mr. Hermann Figge was present at the meeting. Mr. John Egus of 1202 E. Balboa Boulevard aske that the live entertainment be clearly defined and Mr. Figge replied that it would be limited strictly to live music. Commissioners,.Glass, Dosh and Watson stated that this location had had live music since the 1940's and felt that this was a reasonable. request. Chairman Jakosky closed the public hearing and Commissioner Adkinson stated that he felt it would be a mistake to increase the use to permit live entertainment as once this type of • use is permitted it seems to go on and on, therefore, he recommended denial. Zone: C -1 Applicant :. Harry Alexon, Newport Beach Owner: Same as applicant. This application was continued until May 21, 1970 at the written request of the applicant. 'I 5. USE PERMIT Request to permit construction of a fire station. N0. 77 APPROVED Location: Portion of Block 800, Tract 6015, located in Newport Center on the north side of future Santa Barbara Avenue approximately 300 feet east of Jamboree Road. Zone: C- O -H -UL Applicant: City of Newport Beach Owner: The Irvine Company, Newport Beach Mr. James P. DeChaine, Assistant City Manager, represented the City and explained that the size of the building has been reduced approx- imately 1000 sq.ft., however this does not materially alter the plans. This will be a two company station with 4 bays. Construction will probably begin within the next two months and the facility should be completed by May 1, • 1970. SIGN N0. 283 Location: Portion of Block 800, Tract 6015, APPROVED located in Newport Center on the north side of future Santa Barbar Avenue approximately 300 feet east of Jamboree Road. Zone: C- O -H -UL Applicant:. City of Newport Beach Owner: The Irvine Company, Newport Beach Mr. DeChaine represented the City on this appli- cation and upon being questioned as, to whether the property is being purchased or'leased, replied that a purchase agreement will be sub- mitted to the City Council for approval on May 25, 1970. The application was approved subject to the Motion x following conditions: Second x All Ayes 1. That a parcel map be filed. 2. That all improvements be completed as required by ordinance and the Public.Works Department. 3. That Santa Barbara Drive:be dedi- cated and improved to a` connection with Jamboree Road: Item .7.. VARIANCE Request to permit the addition of a second story duplex apartment to an existing dwelling N0. 990 on a lot having 1680 sq.ft. of area where the APPROVED ordinance requires 2000 sq.ft. and to permit an outside stairway to encroach into the re- quired side yard setback. Same as applicant Mrs. Burns and her attorney, Anthony J.,Ward, .were present at the meeting. Mr. Ward pre -. sented a diagram to be distributed to the members of the Commission. Upon being questioned as to whether they had reviewed the staff report, Mr. Ward replied that they had and that they could not reasonab y comply with the technical requirement of the last paragraph (that the garages be brought into compliance with the Code}. This would make the remodeling impossible. Item 8. VARIANCE Request to permit an observation area above th second floor level. Zone:. R -1 Applicant: Mrs. A. W. Colby, Pasadena Owner: Same as applicant Mrs. Colby's son -in -law, Rev. Ralph Parks, and her architect, Mr. Remington, were present at the meeting. Mr. Remington passed around photographs showing to what extent the work on this project had progressed. Chairman • Jakosky inquired whether they were aware of so e of the letters the Commission had received and receiving a negative answer, handed the letter to Rev. Parks stated that the information contained in the letters was incorrect as they do not desire to have a third story, only an observation area. The Commission advised him that under the terms of the zoning ordinance this would have to be considered a third story and it would be to his advantage to wait 6 weeks in- asmuch as the Commission is considering amend- ing this portion of the ordinance. Rev. Parks inquired as to what extent his work could progress and the Commission advised him to meet with the Building and Planning Depart- ments. After considerable discussion, the application was set over until July 16, 1970. I 9. The Commission considered a request from Mr. 7'— J. L. Boggs, 3107 Glendon Avenue, Los Angeles, for a determination as to whether or not an enclosed area at the third level of a proposed dwelling at 223 Abalone, Balboa Island, con- stitutes a third floor. Mr. Nuzum explained Mr. Boggs proposed plan and Mr. Boggs,, who was present at the meeting, displayed a.madel of the proposed duplex. The Commissi.on.complimented him on his plan an advised, Kim i.t would be to his advantage to w.ait.unti.l the ordinance is amended with - r-espe-ct to the definition of "mezzanine" and "story ". Mr. Boggs was,-asked to'check with the Planning Department `in 6 weeks as to the current status of the ordinance. Item.10. The Commission considered and approved a one year extension, or until May 26, 1971, for the Motion Second x x submittal of the final map of Tract 6947 All Ayes (Park Newport) at the request of Mr. Robert W. Bein, President, Raub, Bein, Frost & Associate . It* 11. The Commission considered a request from the Irvine Company to substitute six automobile parking spaces for yacht marina within parking Page 7. CITY OF NEWPORT BEACH Mav 7. 1970 COMMISSIONERS .. N 3 area adjacent to the southeast corner of Bayside Drive and Marine Avenue (1137 Bayside Drive), in lieu of six automobile parking spaces withiii parking area southwest of Bayside Drive, approx- imately 400 feet northwest of E1 Paseo (1135 Bayside Drive). Mr. James E. Taylor represented the Irvine Company and explained that this change would save a grove of trees and substantial landscap ing. It was pointed out that the six spaces to be provided would be outside of the 400 foo limit previously stipulated for parking in con junction with marine activities, however, the parking ratio would be the same. The Commission approved the substitution as Motion x requested subject to the following conditions: Second x All Aye 1. That the map delineating the parking spaces be revised in order to provide an up to date exhibit. • 2. That the required parking spaces be encumbered on a recordable document to be approved by the Planning Depart- ment and City Attorney.
