Balboa Island Owner: Burgess..Donovan, Inc., Corona del Mar Chairman Dosh opened the public hearing regarding this .appeal of a Modifications Committee decision and noted that the matter had been continued from the meeting of.May 4, 1972 so the Planning Commisr sign could discuss the request of the Modifications Committee for guidelines relative to zero side yard encroachments for garages in residential districts. He noted further that this had been - discussed at length at the afternoon study session and that in ten out of twelve modifications approved within the past.six months there had been no objections from adjacent property owners; that it was felt this was a possible, practical,.and acceptable way to increase garage ,spaces for the parking of automo- biles; and that since the Modifications Committee • inspected each case it was felt that this should be under their jurisdiction; therefore the Commis - sion action at the study session had been to:endors their previous recommendation to the Modifications. Committee to continue this policy regarding side yard encroachments for garages. Assistant Director Hewicker noted that two addi- tional items of correspondence objecting to this Modification had been received, one from Mrs. Frank.Sloper of-319 Sapphire Avenue, and another - in the form of a- petition with eight signatures of residents -on Balboa Island. Mr. Hewicker noted further that while the action of the Planning Commission was final on Modification Appeals, in this particular case it had been requested that if the Planning Commission felt it would sustain the action of the Modifications Committee to permit a zero side yard encroachment fora garage, a recom- mendation should be made.to the City Council as opposed to taking final action so that the people who had appealed this particular decision to the.Plan- ning Commission would also have.the opportunity to have that- decision reviewed by the City Council. Following the above action, Commissioner Adkinson read into the record the following Policy Statement Motion and recommended that it be referred to the City Second x Council for approval. All Ayes PLANNING COMMISSION POLICY_ REGARDING SIDE YARD ENCROACHMENTS FOR GARAGES. • A parking space may encroach into-a required side yard in the R -2, R -3 and R -4 Districts subject to the following limitations: 1. The encroachment provides .additional off - street parking spaces which exceed the minimumnumber required by code: 2. The.additional off- street.parking spaces will not increase.the number of dwelling units which would otherwise be permitted. 3. The encroachment shall not be placed in a side yard which abuts a street.-or alley.. 4. An.encroachment required for an enclosed garage space.shall not exceed one story in height and may extend to the property line on one side only. No encroachment.. shall be allowed in the opposite side yard. 5. The encroachment shall be permitted only in the area that lies within.twenty -five • feet of the required alley setback line. 6. Chairman Dash reviewed this application with the Commission and noted it had been continued from the meeting of May 4, 1972 so the staff could secure additional information regarding the intent of the City to locate a fire station and training facility at the corner of Bristol Street and Spruc Avenue, and that subsequently a revised map had. been filed creating two parcels. Assistant Director Hewicker stated that since the revised map showing two parcels.had been submitted, the.subdivider had expressed a desire to have the Planning Commission proceed with the original application showing three parcels; that the staff had reviewed th.e.Citv.'_s._ pas ..i..ti.o.n..wit.h..resp".t_ta, the fire station and felt there would be no problems with this application. Mr. Hewicker noted further. that the applicant had filed an amendment to the Planned Community Text which would eliminate the confusion which had arisen regarding the existing site and that this amend- ment would be on the Planning Commission agenda on June 1, 1972. Assistant Director Hewicker pointed out that since the City had started processing tentative maps in Big Canyon, the Fire Department had gone out and physically measured some of the turning require - ments of•their equipment; that what they thought_wa adequate, apparently was not, therefore they were: trying to increase these standards. Upon being,questioned as -te- .whether this would necessitate a change in the Private.Street Policy, City Engineer Nolan replied that that was a possibil- ity. x Following further discussion, Tentative Map Tract �tion cond x No. 7809 was recommended to the City Council for All Aye approval, subject to the following conditions:. 1. That all public improvements be con- structed as reggired by ordinance and the Public:Wo.rks;Depar.tment. 2. That Section 19.16.030 of the Subdivision Ordinance regarding map.scale be waived provided maps drawn accurately to a scale of l" - 100' are furnished to the Public Works Department. 3. That the boundary of the final map be checked by the County Surveyor before being submitted to the City -for approval.. 