The Newport Beach City Planning Commission held a regular meeting, Thursday,
' May 169 1946, at 7x30 pm, in the Council Chamber, City Hall, Newport Beach,
with Chairman Allen presiding.
Commissioners present: Allen, Baltz, Ellerbroek, Johnson, Longmoor, Nelson,ROLL CALL
Webb, and mite.
Commissioners absent: Isbell.
Commissioner Johnson made the motion, seconded by Commissioner Nebb, that MINUTES
the minutes of the meeting of April 18, 1946, be approved as read. Motion
carried, and so ordered.
Secretary Ellerbroek read a communication from C. G. Boice, owner of Lot COKLUNICATIONS
27, Tract 854, requesting permission to extend his garage to a point south
equivalent to a 50% variance, as the present garage will not accomodate an
automobile. The communication was accompanied by a check for filing fees,
but was not received in time for publication for hearing, so the secretary
was instructed to advertise same for the next meeting, and Chairman Allen
appointed Vault White to head a committee to investigate the matter before
the next meeting. .
Secretary Ellerbroek also read a letter from F. C. McKay, requesting a
setback.variance for Lots 7 and 9. Block 726, Corona Del Mar(Jasmine St.)
for the same distance as the lot directly north of said lots 7 and 9. No
check for filing fees accompanied this letter, so the secretary was instruc-
ted to contact Mr. McKay to remit if he desired to make a proper applica
tion for a hearing. Chairman Allen appointed Commissi ners Baltz and Nel-
son as a committee to investigate the property.
Also read by Secretary Ellerbroek was a lett T from F. E. Birtcher, for per-
mission to convert his gyast house, now under construction, into an esperi-
mental labrotary. Commissioner Longmoor made a motion, seconded by Commiss-
ioner Johnson that the application be denied. Motion carried andso ordered.
Final hearing upon the matter of a petition of property owners of Block
634, C nal Section; for rezoning from R-2 to C -1, was declared and numerous
property owners and citizens, present for the hearing were given an Opror-
tunity to express their views. Those in favor of the application included
Fred Briggs, who stated "it has always been my understanding that spot zon-
ing is porr business ", that two lots at the end of Block 634 are zoned for
boat building, and that a large majority of the property owners on the pet-
ition are anxious for the rezoning for architectural reasons. Also spedk-
ing in favor of the petition was Theressa Bsigga, who said she would build
apartments if rezoned. Protesting the petition were Mr. Owen, Mrs. May
Wiasell' ;,who didn +:t think Club House Avenue would be wide enough for com-
mercial uses, so-would present a traffic hazard. Also protesting were John
Callahan, who said that he felt that he was speaking for the majority of
the property owners, "we are trying to.protect' our property ", referring to
a petition of property owners with fifty -nine names which read "The below
named property owners of the Canal Section signify their desire to protect
and, oppose any change of the zoning restrictions in effect in said section
prior to March 219 1946. Rezoning any part of this section for commercial
or R-3 would cause increased traffic hazard and parking problems in a now
quiet vicinity. Encroaching of business into any part of the residential
section would trend to increase propertu values and property taxes. Fur-
ther it would be contrary: to the enjoyment enjoyment of our homes as such.'
Also.entering protests were Deeds Smith and Catherine Moller. After much
discussion, Chairman Allen stated that considering the complications, that

final action should be held over to the next meeting, in order to get a
more clear picture, and Commissioner Biltz matte the motion, seconded by
Commissioner Nelson, that the matter be hled over to the next meeting,
for time to go over the maps, and get a better picture of the facts, for
further study by the Commission as a whole.

