G iANTED MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, JUNE 17, 1954 8:00 PM CITY HALL COUNCIL CHAMBERS NEWPORT BEACH CALIF.' Chairman Longmoor called the regular meeting of the Planning Commission to order. ROLL CALL: Commissioners present: Hayton, Briggs, Copelin, Lind, Longmoor, Reed, Rudd, Smith, Keene Commissioners absent: none MINUTES: The minutes of the meeting on May 20, 1954 were corrected to read as follows: - Use Permit #141 of Eunice G. Carter - Addition under corrections that "use be limited to 7 roomers ". Under street name changes, "Vilelle Place,to be designated as a street ", changed to read "first alley north of Balboa Blvd. between 18th St. & 19th St. to be named Vilelle Place ".. Under Variance #144 - Parcel #2 corrected to read,. "consisting of all that part of said Lot #492 which is not incorporated and described in said Parcel #1 as stated herein, all of Lot #491, Tract #907 and which said Lot #491 is adjacent to the west of said Lot #492, and the easterly 10 feet of.Lot #490 adjacent to Lot #491." The minutes were then approved upon motion of Com. Keene, seconded by I Com. Copelin, and carried. Application of Dr. Harry G. Huffman and Mrs. Vyvian F. Huffman for permission to enclose an existing porch which extends six feet into the:'20 foot front setback required by Districting Map #10. Said enclosed porch is to be incorporated in and become a part of the existing livingroom. The property is described as Lot #29 in Tract #884 and located at 820 W. Bay Ave., Balboa. This application was set over from the meeting of May 20th last to allow the applicant to obtain the consent of the owners of the three lots adjacent to the west of his own Lot 129 and present the information for this hearing. The hearing was declared open. FINDINGS: Two buildings to the east on adjacent property and one building to the west have already invaded the front setback and are in line with the structure proposed in this application. Agreement to Dr. Huffman's proposed enclosure was obtained from adjacent property owners to the east and the west. The hearing was closed upon motion of Com. Copelin, seconded by Com. Hayton, and carried. Com. Copelin moved that the application be granted, seconded by Com. Lind, and carried by the following roll call vote, to -wit: ALL AYES (Variance #146 acted on at meeting of May 20, 1954) 77 Application of Kenneth M. Udell, 1078 Balboa Drive, Arcadia, for re- alignment of the common property line between Lots #1054 and #1055 V - #147 ' of Tract #907 so as to create two nearly equal size lots. It is Udell, Kenneth M. proposed to maintain the existing 30 ft. wide frontage of each lot on Strada Cordova and to change the rear lot line dimensions on Via Lots #1054 & Cordova as follows: the existing 21.51 ft. dimensions of Lot #1054 #1055 to 25.75 ft. and the existing 30 ft. dimension of Lot #1055 to Tr. #907 25.76 ft. which is in Variance with Section 9103.13 of Zoning Ord. #635. The common property line of said lots will then extend in a GRANYM straight line between the existing point of division on Strada Cordova and the newly established division point on Viq. Cordova. The hearing was declared open. FINDINGS: The realignment of the common property line of said Lots #1054 and #1055 will create sufficient width on both lots facing Via Cordova to permit the construction of a double garage with required setbacks so all garages will be directly accessable from Via Cordova. This adjust,Mw� thus improve Lot #1054 and not be .detrimental to Lot #1055. The hearing was closed upon motion of Com. Copelin, seconded by Com. Rudd, and carried. Com. Briggs moved that the application be granted, seconded by Com, Copelin, and carried by the following roll call vote, to -wit: ALL AYES Application of James E. Taylor of 110 Via Genoa to construct a 2nd floor overhang of 30 inches into the rear yard setback facing an alley V - ' on Lot 31, Block 10, Section 1, of Balboa Island, and located at 212 Agate Ave., all as required by Section 9103.25 of the City Code. FINDINGS: 30 inch overhangs into the rearyard property setback of five feet facing a 10 foot alley on Balboa Island have been allowed Lot 31, Blk. 10 on surrounding properties on said,Balboa Island and the second floor Section 1, setback requested in this application will not be detrimental to Balboa Island adjacent or surrounding property. ' FINDINGS: This variance is in accord with the previously agreed setback conditions as set forth under conditions hereon, The hearing was closed .upon motion of Com. Hayton, seconded by Com. Rudd, and carried. .Com. Hayton moved that the application be granted, seconded by Com. Rudd, and carried by the following roll call vote, to -wit: F'11A Application of Gillman & Sons, under Section 9103.52, to continue operation of a plumbing repair and contracting business in a C-1 district on Lot 2, in Tract #1045, and located at 716 Coast Blvd. Use Permit #104 