4. That all grading be.in accordance with grading plans and reports.approved by the Public Works Director and a.qualified Soils Engineer.. Upon completion of the grading, the Civil Engineer and the Soils Engineer shall.certify that the grading has been completed according to the plans and the requirements of the grading ordi- • nance. The grading operation.for this development must not create conditions that will adversely affect the water quality of Upper.Newport Bay. 5. That easements dedicated to the City be,a minimum of 10 feet -in width, with wider easements provided where required by the Public Works Department. 6. That the following special conditions of approval be applied to the private street system a: The structural and final geometric design shall be approved by -the Public Works Department. • b. Construction shall be inspected by the Public Works Department and the standard plan check -and inspection fees _ shall be paid. C. A satisfactory.means of providing for perpetual.operation and maintenance of the private street system shall be demonstrated prior to recordation of the final map. d. Satisfactory provision for future dedication of the rights -of -way, if° desired, shall be made. e. Zone: R -2 Appellant: Gerald F. Rapp, Balboa Island Owner: Same as appellant. Chairman Dosh reviewed with the Commission this application which had been denied by the Modifica -. tions Committee pointing out that a previous modification had been approved on April 20, 1971; that this.approval lapsed because the applicant had difficulty in.designing a stairway that would meet building code requirements and that he sub- sequently filed the application now under considera- tion. It was brought out at the hearings that the building code would require a one hour wall on the property line, the full height of the stairway. The Modifications.Committee denied the request stating that "a one hour wall on the property line, • required to protect the proposed stairway, would not be consistent with.the yard setbacks required by the Zoning Ordinance ". Dr. Rapp was present and addressed the Commission regarding his application. He stated that this was an existing stairway and it would be an improvement if he were alTowed to erect the wall. He also presented a statement in support of.his applicatio signed by his neighbors; Carol Seamons, 312 Diamond Avenue, Balboa Island and M. L..DeGrasse, 308 Diamond Avenue, Balboa Island. Mr. Robert Price, a property owner -3 doors away, at 304 Diamond Avenue, spoke in favor of the application. The staff explained that the modification was for the extension of an existing nonconforming stairwa from the second level up to the roof and that a. one hour fire wall would be required on the side property line for both the existing and proposed stairway, Motion x Following discussion, a motion was made to grant Second x the appeal subject to conformance with the building Ayes x x code. Mr. Hewicker noted further that the City Council had instructed the Department of Community Development to notify all of the property,owners, tenants and prospective builders.in this particular area of Newport Center that the Department.of Community Development could not accept.requests, for building permits until such time as they had been..reviewed by the City Council and that the applicant in this particular case had been notified of this..Council policy. Director Hogan stated that this would not affect the Commission:action on this application since it would not have to.do with the building itself. There was a discussion regarding parkin for this use. Mr. Bill Roberts of American Marine Limited, the owners.of Pacific Marine Yachts, addressed the Commission and stated he could clarify the parking problem. He stated that as soon as the floating dry dock would be installed the existing crane would be removed so there would be no boats on the land. A rendering showing the proposed dry dock • was displayed and Mr. Roberts explained its opera -. tion in detail. Mr. Bob Davis,, Manager of Pacific Marine Yachts displayed a layout of the proposed building as well as the overall parking lay out; he noted further - that there would not be an increase in the number of employees. He also questioned Items.l, 4, 6 an 10 of the staff's recommendations. Upon being questioned, Director Hogan stated that he had personally inspected the subject property. He outlined in detail the operation of the previous owner as well.as that proposed by Mr. Lawrence. He pointed out that basically the interpretation to.be made by the Commission was whether the new use would be a retail operation as opposed to manufactur- ing; a retail use would require a use permit while a manufacturing or industrial use would not. Mr. Lawrence was present and addressed the Commis- sion at length regarding his proposed operation as well as the use -of the property. He stated that in his opinion, the use he was proposing was simila to that of the previous owner who was known.as a wholesale and retail dealer. x Following further discussion, the interpretation of x the Director of Community - Development was upheld x x x x xx and Mr. Lawrence was advised that.he could appeal x the decision of the Planning Commission to the City Council within 21 days.
