Commissioners present: Copelin, Keene, Hayton, Longmoor, Briggs, Reed, Rudd, Smith Commissioners absent: Lind Chairman Longmoor presented the -new Assistant Director of Building and Safety, Mr. Bud Bartlett, who is ta4ing over the duties of Mr. Leslie Holbrook, Administrative Assistant. MINUTES: Minutes of the meeting of May 19, 1955 were approved on motion of Como Reed, seconded by Como Hayton, and carried. Application of William R. Hervey, Jr. to construct a 4 foot high brick wall with a 5 ft. 8 in. brick pylon to support a 12 foot b�­ 4 foot high chain link fence type of driveway gate along the front property line facing Balboa Blvd. and within a 5 foot frontyard setback on a building site consisting of the Easterly 55 feet of Lots 8, 99 and 109 11 Block 270 Eastside Addition to Balboa Tract and located at 1806 E. Balboa Blvd., Balboa. Section 9105.2 (b) requires a 3 foot height limit in a.frontyard setback. FINDINGS: It was found that unless unusual hardship or necessity could be shown, the commission should require conformity to the applicable sections of the City Code, Section 9105.2 (b). CONDITIONS. 1. The brick wall along the front property line shall not exceed the required 3 feet height. The hearing was closed on motion of Como Rudd, seconded by Como Hayton and carried. Como Copelin -moved that the application be granted in accordance with the conditions, seconded by Como Hayton, and carried by the following roll call vote, to -wib: ALL AYES 153 VARIANCES V - #229 Hervey,Wm. Jr. Lots 8, 9, 10, 11 Tr. #27 Eside Add. Balboa Tr. Granted Application of Mr. and Mrs. Robert A. Griesser, Jr. for a 5 foot rearyard setback for an 18 foot 3 inch by 30 foot addition to an accessory building. V - #230 The property is located at 701 - 15th St., Newport Beach, on Tract 1218, Lot 111 in the Cliff Haven area. Section 9103.15 (c) requires a 101 setback. FINDINGS: Since no alley was involved and neighbors appearing were agree - Griesser, able to the Variance, the Commission accepted recommendation of committee Robt. A. Jr. for the granting of this Variance. The hearing was closed on motion of Como Copelin, seconded by Como Hayton, Lot 111, and carried. Como Rudd moved that the application be granted, seconded by Tr. #1218 . Como Hayton, and carried by the following roll call vote, to -wit: Granted ALL AYES Application of Renate Titus to allow a detached garage accessory building to be placed on the front half of a 90 foot wide building site consisting of 3 lots with a 3 foot side setback and a 4 foot setback between the existing single family dwelling and the proposed accessory building on Lots 16, 17,_and 18, Block 9, East Newport Tract and located at 528 West Ocean Front. FINDINGS: The building site is now in split zoning with 2 lots zoned R-1 and one lot zoned R-3. By developing the property as proposed herein the entire rear half of the property is left clear fora possible future subdivision which would create two R-1 building sites out Of three lots. Lots 16,17,18 Block 9, East Newport Tract Granted 54 The applicant needs garage facilities for his present large single family dwelling and is at present interested only in using the entire property for his own family. The location proposed for the garage offers the best access to the garage, and the greatest ' privacy for the service yard and patio. The developmeht would definitely improve the property and would not be detrimental to any adjacent or surrounding properties. CONDITIONS: Under this Variance the use of the property will be limited to single family occupancy unless allowed otherwise ty any future Variance or Use Permit. The hearing was closed on motion of Com. Copelin, seconded by Com. Reed, and carried. Com. Keene moved that the application be granted in accordance with the conditions, seconded by Com. Smith, William B.Block 23, Lots 9 and 10 to be remodeled into additional living. . quarters in connection with the single family dwelling so that no Lot 9 and 10, garage facilities will exist on the building site (Lots 9 & 10). -Block 23, Permission is also requested to allow a double garage to be constructed Eastside Add. on the rear of Lot 20, located adjacently across an alley and to be Balboa Tract used in connection with the above dwelling, under one ownership. .City Code Section 9105.5 (a) requires one garage space for each single family dwelling; Section 9103.11 (b) requires the accessory building to be constructed simultaneously or subsequent to main building. Granted FINDINGS: The applicant is a quadriplegic and this Variance is , necessary to provide living quarters at a ground level adjacent to a patio for himself and a nurse who must be in constant attendance. The existing dwelling is a considerable distance above the ground level and would be hard to alter. It is necessary for Mr. with to be at home with his family and a converted use of.the present garage with garage facilities transfered to adjacent Lot 20 Offers the best possible solution to the applicant's problem. The number of lots in the adjacent area are now being used for accessory uses to Hay Front homes. CONDITIONS: 1. Altered portion of building on Lots 9 and 10 to be. converted back to a legal size garage if legal garage facilities for said Lots 9 and 10 are not maintained on Lot 20 pr Lot 20 is sold separately from said Lots 9 and 10, all in Hldsk 239 Eastaide Addition to Balboa Tract, and that all permissive uses under this Variance shall terminate in event of any separate sale or other use of the premises. 