On motion of Commissioner Agee, seconded by Commis-
sioner Martin,.and carried, the following officers
were elected for the fiscal year 1971 -72 (confirm-
ing actions taken and recorded at the afternoon
study session of July 1, 1971):

Curt Dosh was nominated as Chairman by Commissioner
Adkinson, seconded by Commissioner Martin, the vote
being all Ayes. Commissioner Dosh abstained from.
voting.
Don R. Adkinson was nominated as 1st Vice Chairman
by Commissioner Glass, seconded by Commissioner
Martin, the vote being all Ayes. Commissioner
Adkinson abstained from voting.
Gordon Glass was nominated as 2nd Vice Chairman by.
Commissioner.Martin, seconded by Commissioner
Adkinson, the vote being all Ayes. Commissioner
Glass abstained from voting.
Jackie Heather was nominated as Secretary by Commis
sioner Martin, seconded by Commissioner Hazewinkel,
the vote being all Ayes. Commissioner Heather ab-
stained from voting.
Chairman Dosh welcomed the three newly,appointed
members to the Planning Commission, William Agee,
William C. Hazewinkel and Jackie Heather.

Chairman Dosh pointed out that.these hearings had
been postponed from the meeting of June 17th, at
which time the applicants' representative had
spent a good deal of time explaining the applica-
tions to the Commission. Since there are now
three new Commissioners,.Chairman Dosh questioned

whether the applicants would be willing to accept
the new Commissioners on the basis of their review
of the applications, the Minutes and the staff
reports and any other remarks the applicants may
wish to make, or whether they. preferred to repeat,
their original presentation.

Mr. John Hooten addressed the Commission and state
that he had been elected as spokesman for the appl
-
cants and they felt the new Commissioners were
qualified to act on these applications. He noted
further that the applicants endorsed the staff's
recommendation that.these applications be postpone
until August 5th and that hopefully they would, be
included in some study sessions between now and th
t
time, both for a discussion and to acquaint the
new Commissioners with the problem. '

Acting Community,Development Director Hewicker
commented that all the Commissioners have th.b staf
report of June 3rd which indicates that the.appli-
•
cations do not meet the qualifications for a vari-
ance and this is still the opinion of the staff.
Mr. Hewicker referred to. a map on the wall sihowing
areas in Newport Center in the C -p -H zone. 'He
noted further that the staff is working with`the
applicants and also the Irvine Company to come up
with a more equitable way of calculating parking.

requested to furnish the staff with an inventory o

floor areas, number of parking spaces assigned to
each area and the way these various requirements
work out when calculated on a basis of absolute

further anticipates that by the end of the week,
additional information will be received from the
Irvine Company so.that by the study session on
August 5th a method or alternative methods for
calculating parking in areas like Newport Center
may be presented together with recommendations to
schedule public hearings on amendments_to the
zoning code rather than the granting of variances
which,are felt not to be justified.

Mr. Ed Giddings, the architect for Mr. John
McNaughton, the applicant under Item 4 was present
and stated he was ready to display his design.
However, since the recommendation was to continue
all five applications until August 5th, the Commis-
sion indicated they would rather wait until that
date.

Senior Planner Nuzum presented the application to
the Commission and noted that approval of this
tract would, in effect, be rezoning the subject
property, therefore it was staff's opinion that_
the matter should be continued until August 5,
1971 so it could be considered at a public hearing,
with legal advertising and posting of the.property.
At the time the area (commonly referred to as the
Moden Annexation) was annexed, staff recommended that.
it be zoned to a less restrictive zone; .however,
after several public hearings, with a large turn

out of residents in the.area_ expressing a desire
for the R -1 -B -2 zone, the Commission concurred
with the wishes of the majority.of the residents.
The adoption of the R -1 -B -2 zone created 77 non-
conforming parcels and 28 conforming parcels (in-
cluding the three comprising the subject property).
Acting Community Development Director Hewicker
stated that the entire "Moden" area is under study
in order to come up with a zoning that will more
nearly meet the development of the area.
Mr. Ron Winterburn, representing Burgess- Donovan
addressed the Commission and stated in his opinion
the matter should be heard at this meeting and
questioned the reason for a public hearing.
The Commission discussed this at length and it was
the consensus of opinion that since the property
owners had shown such great interest at the time
the area was zoned, that this tract should be the
