GLASS, Robert K. 1019 Channel Place Newport Beach 2. Lot 9 Block 340 Canal Section Zone R -2 3. Posted 6- 11 -56 Published 6 -11 -56 4. An encroachment of 81 into a required 20, front yard set back. 5. Due to odd shape and size of property additional frontahe is needed for new building. 6. Discussion : Nate findings. 7. Findings Due to the odd shape and size of the lot in question it would not be practicable to construct a dwelling and to conform to the required 201 front setback. The Commission felt a definite hardship existed and recommended approval. 8. Commissioner Keene moved the Commission recommend the GRANTING.of this Variance, seconded by Comm. Findings There being no protests entered, the Commission recommends approval so that this request will conform to other variances of similar nature in Irvine Terrace. 8. Discussion The applicant requests permission for a four (4) unit structure on this lot, however under the Zoning Ordinance each unit requires 1000 square feet and said lot has 3250 square feet only. Findings Several variances have been granted in this area because of the topography of the land. In keeping with policy already established for this area, the Commission recommends approval. 8. Discussion : Because of the shape and size of this lot the Commission feels the approval of this application will contribute to better development and use of property. An encroachment of 12" into side yard setback to permit construction of fireplace. 5. section 9105.4 (b) permits fireplaces and chimneys to encroach to a • distance of two (2) feet from a side line. The required side yard setback for this lot is three (3) feet permitting the fireplace to encroach a distance of 12" only. The applicant desires to have the same project 24" into side yard to avoid using excessive space in the living room. 6. Discussion : Note findings. 7. Findings As for encroachment, Section 9105.4 of Ordinance # 635 is specific and the Committee feels that same should be strictly followed in most cases. However, as in this particular case, when a building is being errected on a corner lot, and the chimney is to be on the side street, the Committee feels that exceptions are sometimes in order and recommends approval. 8. Section 9105.7 (g) requires a Use Permit application for repairs or alterations of a non - conforming dwelling where the cost exceeds 15% of the appriased value thereof in any one (1) year period. The approximate cost of the alterations in this case will be ;;2500.00. Additional space is necessary to accomodate family and to provide maid's quarters. 6. Discussion : Note findings. 7. Findings The proposed demolishment and reconstruction., will bring this property in better conformity with the Code, therefore the Commission recommends approval. 8. Use Permit # 212 dated December 8, 1956 allowed a four (4) unit dwelling on the East side of these two lots. The Commission feels this is good land use and will add to the improvement of this area. Recommendation of approval is made subject to the condition that the garage walls be located three (3) feet from the side property line and that the gain dwellings be located not less than four (4) feet from the side • property line. 8. Discussion Considerable discussion was had by persons from the floor who were present to protest the establishment of an animal hospital in this area. 7. Findings The general character of this area seems suitable for the use applied for, provided supression of noise, odors, and sanitation are properly provided for. 8. Commissioner Lind moved the Commission recommend the GRANTING of this Use Permit, seconded by Comm. Because this property is non - conforming a Use Permit is required for any structural alterations under Section 9105.7 (g). 8. A discussion was held by the Commissioners and the applicant regarding the 16th Street cut off shown on the plot plan submitted with application. 7. Findings The Commission feels this is good land use and recommends approval subject to a decision to be rendered by the City Engineer regarding the 16th St. lay out. 8. Commissioner Briggs moved the Commission recommend the GRANTING of this Use Permit subject to the above condition, seconded by Comm. The applicant states that due to the congested parking conditions in this area the lot in question was purchased for the purpose of public parking. 6. Discussion Considerable discussion was held by the Commissioners, applicant, and a property owner in Corona del Mar regarding the lot in question. 7. Findings : As in many similar locations, this area is in definite need of additional parking facilities and recommendation of approval is made subject to the following condition: Applicant must build a fence separating • the subject lot and adjoining residential lot extending from rear property line to the front yard setback line. The Commission recommends approval of this application subject to the condition that it be granted for a period of one (1) year only. 8. Second hearing on Planning Commission Resolution of Intention # 601 to amend zoning on the recently annexed Seaquist Annexation from a "U" District to Zoning Districts available in Zoning Ord. # 635 that would be appropriate for land uses existing or proposed. 3. Present at the hearing were several property owners in this area who expressed their desires regarding the proposed zoning. Due to the varied opinions the Chairman of the Commission suggested that this matter be held over for a third meeting. 4. Commissioner Briggs moved the Commission hold over for a third meeting the Zoning of the Seaquist Annexation and that an opinion regarding said matter be secured from our Planning Consultants, Hahn, Wise and Associates, seconded by Comm. Commissioner Copelin moved the Commission hold the first Public Hearing on this matter at the July meeting, seconded by Comm. Hayton, and carried by the following vote, ALL AYES TENTATIVE MAPS # 3082 A letter was submitted to the Commission from Walter E. Jorgensen, Agent Pasadena Land Co. dated June 5, 1956 with six copies of Tentative Map #3082 being a parcel of land lying in Lot 159, Block 53 and Lot 157, Block 52 of Irvine's Subdivision. A communication was presented from the City Engineer who stated therein that he had from an Engineering standpoint found the Maps Acceptable. . Commissioner Copelin moved the Commission approve Tentative Map 3082 and that it be referred to the City Engineer for processing under the Sub - Division Code, seconded by Comm. Reed, and carried by the following roll call vote, to wit: ALL AYES. TENTATIVE MAPS # 3031 & 3032 Received by the Commission were six copies each of Tentative Maps 3031 & 3032 being a parcel of land lying in Pcrtion of Lots 164 & 165, Bl. 53 of Irvine's Subdivision. Commissioner Hayton moved the Commission APPROVE the Tentative Maps as submitted and that they be forwarded to the City Engineer for processing under the Subdivision Code, seconded by Comm.