2. The applicant owners shall furnish a letter signed by themselves agreeing to the conditions stated herein. The hearing was closed on motion of Com. Copelin, seconded by Come Hayton and carried. Com. Copelin moved that the application be granted in accordance with conditions, seconded by Com. Briggs, and carried by the following roll call vote, to -wits ALL AYES 155, Application of Mrs. Wilma Q. Walter Patton for a 56 foot front yard V - #233 setback for construction of a proposed addition to an existing house which is also to be remodeled on a building site consisting of Lots Patton, Wilma 10 and � of 12, Block 328, Corona del Mar Tract and located at 408 Q Walter Avocado, Corona del Mar, in an R-1 District. FINDINGS: If the maximum allowable setback of 35' were complied with, Lot 10 & J 12, the home would be too large for the applicant, however, it is necessary Block 328, to remodel the existing house to obtain more adequate living area and CDM Tract garage facilities and it is desired to maintain the existing trees planted in the front portion of the lot. Construction to the 35 foot line would eliminate some of this planting. Granted CONDITIONS: Legal garage facilities are to be constructed and maintained. 2. Rear and side yard setbacks required by Section 9103.15 are to be observed for existing and proposed construction. The.hearing was closed on motion of Com..Copelin, seconded by Com. Reed, and carried. Com. Read moved that the application be granted in accordance with the conditions, seconded by Com. Keene, and carried by the following roll call vote., to -wit: ALL AYES Application of Charles W. Masters to resubdivide a parcel consisting of Lot 16 and -)J of Lot 15 in Tract #1026 into building sites as follows: Building Site #Is consisting of the southerly 62 foot portion of said Lot 16 and J- of Lot 15 with frontage -on Breakerts Drive and each -site. containing 5,239 square feet. Building Site #2: consisting of the northerly 62.foot portion of said Lot 16 and } of Lot 15 with frontage on Ocean Blvd., top of bluff. FINDINGS: The lot sizes proposed by Mr. Masters are short of satisfying the minimum depth of 80 feet per Newport Beach Municipal Code. Com. Hayton recommended the continuance of this application until the Plan- ning Commission's next meeting, July 21, 1955, and that the property be posted and notice of Public Hearing published. The hearing was closed on motion of Com. Longmoor, seconded by Cora. Copelin, and carried. Application of J. N. Goode to resubdivide. two R-1 lots which are located back to back with their common rear line diagonal with the side lines. The applicant owns both lots. The lots are thus not rectangular in shape and present a rear setback problem in building. The applicant desires to readjust this rear line to a new location to. conform with a retaining wall which is set nearly perpendicular to the side lines. The two lots to the east were allowed a 5 foot rear set- back to accomplish the same results.(Lots 2 & 102 Blk. A-321 CDM Tr.) FINDINGS: Com. Longmoor. pointed out that the irregularity in shape of the lots as originally constituted, presented a rear setback problem in RESQBDIVISION #10 Masters, Chas. W. Lot 16 & J Lot 15 Tr. #1026 held over Resubdivision #11 Goode, J. N. Lots 2 & 10 Block A -32 CDM Tract building. The hearing was closed on motion of Com..Briggs, seconded by Com. Hayton, and carried. Com. Hayton moved that the application be granted, seconded by Com. Rudd, and carried by the following.roll call vote, to -wit: ALL AYES Resolution 0593 of the Planning Commission amends the Zoning.Law, Ord. Resolution #594, Amendment.#13, initiated May 19th to change zoning on.Lots 1 and 2. Block 5, East Newport Tract from R-2 to R-3 in order to limit the westerly 30 foot portion to a single family. development has been held over until next meeting due to lack of time to write it up and have it published two weeks ahead of this meeting, as required.by Section 9106.52 (a) of Zoning Ord. #635. Application of Milton Kramer to allow the construction and operation of a 4 unit dwelling structure on an R..3 district building site 40 feet by 100 feet containing 4,000 square feet and with 40 foot frontage on Balboa Blvd. The property is located on the southwest corner of Balboa Blvd. and "F" Street at 1327 East Balboa Blvd. Section 9103.32 (a) requires a Use Permit. FINDINGS: Commission could anticipate no objection to this type of structure in this area. The trend in this neighborhood appears to be towards multi - dwellings. The hearing was closed on motion of Com. Copelin, seconded by Com. Lind and carried. Com. Copelin moved that the application be granted.in accordance with the committee report.,seconded by Com. Briggs, and carried by the following roll call vote, to -wit: ALL AYES Com. Copelin moved that a letter from Attorney Hurwitz representing Request for certain property.owners requesting annexation of prescribed property Annexation (Seaquist) be referred to the City Council with the recommendation "SUQUIST" for approval. Com.
