Foley, Senior Planner Shirley Morgan Item #1 AMEND - To consider adding Section 20.08:290 to the Newport Beach Municipal Code limiting the height NT of buildings in Newport. Beach. 22 Initiated by: The City of.Newport Beach Chairman Dosh gave a brief report.of the previous undertakings in connection with this matter and introduced various correspondence and recommenda- tions for consideration-in developing a height li.mitation ordinance. Community Development Director Hogan read.the new definitions of "grade" and "height" and explained the intent and meaning of same: Recommendations from the Architects Advisory Committee were read,and discussed. The committee has..been recognized by the City Council and their official name will be Newport Beach-Architects Planning Committee. David Kluges, Stewart Woodard, and Murt Willson, architects serving on the newly formed committee, appeared before the Planning Commission to discuss the proposed ordinance made by the Newport Beach Architects Planning Committee and slides were projected in connection with .their discussion and presentation. Planning Commission recessed at 10:05 P.M, and reconvened at 10:20 P.M. Chairman Dosh closed the public hearing. Planning Commission discussed in detail the proposals and suggested recommendations which had previously been presented, gave.his /her views on the various recommendations and presented additional input for discussion by the Commission. Motion was made by Commissioner Martin, seconded by Commissioner Glass and carried to re -open the public hearing in order that further views or • comments could be made;by.those`present. The following persons appeared before the Planning Commission and commented further in connection with the proposed ordinance: Stewart Woodard; David.Klages; Al Auer, The Irvine Company; Allan Beek. The Chairman closed the public hearing. Motion X Following further discussion, motion was made by Commissioner Agee, with regard to the Ordinance, that the Planning Commission accept the three zones as recommended by the Architects Advisory. Committee, (i.e. 24'/32' -UP; 32'/50' -UP; 50' /Un- limited-UP) and that where a.use permit is require , same.shall be subject to the 3 conditions as:shown on the original draft ordinance (i.e., 1. The increased building height would result in more public visual open space and views than could be achieved within the basic height limit in any zone Particular attention shall be given to the siting of the structure on the lot, the percentage of gro nd • coverage, and the treatment of all setback and ope areas. 2. The increased building height would result in a more desirable architectural treatment . of the building and a stronger and more appealing visual character of the area than could be achieve Page 2. Particular,attenti n shall be given to the total bulk of the structure including both horizontal and vertical dimensions.),. and that the definition of grade and height,.as recommended by the staff be accepted. (i.e., Grade: For the purpose of measuring height, the grade shall be the finished grade as defined in the Uniform Building Code established by the adopted grading plan,.provided, however, that where a problem is caused by sloping ground or where.no grading plan has been adopted, the Department of Community. Development shall endeavor to establish natural or existing grade on the site in such a way as to ensure that the intent and purpose of Chapter 20.09 is fulfilled. Height: The height of a structure shall be the vertical distance between . grade at any point and the highest point of the structure directly above, provided that a pitched . roof shall be measured.to the average height of the roof, and a: mansard roof shall be measured to . the deck, but that no part of the roof shall extend more than five (5) feet.above the.permitted height in the height limitation zone.) ; econd N Motion was seconded by Commissioner Glass with the amendment that a preamble regarding the intent of the ordinance be inserted; that a statement as to the extent.in time pending completion of the General Plan be inserted; change, the 24'/32' -UP zone to 26'/32' -UP zone; waive the fee for ,a use permit in connection with redevelopment of R -1 property within the 26'/32' =UP zone; add an additional zone entitled 26'/50'- Waterfront, where- in buildings on waterfront property may exceed 26 feet up to a maximum of 50 feet if within a Planned Community District, an adopted Specific Area Plan,, or after approval of a use permit, said increase in height be limited to increase at the rate of l foot for each 4 feet additional setback from the waterfront. ;econd to Commissioner Heather seconded the amendment to the: lmendment X original motion. Absent X Motion X In recommending the areas to be established for Second X the various zones, and using the Architects' Map, • Commissioner Glass moved as follows: That the area designated 50' /Unlimited -UP remain as shown.on the map. That the area designated 32' /50'- UP.remain as shown with the exception that the portion along upper Newport Bay north of the Newporter Inn to Park Newport; the area on the west side of Newport Bay from the water to the bluff line; all of the area between the waterfront and Coast Highway along Mariner's Mile; the area along Lafayette and Lido Peninsula; the area along the waterfront in McFadden Square, Balboa Peninsula and the China Cove area should be changed to the 26'/50'.- Water -.. front zone and the unclassified area above the bluff line east.of Dover (Castaway Property) should be changed.to 26'/32' -UP. Also, the three areas in the Bluffs designated 32'/50' -UP should be changed to 26'/32' -UP. The property across Jamboree Road in front of the Newporter Inn should be designated as 32'/50' -UP: Motion X Substitute motion was made by Commissioner.Martin that the area designated in the original motion as to 26' /50'- Waterfront:in the Central Balboa Peninsula be revised to 24'/32' -UP; that McFadden Square be revised to 26'/32': -UP; that the area on the north side of Coast Highway extending from Dover Drive to a point at approximately an exten- sion of Irvine Avenue be designated 26'/32' -UP. Motion died for lack of a second. Ayes X XX X X The original motion as amended was voted on and Noes X carried.
