citizen project on East Coast Highway in Corona del Mar.

INITIATED BY: The City of Newport Beach
Robin Flory, Assistant City Attorney, explained the purpose of the
subject amendment so as to revise the definition of the term
"model studio ". She said that the definition is in the process of
being broadened for permit procedures in Title 5, and that it is
suggested that the Zoning Code be consistent with the definition
that the City Attorney's Office has recommended to the City
Council for adoption under Title 5.
In response to a question posed by Commissioner Glover, Ms.

Flory explained that the amendment is applicable to both genders.
In response to a question posed by Commissioner Pomeroy, Ms.
Flory explained that 'specified anatomical areas' is a term that was
used in a case upheld by the Supreme Court.
The public hearing was opened in connection with this item. There
being no one to appear before the Planning Commission, the public
hearing was closed at this time.

Amendment No. 761
Request to consider an amendment to Title 20 of the Newport
set for
Beach Municipal Code as it pertains to the design of permitted bay

window and greenhouse window encroachments into required yard
setbacks in residential districts.

William Laycock, Current Planning Manager, explained that an
amendment was approved in 1987 that permitted the installation of
bay windows and greenhouse windows so as to allow specific
encroachments into front, side yard, and rear yard setbacks.
Subsequently, the Modifications Committee has determined that
certain criteria has been designed by architects and other designers
that were not considered to be greenhouse or bay windows by
•
putting entrances into the fronts of houses in the front yard
setback, and enlarging bay windows to a height of two stories. Staff
has recommended that the Commission consider redefining 'bay
windows and greenhouses'. If the subject amendment would be
approved by the Commission and the City Council, the
Modifications Committee would still be able to continue to approve
bay windows higher than 10 feet or encroach farther out into a
setback on a case by case basis, if said request would not be
detrimental to the neighborhood.
Commissioner Pomeroy concurred that the bay window should not
be abused. He addressed the structures that were constructed with
a raised wood floor, and a bay window projection at the floor level
wherein he indicated that the bay window would be 18 inches to 24
inches above grade so as not to be used as an entry area
Discussion ensued between Commissioner Pomeroy and Mr.
Laycock regarding the restrictions of the proposed amendment.