was approved for a period of 6 months effective from December 4, 1953 to June 4, 1954. The hearing was declared open. FINDINGS: The applicant has improved his property by the addition of a redwood stake covering to the wire fence across the front of the property and has all open storage stacked in a neat and orderly arrangement. Also, he has added a lawn in the area between the sidewalk and said front fence. It was stated by Com. Hayton that since the garage owner on property to the west was forced to comply with certain restrictions, Mr. Gillman should further improve his property with a building and carry on his activities within the building. Mr. Gillman stated , that he planned to improve his property with a suitable building on the rear of the lot where an existing shed is located. CONDITIONS of Use Permit #104 - 1. A suitable building must be constructed within 6 months to replace the existing shed on the rear of said Lot 2, Tract #1045. 2. Plans must be submitted to the Planning Commission for approval for any buildings or structures which may be placed on said Lot 2, Tract #1045. The hearing was closed upon motion of Com. Nielsen, M.D., under Section 9103.1(e) of the City Code to allow an R-1 district lot adjacent to a C -1 -H district property to be used for free parking of patrons of a proposed professional building. Parking is proposed to be on Lot 19, Tract #1136 and located at 408 Westminster Ave. The hearing was declared open. FINDINGS: No objections were received and the parking area is needed to accomodate clients of the proposed professional bldg. CONDITIONS of Use Permit #145 - 1. Said parking lot shall be paved when adjacent professional building is constructed and maintained in a neat and ordeihly manner. 79 2. Said R-1 Lot #19 is to be a permanent part of any business ' operation on said C-1 -H Lot #18 and maintained and used only as a free parking lot for said professional building to be constructed on said Lot 18, and be it hereafter understood by all parties that should said Lot 19 be severed from control by owners or occupants of said C-1 -H Lot #18, said owners or occupants will bmmediately provide such parking as may be required by the Planning Commission on said Lot 18 and make such alterations to any buildings as may be neces- sary to accomodate such parking. Said waterfront property is 105 feet wide and consists U.P. #146 of the southeasterly 15 feet of Lot 7, all of Lots 6 & 5, and the northwesterly 25 feet of Lot 4 in Tract #1622 and located at Calahan, Lester 3336 to 3348 Via Lido. Mens and ladies comfort facilities are to be provided. Lots 4,5,617 CONDITIONS on Use Permit #146 - i'r. FINDINGS: Proper shore restroom facilities have been incorporated in an apartment building on adjacent C -1 -H property for use of proposed renters and users of the floats and said location of floats is suitable for commercial purposes. Hayton, and carried by the following roll call vote, to -wits ALL AYES Application of J. W. Wood to use boat slips in a "U" District waterfront adjacent to a C-1 -H district land area for rental purposes. U.P. #147 Said waterfront property is 170 feet wide and consists of the north- westerly 10 feet of Lot 17, and all of Lots 18, 192 20, and 21 in good, J. W. Tract #1622 and located at 3408 to 3420 Via Oporto. Mans and ladies comfort facilities are to be provided. "usiness Tract 01237, known as Corona Highlands and located between Association Morning Cqnyon Road and the easterly city limits. A previous Use Permit #93 was allowed for a six month period effective from Lot 3, Tr." 1237 June 5, 1953 to December 5, 1953, and was not renewed. Hayton, and carried by the following roll call vote, to -wit: ALL AYES I Application of Charles Ullman, operator of Servide Afloat to use U.P. #149 boat slips in a "U" District adjacent to a C-1 -H district land area for rental purposes. The property is located easterly L113an, Ch-arles &f Marine Ave. approximately 1250 feet and is 155 feet S. 300 E. of U. S. Bulkhead Station #102 as shown on District Map #15. Herbert Brownell to construct office on a portion of Lot 171, Block 54, Irvin ' in a C-1 -H district fronting the State Highway, portion located in a "U" District as per Map #2 1 property is further located across from the Sea Chamber of Commerce office and Barrette Constru West Coast Hwy. FINDINGS: The name changes as described herein are necessary to avoid confusion and to allow proper'house numbering of said streets. The hearing was closed upon motion of Com. Lind, and carried by the following roll call vote, to -wit: ALL AYES Letter from the Women's Civic League requesting a bicycle path along Letter from Bayside Drive between Balboa Island and Corona del Mar. Women's Civic Uphn motion of Com. Lind, seconded by Com. Smith, and carried, a League ' letter was directed to the Women's Civic League informing them that this suggestion will be taken under consideration and Com.
