On motion of Commissioner Glass, seconded by
Commissioner Watson, and carried, the minutes
of April 16, 1970 were approved.

Mr. Foley explained that the applicant was pro
posing to present a melodrama during the summe
months, removing the theatre seats and re-
placing them with small tables and chairs.
Mr. Walter Phelps, President of the Open End
Theatre Workshop addressed the Commission and
stated they are trying to attract the tourist
business with this informal melodrama producti
n.
They have always served coffee but would like
to serve beer and packaged food. In the fall,
they intend to replace the theatre seats.
After discussion, the Commission approved the

Mr. Hermann Figge was present at the meeting.
Mr. John Egus of 1202 E. Balboa Boulevard aske
that the live entertainment be clearly defined
and Mr. Figge replied that it would be limited
strictly to live music.
Commissioners,.Glass, Dosh and Watson stated
that this location had had live music since
the 1940's and felt that this was a reasonable.

Chairman Jakosky closed the public hearing and
Commissioner Adkinson stated that he felt it
would be a mistake to increase the use to
permit live entertainment as once this type of

use is permitted it seems to go on and on,
therefore, he recommended denial.

size of the building has been reduced approx-

materially alter the plans. This will be a
two company station with 4 bays. Construction
will probably begin within the next two months
and the facility should be completed by May 1,

her architect, Mr. Remington, were present at
the meeting. Mr. Remington passed around
photographs showing to what extent the work

receiving a negative answer, handed the letter
to Rev. Parks to allow him time to study them

while the Commission moved on to the next item
When the hearing was resumed, Rev. Parks
stated that the information contained in the
letters was incorrect as they do not desire
to have a third story, only an observation
area. The Commission advised him that under
the terms of the zoning ordinance this would
have to be considered a third story and it
would be to his advantage to wait 6 weeks in-
asmuch as the Commission is considering amend-
ing this portion of the ordinance.
Rev. Parks inquired as to what extent his work
could progress and the Commission advised him
to meet with the Building and Planning Depart-
ments.
After considerable discussion, the application
was set over until July 16, 1970.

The Commission considered a request from Mr.

J. L. Boggs, 3107 Glendon Avenue, Los Angeles,
for a determination as to whether or not an
enclosed area at the third level of a proposed
dwelling at 223 Abalone, Balboa Island, con-
stitutes a third floor.
Mr. Nuzum explained Mr. Boggs proposed plan
and Mr. Boggs,, who was present at the meeting,
displayed a.madel of the proposed duplex.
The Commissi.on.complimented him on his plan an
advised, Kim i.t would be to his advantage to
w.ait.unti.l the ordinance is amended with
- r-espe-ct to the definition of "mezzanine" and
"story ". Mr. Boggs was,-asked to'check with
the Planning Department `in 6 weeks as to the
current status of the ordinance.
Item.10.
The Commission considered and approved a one
year extension, or until May 26, 1971, for the

Irvine Company to substitute six automobile
parking spaces for yacht marina within parking

area adjacent to the southeast corner of Bayside
Drive and Marine Avenue (1137 Bayside Drive),
in lieu of six automobile parking spaces withiii
parking area southwest of Bayside Drive, approx-
imately 400 feet northwest of E1 Paseo (1135
Bayside Drive).
Mr. James E. Taylor represented the Irvine
Company and explained that this change would
save a grove of trees and substantial landscap
ing. It was pointed out that the six spaces
to be provided would be outside of the 400 foo
limit previously stipulated for parking in con
junction with marine activities, however, the
parking ratio would be the same.
The Commission approved the substitution as
