Posted June 10, 1957 Published June 13, 1957 4. Construction of a two story fireplace extending 30" into front yard setback. 5. There is no other way to build a fireplace in this existing house. 6. DISCUSSION . Note findings. 7. FINDINGS The Committee reported that in 1952 the Commission granted a 10' front yard setback instead of the required 20' at this address. Since a fifty percent encroachment of the front yard setback had already been approved, it was the opinion of the Committee that further encroachments should not be permitted. 8. On motion of Commissioner Reed, seconded by Comm. Lind, Variance application. No. 377 was DENIED by the following roll call vote, to wit: ALL AYES. 71-3 78 1. Page - 2 - VARIANCES #378 (con'd from Page 1) 7. FINDINGS : The Commission has gone on record as favoring 2nd floor overhang encroachments into rear yard setbacks in R -2 Districts. There were no protests and the Committee recommended approval. 8. On motion of Commissioner Copelin seconded by Comm. Posted June 17, 1957 Published.June 209 1957 4. Waiver of side yard setback in order to erect tennis court to be built 10" in from property line adjacent to access road to Bay Shores. Existing fence to be removed and a 12' chain link fence erected.. 5. If tennis court and 12' chain link fence is located 4' in from existing fence on property line in accordance with City regulations, we are inclined to believe this would create a nuisance value,i.e., a catch all for papers, weeds etc. This unsightly condition would be eliminated if proposed tennis court and fence were erected 10" in from property line. 6. FINDINGS Commissioner Longmoor stated that he had contacted the Irvine Company who owns the property adjacent to the Balboa Bay Club and they had no objections to this variance request. The Commission found and determined that the approval of this appli- cation would not be detrimental to the general welfare of persons residing or working in the neighborhood. 7. On motion of Commissioner Smith, seconded by Comm. Copelin, Variance application No. 379 was GRANTED by the following roll call vote, to wit: ALL AYES • Page - 3 - • VARIANCES #380 1. Waiver of off - street parking for nine (9) cars. 50 Off- street parking at 3424 to 3432 Via Oporto, capable of parking 24 automobiles. Bob Dalton's seating being 134 capacity we can park only 27 cars, 3 in front of restaurant off street. This makes us short 9 spaces for which we ask a waiver. Our original lease with Lido Shops Auto Park Association was cancelled. We find it impossible to negotiate a lease with them as this time. 6. DISCUSSION Dr. E.W. Milum representing the Lido Shops Auto Park Association spoke to the Commission in protest of this waiver request. He stated that the area Mr. Dalton planned to use for his parking would accomodate a maximum of 20 cars and these would have to be parked bumper . to bumper. Each time a car was moved it would create a traffic hazard on Via Oporto which is a very narrow street. 7. FINDINGS After consideration of all evidence presented, the Commission found and determined that the approval of this variance would be detrimental to the health, safety, peace, morals, comfort, and general welfare of persons residing or working in the neighborhood. 8. On motion of Commissioner Lind, seconded by Comm. Smith, Variance application No. 38o was DENIED by the following roll call vote, to wit: ALL AYES. USE PERMITS #333 1. RANDOL, W.L. 2826 Newport Boulevard Newport Beach 2. Lot 14 Block 225 Section A Zone C -1 3. Posted June 10, 1957. 4. Operation of a veterinary hospital in a C -1 zone. • 5. DISCUSSION . Note findings. 6. FINDINGS The Committee in their findings stated that the operation of a veterinary hospital in this • S Page- - 4 - USE PERMITS • #333 (con'd from Page 3) area would not be compatible with other uses. It was further pointed out that immediately adjacent to this proposed veterinary hospital would be a medical clinic. After careful consideration of all evidence presented, the Commission found and determined that the establish- ment of a veterinary hospital at this address would be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood, 7. On motion of Commissioner Lind, seconded by Comm. Copelin Use Permit No. 333 was DENIED by the following roll call vote, to wit: ALL AYES. #334 1. SWENSON? The use of these premises for upholstery work, both new and recovering for furniture, automobile or boat work. 5. DISCUSSION Note findings. 6. FINDINGS The Committee in their report stated that the use of this property for upholstery work would be compatible to other uses in the area and in the absence of any protests recommened approval. 7. On motion of Commissioner Copelin, seconded by Comm. Lind, Use Permit application No. 334 was GRANTED by the following roll call vote, to wit: ALL AYES. #335 1. DISCUSSION Note findings. 6. FINDINGS Policy established by the Commission prohibits 0 n U E 0 • Page - 5 - USE PERMITS #335 (con'd from Page 4) "billboard" type construction along the State Highway. If this application were approved it would set a precedent and the Commission would not be in position to deny any further applications. 7. On motion of Commissioner Copelin, seconded by Comm. Construction of a single family dwelling in an "Unclassified" District. 5. DISCUSSION Note findings. 6. FINDINGS This new dwelling is to be located in the area known as the "Tustin - 22nd Street Annexation" which has not been zoned: A Use Permit is required for any construction in an unclassified district. The Committee recommended approval subject to the condition that the new dwelling conform to R -1 re- quirements and restrictions. 7. On motion of Commissioner Lind, seconded by Comm: Copelin, Use Permit application No. 336 was GRANTED subject to the above conditions by the following roll call vote, to wit: ALL AYES. #337 1. Permission to establish fee parking and general rental and sales including beach equipment and automobiles. 5. DISCUSSION Note findings. 6. FINDINGS After considerable discussion with the applicant and other interested parties Page - 6 - • USE PERMITS the Commission advised the applicant that they would favor the request for fee parking on this lot, however the other phases of the application could not be approved until such time as a precise plan was submitted. 7. On motion of Commissioner Copelin, seconded by Comm. Lind, Use Permit application No. 337 was GRANTED for fee parking only by the following roll call vote, to wit: ALL AYES. TENTATIVE MAPS #x3145 Presented to the Commission was the Tentative Map of Tract No. 3145 being a subdivision of Lot 814 and Lot 914 First Addition to Newport Mesa Tract as recorded in Book 9, Page 61, Miscellaneous Maps, Records of Orange County, Calif. This tract is to be an industrial development consisting of 32 lots and will be located in the area known as the "Superior Avenue Annexation ". • On motion of Commissioner Lind, seconded by Comm. Smith, Tentative Map No. 3145 was APPROVED,subject to the following conditions,by the following roll call vote, to wit: ALL AYES 1. That an additional 10' from Lots 1 and 32 be deeded to the City for Street purposes. 2. Suggested to the Subdivider that the planting in parkways recommended by the Parks, Beaches and Recreation Commission be followed which will be reviewed by the Architectural Control Committee when the applicant or sub- sequent owners submit plans for land- scaping entire front yard setback as required in M -1 -A District. • Page - 7 - • FINAL MAPS #3097 Presented to the Commission was the Final Map of Tract No. 3097 being a portion of Lot 157, Block 53 of Irvine's Subdivision. On motion of Commissioner Smith, seconded by Comm. Lind,. and carried, the Final Map of Tract No. 3097 was APPROVED subject to the following conditions:- 1. Subdivider to dedicate and improve the boundary street, Holiday Road, in accordance with the requirements of the City Engineer. 2. Subdivider to provide tree planting within tract in accordance with recommendations of Parks, Beaches and Recreation Commission per its letter of March 20, 1957 or any changes mutually agreed upon. 3. Commissioner Longmoor suggested to the Commission that the entire evening of the regular meeting on July 18, 1957 be devoted to the hearing on the Master Plan and that said meeting be adjourned until July 25, 1957 at 8:00 P.M. at which time other matters could be heard.