First hearing upon the matter of a petition of property owners of Blocks
432 and 532, Canal Section, for rezoning from R-2 to R-3, was declared
same having been duly filed and advertised, with cards having been sent
to property owners. Secretary Ellerbroek read the petition which stated
"We, the undersigned property owners of Blocks 432 and 532, Canal Section
in the City of Newport Beach, petition your honorable body for a rezoning
of said blocks from R,2 to R -3 classification. We would respectfully re-
quest that an R -5 be allowed inasmuch as the adjacent business section ren-
ders this property unsuitable for residential purposes, other than apart-
ments." Present for this petition was Mr. Lampert, owner of property in
Block 432, who stated "the property has gone past the re identiei stage,
is backed by business district on Cnetral Avenue. The property is too
valuable for residential, should be income property." Mr. William Moller
owner of property next to Mr. Lampert, opposed the petition, stating that
he bought and built there beeause it was residential, "that he and the other
property owners had watched it grow from a little fishing village to a nice
residential section, and we are living in the clouds these days —the future
may change the picture, and a depression would or might being a lot of vac-
ant apartments". Mrs. Deede Smith said"we livethere, and I don't believe
Mr. Lampert does," as her opposition to the petition, reminding the Com-
missioners of the petition of property owners, already referred to, of
protest of any rezoning of the Canal Section. Others protesting were Mrs.
Windell, and John Callahan, Chairman Alien said that he would like the
Commissioners as a whole to look over the property, and Commissioner Webb
made the motion, seconded by Commissioner Longmoor for the hearing to be
closed. Motion carried and so ordered.
First hearing upon the matter of an application of Ida Naylor, for the re-
zoning of Lots 10, 113, 12, and a portion of 15, Block 1202 Lake Tract,
from'R -2 to C-2, was declared. Secretary Ellerbroek read the letter from
Mrs. Naylor, giving her reasons for the application as "Across the street
fronting on 30th Street is a grocery store. Cat- o'corner is a Filling
Station, and an Automobile Repair Shop. Obviously, this property is no
longer residential. The end of 30th Street at its intersection with Cen-
tral Avenue is now R -1. That area generally known as the old Southern
Pacific "Y" will, no doubt be the Pacific Electric Railway yards and de-
pot when the City widens Coast Boulevard. The unimproved tri- angular
piece of property in the center of Coast Boulevard will be acquired by the
City when Coast Boulevard is widened. This will leave my property on a
corner of Coast Boulevard in theneighborhood of 1001 wide. There are
only f' -ur other lots and a small tri- angular piece of property in Block
120 that no doubt, will immediately require rezoning as business property.
Under present circumstances it is impossible for me to dispose of this
property." Chairman Allen asked Mrs. Naylor, present for the hearing,
what she intended to use the property for, if rezoned, and she replied,
"nothing, but feel sure that no one would want a home there." whereupon
Chairman Allen explained C-2 zoning. Mr. Fishner, owner of property in
the same tract, stated that some light type of business would be accept-
able. Commissioner Baltz made the motion, seconded by Commissioner Nel-
son to close the hearing, for final hearing June 20, 1946. Motion carried
and so ordered.

First hearing upon the matter of the application of Claude Swestman,
for rezoning.of Lots 19 and 20, Block 25, from R -2 to C -1, was declared,
with Secretary Ellerbroek rea:'ing Mr. Sweetman's letter, which stated,
"To conform with existing zoning in Block 25, Newport Beach, as owner of
Lots 19 and 20 in Block 25, 1 respectfully petition your honorable body .
to rezone these two lots from R-2 to C -1. At present time Block 25
from 25d Street west to the alley is zoned C-21 which makes the above
mentioned lots undesirable for residential pruposes." Commissioner Baltz
made the motion, seconded by Commissioner Nelson, to close the hearing to
final hearing June 202 1946. Motion carried and so ordered.
R. L. Patterson presented final map of Tract 11561 Harbor Heights, for NEW BUSIINTZS
consideration of the Commission and signatures. Commissioner Baltz
made the motion, seconded by Commissioner White, for acceptance of the
map.

Tentative maps No. 1174 and 1175, refereed by the Orange County Planning
Commission for review and recommendation, were considered, with.Commiss-
ioner Webb making the motion, seconded by Commissioner Ellerbrosk for
approval of 1174, which carried; and Commissioner Webb making the motion
seconded by Commissioner Baltz for approval of 1175, which also carried.
Review of these maps brought a protest from Commissioner Longmoor for the
blocking of City streets, existing streets, who stated that if the County
continues with tracts that block city streets by not continuing same, the
future planning will be bad, and will present a traffic problem; that this
matter should be called to the attention of the County Planning Commission
at once, which body had probably overlooked this, and would welcome the
suggestion. After considerable discussion, Commissioner Longmoor made the
motion, seconded by Commissioner.Webb, that the Commission recommend that
that body provide for and/or plan for the continuation of extention of
existing ¢ity of Newport streets, with reference to tentative map 11751
where Riverside Drive becomes a "dead end street" due to the planning of
said subdivision. Motion carried and the secretary was instructed to dir-
ect a special letter to the County Planning Commission on the motion.
Commissioner Nelson presented a letter from Harry Friedman, 924 E, Ocean
Balboa, in which he regeusted consideration of permission.to maintain a
small encroachment of the building line within the side yard, explaining
that an error had been made during construction. Careful consideration
was given the matter, and Commissioner Longmoor made the motion, seconded
by Commissioner Baltz, that the secretary be instructed to write a letter
to Mr. Friedman that the granting of such a consideration is not within
the jurisdiction of the Commission, and to further inform him that he is
in violation of City Ordinance No. 525.
